COMPLAINT
The undersigned complainant hereby accuses ROY TABARA of Daet,
Camarines Norte of the crime of Estafa under Art. 315 (2)(a) of the Revised
Penal Code, committed as follows:

“That on or about April 26, 2018 in the Municipality of Daet,

Province of Camarines Norte, and within the jurisdiction of this
Honorable Court, the above–named accused, with grave abuse of
trust and confidence and intent to gain, did there and there,
willfully, unlawfully and feloniously make false pretenses to the
herein private complainant when he acted and pretended as a
surveyor by the name of JOSE TABARA, and by reason of said
false pretense, the accused received the total amount of
(P47,000.00) FORTY SEVEN THOUSAND PESOS as payment for
the surveying and relocation plans, when in truth and in fact, the
accused is not the real JOSE TABARA and neither is he a surveyor
and consequently was not able to produce any outputs regarding
the surveying and relocation plans of complainant’s property and
despite repeated demands upon the accused to perform its
obligation to deliver the aforementioned plans, the accused
deliberately failed, refused and continue to fail and refuse to
deliver the same to the damage and prejudice of the herein private
complainant.”

SINUMPAANG SALAYSAY NG REKLAMO

Ako, si ROLANDO SAA, may sapat na gulang, Pilipino, at naninirahan sa

Brgy. Mataque, Capalonga, Camarines Norte, matapos manumpa ng naaayon
sa batas ay nagsasasabi:

Na ako ang private complainant sa kasong aking isinampa laban kay

ROY TABARA sa kasong Estafa o paglabag sa Art. 315 (2) (a) ng Revised Penal
Code;

Na noong buwan ng April at Mayo, 2018 ay nagkipagkita ako kay ROY

TABARA sa Daet, Camarines Norte at nakipagkasundo sa kanya upang siya na
ang magsurvey at mag-parelocate ng aking pag-aaring lupa na matatagpuan
sa bayan ng Capalonga, Camarines Norte;

Na matapos ko siyang bayaran at upang pagtibayin ang aming

kasunduan ay nagbigay pa si Roy Tabara ng mga resibo sa mga halagang
(P10,000.00) sampung libong piso, (P20,000.00) Dalampung libong piso at
(P17,000.00) labinpitong libong piso;

Na matapos kong i-abot ang mga nasabing halaga kay Roy Tabara ay
hindi ko na siya nakitang muli. Kaya ako’y nagtungo sa kanyang bahay sa
Tagas upang bigyang linaw ang kanyang biglaang pagkawala.

Na aking napag-alaman na hindi pala surveyor si Roy Tabara bagkus

siya ay kamag-anak lamang ni Jose Tabara na siyang lehitimo at lisensyadong
surveyor at dahil sa kanyang kasinungalingan ay hindi niya natupad ang
aming napagkasunduang survey plan;

Na dahil sa panloloko at pagpapanggap ni Roy Tabara, ako ay kanyang

nalinlang at hindi na isinauli ang perang aking ibinayad na nagkakahalagang
apatnaput pitong libong piso P47,000.00.

SA KATUNAYAN NG LAHAT NG ITO ay aking nilagdaan ang salaysay na

ito ngayong ika-10 ng Marso, 2020 dito sa bayan ng Daet, Camarines Norte.
