Refer to Project Management and the Law: CT du Toit – Juretec Associates: Chapter 5.

1. Contract Document (or Procurement) requirements propose a systematic approach to the

approach, format, content and compilation of tender or procurement documentation.

2. In the South African context several types of contracts are defined, each with its own
contract / procurement / tender documentation requirements.

3. Also in the South African context one can generally distinguish between contracts in the
private sector and then contracts for organs of State, which are governed by regulations
in terms of the Construction Industry Development Board Act, 2000 (Act No 38 of 2000).
4. For the purposes of this course (Documentation III), we will concentrate on the
Construction Industry Development Board (CIDB) regulations and publications. Hence
students are advised to access the CIDB website and familiarise themselves with the
CIDB publication is this regard. These publications can (should) be used as study
material.

5. Notwithstanding the above, students are also advised to consult publications such as
“Project Management and the Law: CT du Toit” which is also distributed by SAICE.
Although this publication concentrates on contracts (procurement / tender) in the private
sector, the basic definitions, descriptions, etc., are valid and supplements the information
published by CIDB. Students are strongly advised to consult this publication and also
other available publications in this regard.

6. Based on the above, the student is not provided with a comprehensive set of notes, but
rather directed to available publications and books, and should in the learning and
studying of this particular topic (tender documentation) use the resources (books and
electronic media) available at the VUT Library.
