Moot Problem

Manoj, age 14 and Ajay 16, both were friends. One day Ajay asked
Manoj to accompany him to Karan’s place at Paltan Bazar, Guwahati.
When they arrived at Karan’s place his younger brother Shyam who
was around 8 years of age told him that Karan had accompanied their
mother to Guwahati City Hospital for medical check up. They asked
Shyam where Karan’s room was. Shyam took them to Karan’s room
left them there to continue to watch cartoon show in the living room.
After a while there was sound of sudden gun fire from the Karan’s
room. Before Shyam could react he saw Ajay leaving the room of
Karan with a gun in his hand. Shyam panicked and he went towards
Karan’s room where he found Manoj lying in a pool of blood. By that
time a neighbour came rushing to the house on hearing the sound of a
gunshot, later on he informed the local police.

Meanwhile, Ajay called up Karan on his personal mobile from an

undisclosed place and told him that the gun misfired on Manoj. Ajay
told him that he need not panicked and that he will find a way out.
When Manoj arrived at his house the Investigating Officer, the rank of
Sub Inspector, immediately arrested Karan, age 17 years and 10
months, on charges of murder of Manoj and keeping of arms in his
residence. The police took suo moto cognizance of the case and
registered FIR against Karan and Ajay U/s 302/34/120 B IPC rw S.
25(1) of the Arms Act.

Meanwhile Ayay who is absconding have applied for anticipatory bail

in the Court of the District and Sessions Judge, Kamrup.
