 a. Rica got a loan from Rico using his house and lot as collateral and payable upon receipt of
her retirement benefits. When he received her retirement benefits he went to pay Rico but
he refused to receive payment because he becomes interested on the property. He went to
court and deposit the amount.

Answer: in this situation payment or performance is applicable tin the sense that Adong paid
10,000 to Adeng meaning payment extinguished and by the time that Adong done repairing the

C. Carlo is obligated to deliver 10 sacks of refined sugar (an indeterminate thing) to Carla. However,
while on transit the truck carrying the cargoes was hit by a rolling stone causing it to overturn and

 Answer: In my own opinion Carlo isn’t liable for the damage because it was an accident
unless there is contract saying that Carlo will be responsible of any damage causing any
event. There is actually an act being presented by Carlo and that could be consider that his
obligation to Carla is being Extinguished and the Mode being presented here is Loss of the
Thing DueIt is understood that a thing is lost when it perishes, or goes out of commerce or
disappears in such a way that is existence is unknown or it cannot be recovered.

 Loiuse acquired a loan from ABC Bank. Due to financial reverses, she failed to pay the
bank. Her brother Luis offered help and assumed the loan by making him the new debtor
of ABC Bank. Did the obligation of Loiuse with the bank extinguish? If yes, by what
mode? Discuss.
Answer: Yes it does, in this case Novation is presented because from the difinition it self says
is the total or partial extinction of an obligation through the creation of a new one which
substitutes it. And as what I’ve understand Novation means changing or replacing
one of the parties. And in this situation Loiuse obligation towards the bank is extinguished
because Luis offered help in a way that he will be the one who’s gonna pay the debt of
his brother.and I guess Luis serves as a substitute of loiuse

Discuss the difference between Confusion and Merger of Rights.

Answer: The confusion or merger of the rights is a mode of extinguishment of obligation wherein the
characters/qualities of creditor and debtor are merged in the same person. An
obligation is extinguished if the debtor also becomes the creditor since one cannot claim against
himself. Confusion or merger is the meeting in one person of the qualities
of creditor and debtor with respect to the same obligation.

Discuss the difference between Payment and Tender of Payment.
