JUDICIAL AFFIDAVIT

COMES NOW, the plaintiff together with the undersigned

counsel to this most honorable court, MOST RESPECTFULLY
STATES THAT;

I, PETER BANAG, of legal age, married, Filipino and a resident

of 142 Sigarilyas St., Woodridge, Maa, Davao City, Philippines, after
having been duly sworn in accordance with law, do hereby state
under oath as follows THAT:

PRELIMINARY STATEMENT
1. I was examined by Atty. Jessette Amihope Castor, with office
address at Door 15. 123 Bldg, Rose Street, Davao City, 8000.

2. The examination was held at the same address on November 28,

2020.

3. I am fully conscious that I am answering the questions in English

which I clearly speak and understand.

4. All information and requirements of Sec. 3, A.M 12-8-8-SC was

explained to me by the administering officer; and

5. I am answering the questions with full consciousness that I do so

under oath, and may face criminal liability for false testimony and
perjury.
PURPOSE
This affidavit/testimony is being offered to prove that there was
no doubt that the defendant is legally liable for damages caused to the
plaintiff.
QUESTIONS AND ANSWERS
1. Q. Please state your name, age, marital status, address, and
occupation for the record.
A. I am Peter Banag, of legal age, married, Filipino and a resident of
142 Sigarilyas St., Woodridge, Maa, Davao City, Philippines. I am a
Businessman.

2. Q. Do you know the defendant Arthur Sison?

A. Yes ma’am.

3. Q. What is your relationship with the defendant Arthur Sison?

A. He is my neighbor in Sigarilyas St., Woodridge, Maa, Davao City
since 2005 ma’am.

4. Q. Do you have any proof to substantiate that claim?

A. Yes, I have here the list of homeowners of Sigarilyas St.,
Woodridge, Maa, Davao City, and their corresponding house
numbers which I obtained from our Homeowners Association
President.

5. Q. Is this the document that you are referring to?

A. Yes, ma’am.

6. Q. I am attaching this document to this Judicial Affidavit as Exhibit

“A”, do you affirm my actions?
A. Yes ma’am.

7. Q. Can you tell us what happened on November 18, 2020?

A. It was afternoon of November 18, 2020, my child Mary went to the
house of Arthur Sison to buy ice candy but unfortunately she was
attacked and bitten by the dog owned by Arthur Sison, because of this
my child was brought to a medical clinic.

8. Q. Who paid the medical expenses?

A. Arthur Sison paid for the treatment of her wounds and injection at
that time, however, we paid for the subsequent shots of anti-rabies,
other medical prescriptions and counselling of my child Mary as she
was in trauma of what happened.

9. Q. Do you have proof to substantiate such claim?

A. Yes, I have here the medical bills, receipts of prescriptions, as well
as of the counselling program.

10. Q. Is this the document that you are referring to?

A. Yes ma’am.

11. Q. I am attaching this document to this Judicial Affidavit as

Exhibit “B”, do you affirm my actions?
A. Yes ma’am.

12. Did you asked Arthur Sison for a reimbursement of the

subsequent medical expenses and the cost of counselling program?

A. Yes ma’am, I informed him but he just sent me a letter containing
his refusal to reimburse.

13. 9. Q. Do you have proof to substantiate such claim?

A. Yes, I have here his letter.

14. Q. Is this the document that you are referring to?

A. Yes ma’am.

15. Q. I am attaching this document to this Judicial Affidavit as

Exhibit “C”, do you affirm my actions?
A. Yes ma’am

16. Q. What are you asking this office with respect to this case?
A. I am praying that an action for damages be filed in proper court
against defendant, to recover 50,000 pesos representing the actual
damages incurred and any other damages that the court may deemed
necessary and appropriate.

1. I personally conducted the examination of PETER BANAG, of legal

age, married, Filipino and a resident of 142 Sigarilyas Street,
Woodridge Maa, Davao City, in his judicial affidavit for complaint for
damages against Arthur Sison.

2. I faithfully recorded the questions asked to Peter Banag and the

corresponding answers that he gave; and

3. Neither I nor any other person then present coached and/or, in any

1. That I as the plaintiff in the above-entitled case have caused

this Certificate of non-forum shopping to be prepared; that I
read and understood its contents which are true and correct of
my own personal knowledge and/or based on true records;

2. That I have not commenced any action or proceeding

involving the same issue and specifically the same check/s in
the Supreme Court, the Court of Appeals or any other tribunal
or agency, particularly before the Office of the City Prosecutor
of Davao City; that to the best of my knowledge, no such action
or proceeding is pending in the Supreme Court, the Court of
Appeals or any other tribunal or agency, and that, if I should
learn thereafter that a similar action or proceeding has been filed
