Case 1 HOLIDAY PAY (HP)

1.       If an employee is on leave of absence, is he entitled to regular HP?

 He/She should be present on the workday immediately preceding the regular holiday;
or
He/She should be on leave of absence with pay on the day immediately preceding the
regular holiday.

2.       If an employee is on leave of absence without pay on the day immediately before a regular
holiday, is he entitled to a HP?

He/She should be on leave of absence with pay on the day immediately preceding the
regular holiday.

Case 2   COMPUTATION OF PREMIUM


Given:

1.       Regular pay for the day (8:00 am to 5:00 pm or 8 hours of work) is Php400.00.

2.       Overtime (5:00 pm to 6:00 pm)

3.       Night shift differential (10:00 pm to 6:00 am)

4.       Overtime and night shift differential (8am to 12:00 mn)

Note:

For purpose of determining entitlement to OT pay, DOLE ruling has consistently opined that “a
day” shall mean the 24-hour period reckoned from the time the worker started working. (Letter
of Opinion dated 15 February 1993, issued by Dir. Augusto G. Sanchez, Dir. IV of DOLE)
