AN ORDINANCE ESTABLISHING AND IMPOSING HEALTH AND


SAFETY PROTOCOLS, RULES AND REGULATIONS TO PREVENT
THE SPREAD OF CORONAVIRUS VIRUS DISEASE (COVID-19)
AND FUTURE HEALTH THROUGH EPIDEMICS/PANDEMICS,
IMPOSING PENALTIES OF IMPRISONMENT FOR VIOLATION
THEREOF AND PROVIDING FUNDS THEREFOR.

WHEREAS, sometime in January 2020, our country and nation


was attacked by the indiscriminate and deadly Coronavirus disease
(COVID-19);

WHEREAS, the World Health Organization (WHO) has declared


COVID-19 as world pandemic;

WHEREAS, to avoid COVID-19, the Philippine Government,


through President Rodrigo R. Duterte, on March 9, 2020, through
Proclamation No. 922, S-2020, has declared the entire Philippines,
under a “State of Public Health Emergency” and took precautionary
and re-medical measures, particularly expanded Community
Quarantine (ECQ) imposed in the whole country especially in the

National Capital Region (NCR) with attendant health and safety


protocols, rules and regulations;

WHEREAS, on June 1, 2020, to bring back to normal our nation’s


life and economy make it alive and kicking to attain pre-set economic
goals and enhance national economic growth, President Duterte, upon
the recommendation of the Inter Agency Task Force for the Emerging
Infectious Diseases (IATF-EID), downgraded the Expanded
Community Quarantine (ECQ) to General Community Quarantine
(GCQ) in Metro Manila, Davao City, Cagayan Valley, Central Luzon,
Pangasinan and Albay, while the rest of the country will be under the
more relaxed Modified General Community Quarantine (MGCQ);

WHEREAS, GCQ allows the resumption of works and operation of


establishment as stated in the “Omnibus on the Implementation in the
Philippines” issued by the IATF-EID. This is referred to as the NEW
NORMAL;

WHEREAS, from the words of Secretary Harry Roque, the NEW


NORMAL, is a CRITICAL NORMAL. It cannot be the same as the
NORMAL where COVID-19 was not yet around. It is the NORMAL,
wherein we put back out national (economy) to its toes and keep it

alive and kicking but we still have to face and tangle with the
indiscriminate, dreaded, deadly COVID-19 which is still in our midst;

WHEREAS, as amended above, COVID-19 is indiscriminate,


dreaded and deadly. It choses no particular places and victims to
attack. As a result, the number of COVID-19 victims in the Philippines
has sporadically increased and keeps increasing. From 10,794 case of
COVID 19 sick people nationwide (confirmed cases), 719 deaths and
1,924 recoveries on May 10, 2020, to date, the latest figures have
rose to 54,222 confirmed cases, 1372 deaths and 14,037 recoveries.
In the Province of Ilocos Sur alone, records of the PGIS Action Center
COVID Update dated July 11, 2020 revealed the 5 th confirmed cases of
COVID-19 in the person of IS-C%, 37 years old male, resident of San
Ildefonso, Ilocos Sur;

WHEREAS, the sporadic increase of COVID-19 confirmed cases


and deaths is due to lack of discipline of the people in violating
quarantine health and safety protocols, rules and regulations;

WHEREAS, during the meeting of the government task force in


Davao City on July 7, 2020, DILG Secretary Eduardo Ano, has
encourage Mayors to pass Ordinance imposing penalty of

imprisonment for violators, he saying, to wit “We have encouraged


our mayors to pass ordinances that the implementation will be
uniform and all violators should be punished with imprisonment so it
will serve as a lesson and they will no longer violate (quarantine
measures)”;

NOW THEREFORE, upon motion of Hon. Constante T. Oandasan


be it enacted by the Sangguaninang Panlalawigan of the Province of
Ilocos Sur, in session assembled, that:

SECTION 1. This piece of legislation be known as “Ordinance


Imposing Imprisonment for Violation of COVID-19 Health
and Safety Protocols, Rules and Regulations”.

SECTION 2. Coverage. - This Ordinance shall include in


coverage all persons; homes/residences’ educational institutions;
work places; commercial and industrial establishment; public
transport; open public places; and other places not mentioned
above where groups of people not mentioned above where groups
of people gather together.

SECTION 3. Health and Safety Protocols, Rules and


Regulations for Individual Persons. - All individual persons
must observe the following health and safety protocols, rules and
regulations:

1. Frequently wash the hands with soap and water of spray


alcohol for at least twenty (20) seconds.
2. Avoid touching the eyes, nose, and/or mouth with
unwashed hands.
3. Practice good hygiene etiquette, Including covering
coughs and sneezes with clean handkerchief.
4. Avoid close contact with people who are sick or with flu -
like symptoms.
5. Stay home if sick.
6. If you develop a fever, cough, or difficulty one thing, seek
medical care early with a doctor, clinic or hospital.
7. Take particular precaution while traveling.
8. All individual persons must wear a face mask when going
out of the home/residence.
SECTION 4. Health and Safety Protocols, Rules and
Regulations for Homes/Residences. - The following health

and safety protocols, rules and regulations shall be observed in all


homes/residences:

1. The home/residence must be cleared, kept orderly and in


habitable condition every day both inside and outside.
2. Inside in particular. The kitchen sink, lavatory or bathroom
and toilet/comfort room must be cleaned and sanitized
daily with proper and effective cleaning and sanitizing
agents. The furniture, appliances, gadgets like computers,
telephones, if any, apart from being cleaned, must also be
sanitized daily.
3. Outside, the yard, parking area, if any, door/s, windows,
walls, must also be cleaned and sanitized daily.
3.1 A mini-sanitizing booth or a bottle of alcohol
permanently installed or placed beside the door must also be
made available therein for the resident’s occupants of the
house and visitors to sanitize their hands before entering the
house/residence.
4. When talking with each other especially at close contact,
occupants/residents of the home/residences and door
neighbors, in the case of now houses of series of
apartments, must wear face mask.

SECTION 5. Health and Safety Protocols, Rules and


Regulations for Educational Institutions. - The following
health and safety protocols, rules and regulations shall be
observed in all educational institutions:

1. No employee, Teacher/professor, and/or student shall be


allowed to enter the school and its premises without
wearing a face mask.
2. At the entrance of the school or mean it, there must be
placed a sanitizing booth equipped with a large bottle,
container off alcohol where all who enter the school and
its premises can sanitize their hands.
3. All schools must have a clinic with at least one (1) doctor,
one (1) nurse to serve the health needs of employees,
teachers/professors and students.
4. At the entrance of the school, there must be posted a
licensed security guards who will serve as guide to
enforce the wearing of face mask and the necessary
health and safety protocols, rules and regulations in the
school.

5. There must be a separate comfort rooms for the males


and females, which must be cleaned and sanitized daily
with proper and effective leaning sanitizing agents.
6. The offices of the officers of the school, the door/s and
windows, including the furniture, filing cabinets, shelf,
gadgets and like computers/telephones must also be
cleaned and sanitized daily with proper and effective
cleaning and sanitizing agents. So with the classrooms,
teachers table, white board/ black board, and
chairs/desks of the students. So with the laboratories of
the school, including the chairs, laboratory tables and
equipment. So with the various other offices of the school
such as the accounting department and cashier’s
booth/office.
7. In the Accounting Department and Cashiers booth office,
there must be placed to prevent the spread of the
COVID-19 virus, paper, and plastic barriers on that part of
portion thereof where the students used to transact
official business such as having their tuition and other
fees assessed and/or paid.
8. The canteen of the school, if any must also be cleaned
and sanitized daily, including the chairs, tables, kitchen

wares such as spoons and forks with proper and effective


cleaning and sanitizing agents.
8.1 There must also be placed at the counter where
customers order and pay their food pack in thin, paper
plastic barriers to prevent the spread of the COVID-19
virus.
9. Social distancing which means a distance of one (1)
meter between two (2) persons shall be imposed and
enforced in all parts of the school and its premises,
provided that, in the classroom and laboratories, the
students who are all wearing masks shall be at least be
seated or (1) seat or desk apart.
10. Finally, in case there is or there are students,
teachers, professors or employees who has or show flu-
like or COVID-19 symptoms, he/she or they must be
immediately separated from the rest and brought
immediately to the school clinic for immediate medical
attention.

SECTION 6. Health and Safety Protocols, Rules and


Regulations for Work Places. - The following health and safety
Protocols, Rules and Regulations shall be observed in all work places.

1. No company/business entity officer or employee shall be


allowed to enter the company/business entity and its
premises without wearing a face mask.

2. There shall be posted a licensed security guard or guards


at the entrance of the workplace building or buildings who
shall serve as frontliners to enforce the wearing of face
masks and the necessary health and safety protocols,
rules and regulations.

3. On personal and company hygiene:


3.1 Management shall establish daily disinfection
procedures;
3.2 There must be handwashing stations at the entrance
of the building with proper hand hygiene reminders
where officers employ shall be required to wash their
hands with soap and water, or sanitize the same with
alcohol.
3.3 Common areas must be cleaned and disinfected at
the end of the day and at the end of each shift.
3.4 Management shall provide proper equipment and
materials, i.e., tissue papers, soap, alcohol, disinfectants,

etc., to promote hygiene and prohibit sharing of tools to


minimize the spread of the virus.
3.5 All tools and machinery must be cleaned and
disinfected and increase cleaning and disinfection at the
end of the day.
3.6 Clean and disinfect computers and other gadgets and
desks keyboards, mouses and the phones at the end of
the day with anti-bacterial cleaners and disinfectants and
leave desks empty.
3.7 Company/business entity officers, including door/s
and windows, chairs, tables, filing cabinets, shelves,
computers and other gadgets and telephones must also
be cleaned and disinfected every day with proper and
effective cleaners and disinfectants.
3.8 There must be separate comfort rooms, for males and
females complete with hygiene provisions such as
tissue/toilet paper, soap and disinfectants.

4. On Facilities and equipment:


4.1 Stop elevator use whenever possible. If that is not
possible, restrict use of elevators to two (2) people at a

time. In the case of escalators, riders must be at least one


(1) meter apart from each other.
4.2 Sharing of items such as pens, pencil, phones,
cellphones and etc., must be stopped.
4.3 Printers and photo copiers after each use or find
alternative solutions to their use.
4.4 Protocols should be established to move in a
clockwise direction in corridors, hallways and narrow
spaces.

5. On Social Distancing
5.1 Social distancing which means a distance of one (1)
meter between two (2) persons shall be observed in all
parts and premises of the work place, including its
buildings.
5.2 Employees gathering in common spaces (entrances)
exits, stair-wells/stairways and inside trailer offices and in-
person meetings or in a closed room shall be avoided.
5.3 Flexy glass panes shall be installed when social
distancing cannot be 100% respected.

6. On Health Concerns and Quarantines.

6.1 The Company/Business entity shall have at least one


(1) medical clinic to service the health needs and concerns
of the employees and shall have one (1) or more doctor/s
and nurse/s, depending upon the labor population or
number of employees. The medical staff shall also wear
face masks.
6.2 In case an employee/s show any sign of COVID-19
symptoms, he/she or they shall be taken immediately to
the medical clinic to appropriate medical attention, and be
required to undergo quarantine.

7. On Other Matters
7.1The company/business entity shall have a canteen too
attend to the meal and food needs of the employees. It
must also be cleaned and sanitized every day, including
the chairs, tables, kitchen wares, with proper and effective
cleaning and sanitizing agents.
7.2 There must also be placed at the counter or that
part of the canteen where the employees/customers
pay their food purchased, thin papers plastic barriers to
prevent the spread of the COVID-19 virus.

SECTION 7. Health and Safety Protocols, Rules and


Regulations for Commercial and Industrial
Establishment. - The following health and safety protocols,
rules and regulations shall be imposed/observed in all
commercial establishments:

1) No employees and customers of the commercial


establishment shall be allowed to enter the same
without wearing a face mask.
2) At the entrance of the commercial establishment,
there shall be placed, a sanitizing booth of alcohol
where all who enter the establishment are required
to sanitize their hands.
3) At the entrance, there shall also be posted a licensed
security guard or guards who shall serve as
frontliner/s to enforce the wearing of facemask and
the necessary health and safety protocols rules and
regulations. In the absence of a sanitizing booth or
station, the guard or guards shall sprinkle the hands
of all those who enter with alcohol, requiring them to
sanitize their hands.

4) The security guard or guards shall also take the body


temperature of all those who enter the
establishment, using digital thermometer for the
purpose. And those who have or appear to have
fever shall not be allowed to enter.
5) There must be a separate comfort rooms for the
males and females, which must be cleaned and
sanitized every day with proper and effective
sanitary agents and equipped with complete
sanitized materials such as hand soap, alcohol and
tissue/toilet paper.
6) The floors of the commercial establishment shall also
be cleaned and sanitized daily with proper and
effective cleaning and sanitizing agents. So with
chairs and tables at the food court of the
establishment.
7) The offices in the commercial establishment such as
those of the manager and other officers, including
the tables, desks, chairs, shelves, computers,
telephones, shall also be cleaned and sanitized daily
with proper and effective cleaning and sanitizing
agents.

8) Social distancing which means a distance of one (1)


meter between two (2) persons shall be observed in
all parts of the commercial establishment.
9) In the cashiers booths, there must be placed thin
papers plastic barriers between the cashier and the
customer to prevent the spread of the COVID-19
virus.
10) In the case of banks/lending institutions, apart
from the foregoing health and safety protocols and
regulations there must be placed in the whole areas
of the New Accounts and Tellers, Counter, thin
papers plastic barriers between the staff and
customers who transact business to prevent the
spread of the virus.
11) So, with the case of pawnshops, money/cargo
transfer establishments like Cebuana, LBC, etc.
There must be placed the same plastic barriers
between the staff and customers who transact
business, to prevent the spread of the virus.
12) In the case of restaurants, canteens, coffee shops
and the like, apart from the foregoing health and
safety protocols, rules and regulations, there must

also be placed at the food counters, said plastic


barriers, between the employee/staff and the
customers, who order and pay them foods, to
prevent the spread of the virus.
13) In the class of sari-sari stores, there must be
placed the same plastic barriers between the sari-sari
store owner/attendant and the customers who buy
retain, goods, to prevent the spread of the virus.

SECTION 8. Health and Safety Protocols, Rules and


Regulations for Public Transport. - The following health and
safety protocols, rules and regulations shall be observed in all public
transport:
1. At the entrance of the vehicle, whether at the back or
side of the vehicle, there must be placed in a
permanent receptacle or container, a bottle of alcohol,
which passengers boarding on and off the vehicle are
required to sanitize their hands. Same thing in the case
of the entrance beside or near the driver’s booth, the
permanent receptacle or container of the bottle of
alcohol, being placed on the dashboard beside the
entrance.

2. No passenger not wearing a face mask shall be allowed


to board a vehicle.
3. Social distancing shall be applied among the
passengers. In the case of seats facing each other, like
in a jeepney, there must be a distance of at least three
(3) feet between and among the passengers. The seat
beside the drivers must be occupied by only one (1)
passenger.
3.1 In the case of buses, or mini-bus, the seat used to
be occupied by only one (1) passenger; the seat used
to be occupied by only one (1) passenger; the seat
used to be occupied by three (3) passengers must be
occupied by only two (2) passengers. In the case of
seats facing each other, there must also be a distance
of at least three (3) feet between and among
passengers.
4. Proper personal hygiene (Section 3) shall be observed
by all the passengers in particular, whereon coughing
or sneezing they must cover the same with a clean
handkerchief.

SECTION 9. Health and Safety Protocols, Rules and


Regulations for Open Public Places. - This refers to public places,
squares, through multipurpose pavements, basketball courts, courts
and the like. The following health and safety protocols, rules and
regulations shall be observed therein:

1. There must be placed in a strategic place of the area, a


sanitizing booth or station equipped with hand soaps or
a bottle of alcohol where people who go to and fro in
the place are required to sanitized their hands as
frequently as possible, depending upon the activity
they do in the place.
2. Every individual person who goes to and fro in the
place should wear a face mask.
3. There should be assigned or posted in the area at least
one (1) or two (2) licensed security guard/s who shall
serve as frontliners in the place to enforce the wearing
of face mask, sanitizing of the hands and other
pertinent health and safety protocols, rules and
regulations. The security guard/s shall have the power
to segregate and drive away the occupants or users of
the place without a face mask.

3.1 the assignment or posting of the security guard/s


shall be at the expense of the Local Government Unit,
in the case of public plaza, squares or triangles. In the
case of privately owned open public places, like a
multipurpose pavement, open halls, basketball court
and tennis court, shall be at the expense of the owner
or operator thereof such as homeowners association.

3.1.1 Apart from the functions in parts hereof, the


security guard/s shall take the body temperature of
occupants/users of the place with a digital
thermometer. Those found out to have fever and/or
symptoms of flu-like disease or COVID-19 disease
shall be required by the guard/s to leave the place.
4. Social distancing which means a distance of one (1)
meter between two (2) persons shall be observed in
the place. Again, the security guard/s shall enforce
this.

SECTION 10. Health and Safety Protocols, Rules and


Regulations in Other Places not mentioned in the foregoing

where group of people, may gather or passed by.- This refers to


subdivision involves or gateways, among others. The following health
and safety protocols, rules and regulations shall be observed therein:

1. At the entrance of the subdivision, there shall be a


frontliners station, there shall be one (1) or two (2)
licensed security guards and at least five (5) staff the
barangay government who will serve as frontliners to
force wearing of face masks and sanitizing and other
health and safety protocols, rules and regulations.
2. No person shall be allowed to enter into or get out of
the subdivision without wearing a face mask. In the
frontlliner’s station, there shall be a sanitizing booth
equipment with at least one (1) large bottle or
container of alcohol where residents and outsiders who
enter into or get out from or pass by the subdivision,
shall be required to sanitize their hands. The frontliners
themselves shall enforce and administer the sanitizing.
2.1 All vehicles which enter into or get out or pass by
the subdivision shall also be required to be completely
sanitized by spraying thereto with its windows with
proper and effective sanitizing agents and chemicals.

3. The frontliners shall also get the body temperature of


all those who enter into or get out or pass by the
subdivision, with digital thermometers.
3.1 All those who are found out to have fever and/or
symptoms of the like disease or COVID-19 disease,
shall be refused to entry into or exit from the
subdivision and sent to the nearest clinic or hospital for
proper medical attention and quarantine.

SECTION 11. Compulsory Requirement for


Hospitals/Clinics. - Apart from the requirements of cleaning and
sanitizing as discussed above, hospitals/clinics are required to have a
separate ward/wards for COVID-19 victims to prevent the spread of
the virus/disease; to have a separate emergency area for Coronavirus
infected suspects or people showing symptoms of the disease.

SECTION 12. Universal Application of the Ordinance. - This


Ordinance does not only apply to the COVID-19 disease/pandemic but
to similar future health threats/epidemics/pandemics. The same
health protocols, rules and regulations shall be observed.

SECTION 13. Implementation .- (a) The Provincial Office of the


Department of Health and Provincial Sanitary Engineering Office with
the Cooperation of the Municipal Sanitary Engineering Offices and
other Offices of the Barangay Chairman/Chairpersons of the
Municipalities shall be the lead government agencies in implementing
this Ordinance. They shall field and assign their personnel’s on a
barangay to barangay basis to conduct surprise, unscheduled at a
random visits and inspection of homes/residences, schools,
commercials and industrial establishments, public transport
groups/associations offices, vehicles and terminals and all entities
covered by this Ordinance as mentioned in Section 2 hereof.
(b) In the Inspection particularly of Public Transport/Utility Vehicles,
the Philippine National Police (PNP) and Provincial Highway Patrol
Group shall assist the aforesaid lead government agencies in
implementing this Ordinance.

SECTION 14. Implementing Rules and Regulations. - The


Provincial Office of the Department of Health and the Provincial
Sanitary Engineering Office shall be responsible for the formulation of
the Implementing Rules and Regulations of this Ordinance.

SECTION 15. Penalties. - Any violation of this Ordinance or


Section, provision or part hereof shall be meted a penalty of:

A fine P1, 000 for the first offense;


A fine P2, 000 for the second offense or 10 days
imprisonment;
A fine P5, 000 and 10 days imprisonment for the third
offense;

SECTION 16. Definition of Terms. - The following terms as


used in this Ordinance, shall mean:
1. Epidemic- It refers to a widespread occurrence of an
infectious disease in a community at a particular time.
2. Pandemic- An epidemic occurring worldwide, or over
a very wide area, crossing international boundaries,
and usually affecting a large number of people.
3. COVID-19- From the words of the World Health
Organization (WHO) Director-General in his opening
remarks at the media briefing on COVID-19 on 11
March 2020, it is “a pandemic sparked by a
Coronavirus. This is the first pandemic caused by a
coronavirus.”

4. Enhance Community Quarantine (ECQ)- It is a


kind of quarantine characterized by the following: (a)
stringent quarantine measures; (b) public
transportation systems are suspended; (c) only
essential businesses and services are allowed to
operated; and (d) subject to further evaluation before
transitioning to General Community Quarantine (GCQ).
5. General Community Quarantine (GCQ)- It is a kind
of quarantine characterized by the following: (a)
relaxed quarantine measures; (b) public transport are
allowed but in reduced capacity; (c) 50-100% re-
opening of selected establishments subject to minimum
health standards; (d) is no further deterioration, GQC
will be relaxed further for normalization.
6. Modified General Community Quarantine
(MDCQ) - A classification of quarantine which is a
level under GCQ. It contains a level called “new
normal” which was introduced sometime in June 2020.
An area needs to be placed under normal measures. It
is the most relaxed form of quarantine.
7. Residences- it refers to a building or structure for
abode or residential purposes, whether free, rented or

otherwise. It includes dormitories, pension houses,


apartments for rent and the like.
8. Commercial Establishment- It means any income-
producing or non-profit, including but not limited to
those used for retail, whole sale, dining, offices,
professional services, automobile services, hotels,
motels and restaurants. It includes sari-sari stores,
department stores, coffee shops, canteens, banks,
lending companies, bookstores and the like.
9. Industrial establishment- An establishment
involving manufacturing assembling, fabricators,
processing, bulk handling of products, large amounts of
storage, warehousing and heavy trucking’s in addition
to lighter industrial activities consisting of uses
involving the processing, handling and creating of
products.
10. Public Transport- A system of transport in contrast
to private transport, for passengers by group travel
systems available for use by the general public,
typically managed on a schedule, operated on
established routes, and that charged a posted fee (or

fare) for each trip. This includes, jeepneys, buses,


among others.
11. Open public places or space- A open piece of land
both green space or hard space to which there is a
public access. It is located outdoor not indoor. It may
be owned by a national or local government, by a
public body (e.g., a non-profit organization and held in
trust for the public, or by a private individual or
organization but made available for public use or public
access).
12. Health and Safety Protocols, Rules and
Regulations- It refers to standard requirements and
practices that a person or community must do to stay
healthy and be safe from a disease, epidemic or
pandemic, such as Wearing of face mask and sanitizing
the hands.
13. Social Distancing- It means a distance of three (3)
feet or one (1) meter between two (2) persons in order
to avoid the spread of a virus or disease.
14. Frontliner- It refers to people who work on the front
line of a disease spread prevention operation such as
prevention of the Coronavirus disease (COVID-19).

They are subject to risk of being infected by the virus


or contracting the disease.

SECTION 16. Separability Clause.- If for any reason, any


section or part of this Ordinance is declared unconstitutional or
invalid, the rest of it which are not so declared shall remain valid,
binding and of legal force and effect.

SECTION 17. Repealing Clause.- All Ordinances, Memorandum


Orders in circulars, Provincial Executive Orders, rules and regulations
and similar issuances inconsistent with this Ordinance or any of its
provisions are hereby repealed, amended or modifies accordingly.

SECTION 18. Effectivity. - This Ordinance shall take effect


fifteen (15) days after its publication in a newspaper of general
circulation in the Province of Ilocos Sur.
