Sub: Notice Under Section 138(b) of the Negotiable Instrument Act for demand of the amount of the
dishonor of cheque issued by you in favour of my above-named client.

Sir,

Under the instructions of my above-named client his legal notice is being served upon you, which is
as follows: -

1. That you have approached my above-named client for supply of medicines. Having agreed upon the
terms and conditions and after the delivery of the consignment by North Bihar Express consignment
no – 845687 you had signed and issued a cheque for the payment of the consignment, details are
given below:

2. That as per your instruction my above named client presented the said cheque for encashment to its
Banker HDFC, Jamal Road, Patna having A/C no. 50200036672182 and the said cheque was
dishonored by your banker on the ground of “Fund Insufficient” which was communicated to my
client through Memo dated 13.03.2021.
3. That the above facts make it abundantly clear that you have mischievously and intentionally issued
the aforesaid cheque with ulterior designs and instructed my client to present the same for
encashment knowing fully well that the said cheque would not be honored on presentation.
4. That our client further states that this act of you dishonoring the above cheque, attracts the criminal
liabilities to be prosecuted inter alia for offence Under Section 138 of the Negotiable Instrument Act
under which you are liable to be punished with imprisonment for a term which may be extended to
two years, or fine which may extend to twice the amount of the cheque, or with both.

Therefore, by this notice you are hereby called upon to pay my client a sum of Rs. 19995/- and a
sum of Rs. 500/- (Rupees Five Hundred Only) for bank charges and Legal Notice charges through
Demand Draft at the address of the Branch office mentioned above of my above client within a
period of 15 days from receipt of this legal notice failing which my client shall be compelled to
initiate criminal proceeding against you for offence under section 138 of the Negotiable Instrument
Act and you will be held liable for costs and consequences arising thereof.
