Subject: Construction of the New Khanki Barrage Project – Contract No NKB/ICB-01
Contractor’s Request for Extension of Time for Completion of
Main Barrage Works and Preliminary Works

This is with reference to the Contractor’s above cited letters (Ref-1 & Ref-2) which pertain to
extension of time (EOT) of Main Barrage (BW-01) and Preliminary Works (PW-01) for the period
from July 08,2013 to November 04,2013. In this regard, please note that the mutually agreed
schedule for issuance of Drawings as required under Sub-Clause 6.20 of Special Provisions was
issued on November 04,2013.

Thus, before this date, no delay can be established due to non-issuance of IFC drawings.
Furthermore, contemporary record submitted by the Contractor upon the advice of the Engineer,
don’t depict any valid notice under Sub-Clause 1.9 [Delayed Drawings or Instructions] of GCC of
the Contract. Hence, the Contractor is not entitled for any EOT in case of Main Barrage during the
period from July 08,2013 to November 2013. In this regard, please refer our letter issued vide
letter at ref-4) above. However, please be apprised that the delaying events occurred during the
period from 5th November,2013 to 28th February,2014 have already been considered while
determining EOT -1 (for Main Barrage).

Similarly, we have not seen any valid notice for the delayed issuance of IFC drawings from the
Contractor’s submission for Preliminary Works (PW-01) during the period from July 08,2013 to
November 04,2013. In this regard, please refer our letter at Reference-3) above, through which
detailed comments were conveyed to the Contractor for the disapproval of EOT for the
Preliminary Works.

In both the above said cases, consultation have been made with the Parties to the Contract in
various meetings exhaustively and the Engineer considers that no further consultation is needed
in pursuance of Sub-Clause3.5 of GCC. The Engineer therefore, concludes and Evaluates under
Sub-Clause3.5 that the Contractor is not entitled for any EOT under the relevant provisions of the
Contract for Barrage and Preliminary Works on the basis of delaying events pointed out by the
Contractor through his submission (Ref-1 &2), pertaining to the period from July 08,2013 to
November 04,2013.
