WHEREAS, it is the policy of the State to protect and promote the right to health of the people and
instil health consciousness among them;
WHEREAS, itis the policy of the State to protect and advance the right of the people to a balanced
‘and healthful ecology in accordance with the rhythm and harmony of nature;

WHEREAS, the passage of Mining Law of 1995 (RA 7942) that liberalizes the domestic mining“
industry by granting or allowing the operation and exploration of our mineral resources does not in any way
divest any Local Government Unit (LGU) ofits power and authority to enact laws and ordinances in ordec to
protect its inhabitants from the perilous and destructive effects of mining as inherently enshrined in our
constitution;
WHEREAS, under the General Welfare Clause of the Local Goverment Code, every local
government unit shall exercise the powers expressly granted, those necessarily implied therefrom, as well
a powers necessary, appropriate, or incidental for its efficient and effective govemance, and those which
are essential to the promotion of the general welfare, and shall ensure and support, among other things,
the preservation and enrichment of culture, promote health and safety and enhance the rights of the people
to logy, xx x and preserve the comfort lence of their inhabitants;
