A RESOLUTION RECOMMENDING TO ENACT AN ORDINANCE ON

(THE CONDUCT OF ROAD CLEARING OR AN EQUIVALENT ACTION TO ELIMINATE THE
COMMON ROAD OBSTRUCTION)

WHEREAS, Section 16 and Section 17(b) of the Local Government Code of 1991 respectively
mandates Local Government Units to protect and preserve the safety and health of its
inhabitants and the maintenance of all local roads within their jurisdiction as a basic service and
facility;

WHEREAS, President Rodrigo Roa Duterte during his 2019 State of the Nation Address has
directed all local government units to reclaim public roads being used for private ends, to clear
all roads of illegal obstructions;

WHEREAS, DILG Memorandum Circular No. 2020-027 provides that Barangays shall be in
charge of the conduct of road clearing operations in barangay roads and minor public-use
streets within their jurisdiction, as well as the maintenance of other local roads turned over by
the municipal government;

WHEREAS, several common obstructions observed by the Barangay Peace and Order Council in
this barangay are (kind of road obstruction)______________, ___________ need to be cleared and
restored for public use;

NOW THEREFORE, be it resolved and it is hereby resolved, for this council to recommend to
the Sangguniang Barangay the enactment of an Ordinance on the (the conduct of road clearing
or an equivalent action to eliminate the common road obstruction);

RESOLVED FURTHER, that copies of this resolution be forwarded to the Sangguniang Barangay

 for consideration and appropriate action.
