COMPROMISE AGREEMENT

      This Agreement executed this ___day of _________, 2018 at

_____________________, La Union, by and between:

ROBERT F. TRIA, Filipino, of legal age, married and resident of

Brgy. Bulala, Bacnotan, La Union (hereinafter referred to as “private
complainant”);

-and-

   
ELI P. CARDINEZ, Filipino citizen, of legal age, married and
resident of and with postal address at Brgy. Carcarmay, Bacnotan, La
Union, (hereinafter referred to as “the accused”).

  
WITNESSETH:  That -

      WHEREAS, the private complainant have instituted a criminal

action for QUALIFIED THEFT/THEFT against ELI P. CARDINEZ,
Ireneo Dumale, Julius Dumale, and Rommel B. Cawaing relative to
Criminal Case No. 12818, now pending at the Regional Trial
Court - Branch 66, San Fernando City, La Union;

        WHEREAS, the parties desire to buy peace and wish to avoid a

protracted litigation in this case;

      NOW THEREFORE, in consideration of the foregoing and the

further covenants hereinafter set forth, the parties agree as follows:

4. Provided, however that the foregoing undertakings shall only
commence after the Honorable Court has approved this Compromise
Agreement and has dismissed the above-described criminal case.

5. That private complainant, Robert F. Tria, by these presents,

and for and in consideration of this compromise agreement and
after full and complete satisfaction of the provisions of this
compromise agreement from the accused/defendant, Eli P.
Cardinez, hereby declares that he has no further claims
whatsoever against him and that he hereby releases and forever
discharges the said accused/defendant from any and all claims,
demands, cause of action, or liability of whatever nature arising
out of the said criminal case;

6. That private complainant further manifests that the

aforementioned obligation payment he will receive from herein
accused/defendant, Eli P. Cardinez shall be in full and final
settlement of all his claims from the latter, including those
treated in the above-described criminal case and that the
payment received as provided herein should not in any way be
construed as an admission of guilt and/or liability on the part of
herein accused;

7. Upon full delivery of payment of obligation by herein

accused/defendant, Eli P. Cardinez in favor of the private
complainant, subject of this Compromise Agreement between the
private complainant and the accused/defendant, the parties shall
waive, cease and desist from any action against each other in relation
to the obligation by herein accused subject of the criminal case
described from the foregoing;

8. That this Compromise Agreement / Settlement of Any and

All Claims constitutes a Release, Waiver and Quitclaim and that
no further claim, suit or proceeding of whatever nature may be
filed in any court or agency of the government against the herein
accused/defendants or any person acting in their interest, since
any and all claims of the subject private complainant have been
finally settled once and for all.

9. The signatories to this Agreement hereby represent and warrant

that they are duly authorized to execute this Agreement;

10. The foregoing covenants are not contrary to law, morals, or

public policy and the parties bind themselves to comply strictly with
their undertakings; and

11. While this Compromise Agreement nor anything contained
within it shall not be admissible in any proceeding as evidence of
liability or wrongdoing on the part of either party, this Compromise
Agreement may be introduced in any proceeding instituted to
enforce its terms.

AS SUCH THEREFORE, the parties hereto respectfully pray that the

Honorable Court approve this Compromise Agreement and the above-
described criminal case against herein accused, ELI P. CARDINEZ be
DROPPED.

IN WITNESS WHEREOF, we have hereunto set our hands this

 The foregoing instrument relates to a Compromise Agreement
anent the civil aspect of Criminal Case No. 12818 pending before the
Regional Trial Court-Branch 66, San Fernando City, La Union
consisting of four (4) pages, including the page on which this
acknowledgment is written, and has been signed at the bottom and on
the left hand margin of each and every page by the parties and their
instrumental witnesses, and sealed with my notarial seal.
