Regional State
የአካባቢ ተፅዕኖ ግምገማ ሰነድ፤ የልማት ሀሳብ WHEREAS, believing that the document of
ሲዘጋጅ፣ በቦታ መረጣ፣ በግንባታ፣ ተግባራዊ environmental Impact assessment is to be a
በሚሆንበት፣ በሚሻሻልበትና በሚቋረጥበት ወቅት process which indicates the impact assessment
as
በአካባቢ ላይ የሚያስከትለውን በጎ ወይም አዎንታዊ እና starting from the plan up to completion, during
ጎጅ ወይም አሉታዊ ተፅዕኖዎች በቅድሚያ በመተንበይ the preparation of development proposal,

በክልሉ የሚታዩ አካባቢ ነክ ችግሮች መነሻ ወይም ምንጭ WHEREAS, as the cause or source of environmental
በአብዛኛዉ ሰዉ ሰራሽ ችግሮች በመሆናቸዉ፤ ይህን ችግር problems mostly are man-made and it has been recognized
ለማስወገድ የሚቻለዉም የሚመለከታቸዉ that it is possible to avoid the same through participation of

በህግ የተከለከሉ ተግባራት መከበራቸዉን ለማረጋገጥ health or environment due to the activity ; as well as to
ensure activities prohibited by law thereof.
የሚያስችል፣ የቅድመ ጥንቃቄ ስርዓት የመዘርጋት ኃላፊነት
ያለበት በመሆኑ፣
የአማራ ብሔራዊ ክልል ምክር ቤት በተሻሻለው የክልሉ NOW, THEREFORE, the Amahara National Regional
ሕገ መንግስት አንቀጽ 49 ንዑስ አንቀጽ 3 (1) ድንጋጌ Council, in accordance with the powers vested in it pursuant
በተሰጠው ሥልጣን መሠረት ይህን አዋጅ አውጥቷል:: to the provision of sub-article(3) of article 49 of the revised
Constitution of the Region, here by issued this proclamation.
ክፍል አንድ PART ONE
ጠቅላላ ድንጋጌዎች
Genera Provisions
1. አጭር ርዕስ 1. short Title
ይህ አዋጅ “በአማራ ብሔራዊ ክልላዊ መንግሥት This proclamation may be cited as “the Amahara

2. ƒ`ÕT@ 2. Definitions
የቃሉ አግባብ ሌላ ትርጉም የሚያሰጠው ካልሆነ በስተቀር Unless otherwise the context requires, in this
በዚህ አዋጅ ውስጥ፣ Proclamation:
1. “ቢሮ” ማለት የአማራ ብሔራዊ ክልላዊ መንግስት 1. “Bureau” means the Amhata National Regionnal State
የአካባቢ ጥበቃ፣ የገጠር መሬት አስተዳደርና አጠቃቀም Environmental Protection, Rural Land Administration
ቢሮ ማለት ነው፡፡ and Use Bureau.
2. “አካባቢ” ማለት በመሬት፣ በከባቢ አየር፣ በአየር ሁኔታ 2. “Environment” means the totality of all materials
እና በአየር ንብረት፣በውኃ፣ በሕያዋን፣ በድምፅ፣ በሽታ፣ whether in their natural state or modified or
በጣዕም፣ በማሕበራዊ ጉዳዮች እና በሥነ ውበት changed by human; their external spaces and the
ሳይወሰን በተፈጥሯዊ ሁኔታቸው ወይም በሰው interactions which affect their quality or quantity
አማካኝነት ተሻሽለው ወይም ተለውጠው የሚገኙ ነገሮች and the welfare of human or other living beings,
በሙሉ ያሉበት ቦታ፣ እንዲሁም መጠናቸውን ወይም including but not restricted to, land, atmosphere,
ሁኔታቸውን ወይም ደግሞ የሰው ወይም የሌሎች wheather and climate, water, living things,sound,
ሕያዋን በጎ ሁኔታን የሚነኩ መስተጋብሮቻቸው ድምር odor, taste,social factors, and aesthetics.

3. “የአካባቢ ጥበቃ” ማለት የሰው ልጅን ጨምሮ 3. “Environmental protection” means an activitiy of
የማንኛውም ሕይዎታዊ አካልና እድገት የሚወስኑ giving care for the land, water and air that
የመሬት፣ የውኃና የአየር እንዲሁም ሌሎች determine any living things’ body and growth
ተመሳሳይ የአካባቢ ሀብቶች፣ ክስተቶችና ሁኔታዎች including human being,as well as other similar
እንዳይጠፉ፣እንዳይቀንሱ ወይም ባህሪያቸዉ environmental resources, occurances and
እንዳይለወጥ የመንከባከብ ተግባር ነው፡፡ conditions not to be extincted, reduced or not to
be changed their characteristics.
4. “የአካባቢ ተፅዕኖ ግምገማ” ማለት 4. “Environmental Impact Assessment” means a
ኘሮጀክት፣ፖሊሲ፣እቅድ ወይም ፕሮግራም process of indicating the methodogy of reducing or
ተግባራዊ ሲሆን፣ ሲስፋፋና ሲቋረጥ በአካባቢ ላይ removing problems by identifying the result it brings
on the environment, whether be it positive or
የሚያስከትለውን ጠቃሚም ሆነ ጎጅ ዉጤትን
negative when the project, policy, paln or program is
ለይቶ የማወቂያና ለችግሮችም ማቃለያ ወይም
implemented, expanded or termimated.
ማስወገጃ ዘዴን የሚያመላክት ሂደት ነው፡፡
5. “ተፅዕኖ” ማለት በአካባቢ ወይም በንዑሳን ክፍሎች 5. “Impact” means any change to the environment or its

በአካባቢያዊ፣በማህበራዊ፣በኢኮኖሚያዊ ወይም
በባሕላዊ ገጽታዎች ላይ የሚከሰት ተከታይ ለውጥ
ነው፡፡
6. “ብክለት” ማለት በዚህ አዋጅ ወይም አግባብ ባለዉ 6. “ pollution ” means any condition which is hazardous
ሌላ ህግ የተደነገገን ማንኛዉም ግዴታ፣ ማዕቀብ or potentially hazardious to human health, safety or

contravention of any condition, limitation or
የተፈጠረ በሰዉ ጤና ወይም በጎነት ወይም ደግሞ
restriction made under this proclamation or under any
በሌሎች ህያዋን ላይ አደገኛ የሆነ ወይም አደገኛ
other relevant law.
ሊሆን የሚችል ሁኔታ ነዉ፡፡
7. “በካይ” ማለት ፈሳሽ፣ ጠጣር ወይም ጋዝ የሆነ 7. “pollutant” means any substance whether liquid, solid
በቀጥታም ሆነ ቀጥተኛ ባልሆነ መንገድ፡- or gas which directly or indirectly:
a. alters the quality of any part of the receiving
ሀ) ያረፈበትን የአካባቢ ክፍል ጥራት በመለወጥ
environment so as to affect its beneficial use
ጠቀሜታ የመስጠት አቅሙን የሚያጓድል
adversely; or
ወይም፣
ለ) በሰው ጤና ወይም በሌሎች ሕያዋን ላይ ጉዳት b. Produces toxic substances, diseases, objectionable
የሚያደርስ ወይም ሊያደርስ የሚችል መርዝን፣ odour, radioactivity, noise, vibration, heat, or any
በሽታን፣ ክርፋትን፣ ጨረርን፣ ድምፅን፣ ንዝረትን፣ other phenomemnon that is hazardious or potentially
ሙቀትን፣ ወይም ሌላ ክስተትን የሚያመነጭ hazardious to human health or other living things.
ማንኛውም ነገር ነው፡፡

8. “ፕሮጀክት” ማለት ማንኛውም አዲስ የልማት 8. “Project” means any new development activity or
እንቅስቃሴ፣ ወይም በነባር ድርጅት ላይ የሚደረግ major expansion undertaking on the existing
organization or alteration, or any resumption of work
ጉልህ መስፋፋት ወይም ለውጥ፣ ወይም ተቋርጦ
that had been discontinued.
የነበረ ሥራን መልሶ ለመጀመር የሚደረግ እንቅስቃሴ
ነው፡፡
9. “ነባር ፕጀክቶች” ማለት የፌዴራል የአካባቢ ተጽዕኖ 9. “Existing projects” means projects that were

10. “የፕሮጀክት ባለቤት” ማለት የልማት ተግባሩ 10. “Proponent” means a concerned government body if

ሲሆን ባለሀብት የሆነው ሰው ወይም በሁለቱም concerned and a person if both initiate the same.
የሚካሄድ ሲሆን የሚመለከተዉ የመንግስት አካልና

ባለሀብት የሆነዉ ሰዉ ነዉ፡፡
11. “ፈቃድ ሰጭ መስሪያ ቤት” ማለት እንደሁኔታዉ 11. “Licensing Agency” means any organ of
የኢንቨስትመንት፣የንግድ ወይም የስራ ፈቃድ government empowered by law to issue an
ለመስጠት ወይም የንግድ ድርጅት ለመመዝገብ በህግ investment permit or a trade or operating license or a
ስልጣን የተሰጠዉ ማንኛዉም የመንግስት አካል work permit or to register a business organization, as
the case may be.
ነዉ፡፡
12. “ተሻጋሪ” ማለት ከአንድ ቀበሌ ወደ ሌላ ቀበሌ 12. “Transitive” means the transfer or transit of the

13. “የይሁንታ ፈቃድ” ማለት ማንኛውም ሰው ወደ ሥራ 13. “Authorized Licence” means a licence to be given any

14. “መንግሥታዊ ሰነድ” ማለት ፖሊሲ፣ስልት፣የረጅም

3. የአዋጁ ተፈጻሚነት 3. Applicability of the Proclamation

ይህ አዋጅ በአማራ ብሔራዊ ክልል ውስጥ This proclamation shall be applicable at any palce in

ክፍል ሁለት PART TWO

ስለአካባቢ ተጽዕኖ ግምገማ Principles, Considerations and Bodies that
መርሆዎች፣ታሳቢዎችና በግምገማው የሚሳተፉ Participate in Assessment

4. ጠቅላላ 4. General
1. የይሁንታ ፈቃድ የሚሰጥባቸዉ የንግድ 1. The trade or work licence types that shall be

4. የተፅእኖ መወሰኛ ታሳቢዎች 5. Consideration to Determine Impact

2. ጠቃሚና ጎጂ ውጤቶች ካሉት ነገር ግን 2. The bureau or the concerned office of

6. በአካባቢ ተፅዕኖ ግምገማ ሂደት ውስጥ 6. Projects passing through the process of

1. የአካባቢ ተፅዕኖ ግምገማ ሂደት የክልሉን 1. The environmental impact assessment process

environmental impact assessment of the region:

ሀ) ቢሮዉ በሚያዘጋጀዉ መመሪያ የአካባቢ a. The directives to be issued by the bureau,

environmental impact assessment, cause
ብሎ ያመነባቸዉን ፕሮጀክቶች
positive response for license to be given,

pursuant to the study being prepared by them
ሲያቀርቡ የይሁንታ ፈቃድ
, in accordance with the criterion,

impact assessment of a project that is likely to

11. Environmental Impact Study Report

3. በዚህ አንቀፅ ንኡስ አንቀፅ 2 የተደነገገዉ እንደተጠበቀ 3. Without prejudice to the provision of sbu-

ማንኛዉም ሰዉ ለዚህ አዋጅ ተፈጻሚነት Any person shall have the duty to cooperate in the

ይህ አዋጅ በክልሉ መንግስት ዝክረ ህግ ጋዜጣ This proclamation shall come into force as of its

በአማራ ብሔራዊ ክልላዊ መንግስት የአካባቢ Environmental

በዚህ አዋጅ ውስጥ፣ Proclamation:

ቢሮ ማለት ነው፡፡ and Use Bureau.

በአፈር፣ በአየር፣ በውኃ፣ በአየር cultural heritage, other physical structure, or in
