MOTION TO IMPOSE SENTENCES

Comes now the State of Alabama, by and through Chris Connolly, District Attorney, for the

11th Judicial Circuit, and hereby moves this Honorable Court to impose the previously suspended

sentences in the above-entitled cases. As grounds for such, the State avers the following:

1. On June 5, 2020, the defendant pled and was sentenced on his conviction of Burglary 3rd

Degree in CC-19-182 to 38 months in the Department of Corrections to be served at the Lauderdale

County Community Corrections felony supervision program; and pled and was sentenced on his

conviction of Escape 3rd Degree to 60 months in the Department of Corrections, suspended for 36

months and Defendant placed on Lauderdale County Community Corrections program.

2. The Defendant was further sentenced on two misdemeanors: Unlawful Possession of

Drug Paraphernalia and Attempted Burglary 3rd Degree 12 months in the Lauderdale County

Detention Center, suspended 24 months.

3. On or about this date, the Defendant was arrested and charged with six (6) counts of

Attempted Murder by the Lauderdale County Sheriff’s Department.

4. This is a violation of the Court’s orders.

Based on the foregoing, the State moves to for an immediate bench warrant and to impose the

Defendant’s sentences to be served in the Alabama Department of Corrections.

BENCH WARRANT

The Court having probable cause to believe that the defendant, Kyle Lyn Seeley has

failed to abide by the terms and conditions of this court, the Court hereby issues a Bench Warrant

and orders that he be arrested immediately and brought before this Court. He is not to be

released before he appears before this Court.

TO THE SHERIFF OR HIS AUTHORIZED DEPUTY:

You are hereby ORDERED to forthwith place under arrest Kyle Lyn Seeley, and confine

him in the Lauderdale County Detention Center and hold him without bond until further

disposition of this case.

Other matters: The defendant shall be held in the Lauderdale County Detention Center

until further order of the Court.
