The rollo shows that a Notice to File Brief 1 dated 09 November

2020 was sent to plaintiffs-appellants and to their counsel, Atty. Omega
C. Lacandola-Moises (Atty. Lacandola-Moises), directing them to file
an Appellant's Brief within 45 days from receipt of the said Notice. As
per Reply to Tracer2 dated 15 January 2021, it stated that the said Notice
addressed to Atty. Lacandola-Moises was received by her son, Paul
Moses, on 04 December 2020.

As per CA-CMIS verification report dated 04 May 2021, no

Appellant's Brief has been filed in this appealed case despite receipt of
the said Notice on 04 December 2020.

WHEREFORE, premises considered, the instant appeal is

considered ABANDONED and is hereby DISMISSED pursuant to
Section 1 (e), Rule 50 of the 1997 Rules of Civil Procedure, as amended.
