REACTION PAPER FOR RA 9175 OR THE CHAIN SAW ACT OF 2002

Our discussion was about Republic Act No 9175 or The Chain Saw Act of 2002.
The said law was enacted on November 7, 2002.
Under this law, it is explicitly stated that it is the policy of the State consistent with
the Constitution, to conserve, develop and protect the forest resources under sustainable
management. Toward this end, the State shall pursue an aggressive forest protection
program geared towards eliminating illegal logging and other forms of forest destruction
which are being facilitated with the use of chain saws. The State shall therefore regulate
the ownership, possession, sale, transfer, importation and/or use of chain saws to prevent
them from being used in illegal logging or unauthorized clearing of forests.

Several relevant terms were also identified such as Chain saw which is any
portable power saw or similar cutting implement, rendered operative by an electric or
internal combustion engine or similar means that may be used for, but is not limited to,
the felling of trees or the cutting of timber. One can only have access to a chain saw if it
is only for the purpose of sale and import, manufacturers, dealers, and/or private owners,
and if duly authorized by the DENR.
Its possession, manner of use, as well as registration is covered by the Department
of Environment and Natural Resources (DENR) offices. The registration of a chainsaw is
valid for a period of 2 years upon issuance. The DENR Secretary may opt to revoke any
registration, certificate, or permit on any person/entity who will be found to be violating
the said Act. The prohibitions as well as penalties for its usage was also discussed.

As our country gives primacy to the protection and preservation of our bountiful
natural resources, the different machineries and equipment, which if used wrongly might
be destructive and chaotic for the environment, is being strictly regulated by our
Government. Therefore, it is truly a duty and responsibility for those allowed to carry such
equipment to use it wisely and for the right purposes.
