AFFIDAVIT OF DEATH AND HEIRSHIP

WE, ALICIA CABAYACRUZ DELA CRUZ, widow, ROSAMARIE D. TARROZA,

married, DENNIS CABAYACRUZ DELA CRUZ, single, NONITO CABAYACRUZ DELA
CRUZ, married, JAYSON CABAYACRUZ DELA CRUZ, single, JUDITH CABAYACRUZ
DELA CRUZ, single, RONALD CABAYACRUZ DELA CRUZ, married, EVELYN
CABAYACRUZ DELA CRUZ, single, ALELIE CABAYACRUZ DELA CRUZ, single,
ARNOLD CABAYACRUZ DELA CRUZ, married, all of legal age, Filipino citizens, and with
residents at Salaan, Zamboanga City, Philippines, after being duly sworn to in accordance with
law, depose and state THAT:
1. We are the surviving heirs being the wife and children of the deceased PORFERIO
DELA CRUZ, who died on October 25, 2009, a copy of his Death Certificate is
hereto attached as “ANNEX A”;

2. That late PORFERIO DELA CRUZ, being on the legal heir/successor of Henaro
Dela Cruz married to Sebastiana Francisco, who died on August 24, 1975 and
December 23, 1964, machine reproduction copy of their Death Certificate is hereto
attached as “ANNEX B”;

3. That deceased Porferio Dela Cruz, being one of the legal heirs of Hernaro Dela Cruz
married to Sebastiana Francisco is entitled to inherit the property located at Salaan,
Zamboanga City, property more particularly described, to wit:
“ A parcel of land Lot 230 of the Cadastral survey of
Zamboanga, with the improvements thereon, situated in the
Municipality of Zamboanga. Bounded on the N.W and N.E by the
Mercedes river; on the S.E by Lot No. 232 and 231 and on the SW.
by Lot No. 288. Containing an area of Forty One Thousand Two
Hundred Eighty Nine (41,289) square meters covered by OCT-
7384”;
4. That said decedent left no bedts, nor any Last Will and Testament;

5. That the aforementioned property was subdivided into Lot 230-A to 230-I, under Psd
No. 09-067231;

6. That we hereby adjudicate the Lot No. 230-A, in our favor;

7. That we are the legitimate heirs of the deceased Porferio Dela Cruz;

8. That the above-described parcel of land does not come under the operation of the
Comprehensive Agrarian Reform Program.

9. That we executing this Affidavit of Heirship to establish names of the heirs of

Porferio Dela Cruz and for whatever legal intents it may serve.

IN WITNESS WHEREOF, we have hereunto set our hands on the date and place
hereinafter mentioned.
