Dear President Muhi:

This refers to the herein attached Office Memorandum No. 02, S. 2021 (Annex A) issued by the
Property and Supplies Management Office (“PSMO” for brevity) dated 22 March 2021, recommending the
suspension of delivery from 15 March 2021 until 27 March 2021.

It has been certified by the PSMO that suspension of delivery during the aforementioned dates is
necessary as their office were closed for disinfection, due to the unexpected surge of COVID-19 cases.
Moreover, on 28 March 2021, President Rodrigo Duterte placed the NCR+ under enhanced community
quarantine (ECQ) until 4 April 2021, thereby restricting the operations of this University exclusively essential
and priority projects. Therefore, the acceptance of the deliveries from the suppliers, within the aforementioned
period, were rendered impossible by the existence of the foregoing events which are outside the control of this
University.

Considering the premises above, we hereby respectfully recommend that a suspension order be
issued suspending the delivery period of suppliers from 15 March 2021 until 4 April 2021 , pursuant to
Paragraph 2.1 of Annex “D” of the IRR of R.A. 9184, which states that:

“The procuring entity may suspend the work wholly or partly by written order for a
certain period of time, as it deems necessary due to force majeure or any fortuitous
events as defined in the contract.”

Likewise, it is recommended that no liquidated damages shall be imposed during the period of
suspension.

Finally, a notice of resumption of delivery period shall immediately be issued thereafter.
