A Fraud on the Constitution

 INTRODUCTION -
America is divided as never seen before 1980. The civil war of 1980 was
fought on the issue of ‘right to equality’ on the factor that ‘should black
American’s be treated as equal?’ Eventually Mr. Lincoln prevailed and
pass the 13th Amendment of the Constitution.

On the other hand, throughout the struggle of Indian Independence


Indians were never divided on the basis of caste, religion, gender, race
or language. As we know history says a lot about the famous leaders
who were known for their hardships and struggle not for their caste or
religion.

 EQUALITY ENSHRINED –
‘Equality before law’ was translated into Fundamental Rights and
embodied in the constitution. Some of them are listed below: -
Article 14 Equality & equal protection of the laws
Article 15 Prohibition of discrimination
Article 16 Equality of opportunity
Article 21 Protection of life & personal liberty
Article 25 Freedom of conscience
Article 29 Protection of interests of minority
Article 30 Rights of minorities to establish & administer
educational institutions

 PRIMITIVE INSTINCTS –
As we are living in the modern India there still many who are refusing to
accept the Fundamental principles of the constitution. Earlier times
leaders have a check on the primitive instincts who believed in liberty,
equality etc. Some examples are listed below: -
 The imposition of Hindi on non – Hindi speaking people.
 The discriminatory National of Citizens and the Citizenship Act
 The dismemberment of the state of Jammu and Kashmir
When the BJP acquired presence, and grew, in the political space these
primitive instincts acquired political legitimacy. BJP has the right to rule, but not
the right to destroy the constitution.

 ONSLAUGHT ON LIBERTY –
The latest law made by the UP government called as ‘testing the
egregiousness’ which means to punish the Muslims men who love or live
with Hindu women which is crudely known ‘Love Jihad’.
Such states are unaware to read the judgements of Supreme Court. The
law is an onslaught on the choice; on the freedom; on the dignity; on the
equality of men and women. The first victim, meanwhile, is Mr. Owais
Ahmed from UP.
