AFFIDAVIT OF DESISTANCE

        I, EPIFANIA E. PAGUIRIGAN, of legal age, married, and a resident of

Zone 04, Provincial Road, Bagay, Tuguegarao City, Cagayan, after having duly
sworn to in accordance with law hereby depose and state:
 
1. I am the Private Complainant in the criminal case of Epifania E.
Paguirigan versus Robinson A. Paguirigan, et. al before the Tuguegarao
City Prosecutor’s Office docketed as II-03-INQ-020G-00118;
 
  2. After my sober and soul searching assessment, I have realized that
whatever allegations stated in the complaint arose from an erroneous
interpretation of the facts and circumstances surrounding the case.
Certainly, I am not sure if the death of my son was caused by the alleged
mauling made by the perpetrators because at that time he was heavily
drunk and I also believed that his existing mental illness aggravated his
untimely death;
 
 3. Since I could not state with certainty and without doubt the liability
of the respondents in fairness to them, I am permanently withdrawing
my complaint against them. I clear them of whatever responsibility or
liability.
 
4. I hereby inform the City Prosecutor of Tuguegarao that I am
withdrawing my complaint for Homicide against the four respondents
namely: Robinson Paguirigan, Reymund Paguirigan, Jonel Liggayu
and Jeffrey Paguirigan;

 
        IN WITNESS WHEREOF, I hereby set my hand this 14 th day of July 2020
