Subject- “Regarding complaint against TMC leader's namely, Alamgir Hasan


Chowdhury alias Rajesh and S.K. Laltu for alleged violence in the Hindu Para,
Hiyatpur area, Arandi 2 GP, under Arambagh police station in Hoogly Rural District
of West Bengal”

Sir,

National Commission for Protection of Child Rights (hereinafter referred to as the


Commission) is a statutory body constituted under Section 3 of the Commission for
Protection of Child Rights (CPCR) Act, 2005 to protect the child rights and other related
matters in the Country. The Commission is further mandated to monitor the proper and
effective implementation of Protection of Children from Sexual Offences (POCSO) Act,
2012; Juvenile Justice (Care and Protection of Children) Act, 2015 and Right to Free and
Compulsory Education (RTE) Act, 2009. In one of the functions laid down under Section
13 of the CPCR Act, 2005, the Commission has been assigned the function of inquiring into
complaints and to take suo-moto notice of matters related to deprivation and violation of
child rights in the country.

2. Since the conclusion of election polls in the State of West Bengal, there are many
incidents of violence being reported across the State which has made the people in the State
vulnerable and at imminent risk of danger and harm, especially children. In relation to these
incidents of violence, the Commission has received a complaint concerning the safety and
security of families especially children in these present incidents of violence. The
Commission has come across a complaint regarding a heinous crime committed by a mob
led by two TMC leader's, namely, Alamgir Hasan Chowdhury alias Rajesh and Sk Laltu in
the Hindu Para of Hiyatpur area, Arandi 2 GP, under Arambagh police station in Hoogly
rural district of West Bengal. As per complaint, in continuation of the TMC sponsored post-
poll violence, these TMC musclemen led by above named, entered the Hindu para area of
Hiatpur with a mob and dragged out women and children from their houses, molested them,
thrashed them and looted their houses. The complainant further alleged that the Local
Thana in-Incharge Mr. Partho Sarathi Halder and Hoogly SP Rural Mr. Amandeep Jakhu,
IPS, strangely ignored repeated distress calls made by the residents, while this heinous
crime was unfolding and had not taken any preventive measures. Further, the complainant
alleged that the most saddening part about this entire episode is, that, policemen stood as
mute spectators ignoring their duty to protect these victims and take these criminals to task.

3. In view of the serious nature of incident posing a threat to the safety of the innocent
families especially children and their rights which causes immense emotional and
psychological trauma for a lifetime, the Commission has taken cognizance under Section
13(1)(j) of the CPCR Act, 2005 in this matter.

4. Prime-facie, it appears to be violation of Juvenile Justice Act, 2015, POCSO Act,


2009 and IPC. As such, the Commission desires that an inquiry into this incident of violence
should be conducted by lodging an FIR forthwith and the safety and security of the families
and children in the area must be ensured. The Commission also desires that besides
recording the statements of affected families, the statements of affected children of the area
should also be recorded, in a child friendly manner, by the Special Juvenile Police Officers
and made available to the Commission.

5. The Commission also express concern over the role and responsibilities of concerned
Police personnel in the entire episode, who failed to discharge their duties during the said
violence and also failed to maintain the law & order situation of the area, and therefore,
recommends suitable disciplinary action against the concerned Police personnel under
relevant Service / Departmental Act and Rules.

6. An action taken report of the inquiry along with copy of FIR, and other relevant
documents be submitted to the Commission within 03 days.
