RESOLUTION RECOMMENDING THE SANGGUNIANG BARANGAY TO ENACT AN ORDINANCE ON ROAD

CLEARING OF BARANGAY MAGKIANGKANG BAYGAN CITY AGUSAN DEL SUR

WHEREAS, The President of the Philippines has made clear directive during his 2019 State of the Nation Address that all
local officials are enjoined to exercise their passes essential to reclaim public roads which are being used for private and in the
process rid them of illegal structures and constructions.

WHEREAS, pursuant to Section 16 of the Local Government Code, every LGU shall exercise the powers expressly
granted those necessary, appropriate and effective governance and those which are essentials to the promotions of the general
welfare , health and safety within their respective territorial jurisdictions.

NOW THEREFORE, on motion of Mr. Reynante Pedraza and duly seconded Jhayvie M. Batingal , BE IT RESOLVED as it
is hereby resolved to RECOMMEND THE SANGGUNIANG BARANGAY TO ENACT AN ORDINANCE ROAD CLEARING OF
BARANGAY MAGKIANGKANG BAYGAN CITY AGUSAN DEL SUR

A RESOLUTION ENDORSING TO THE BARANGAY DEVELOPMENT COUNCIL THE BARANGAY PEACE AND
ORDER AND PUBLIC SAFETY PLANS (BPOPS) OF MAGKIANGKANG , BAYUGAN CITY AGUSAN DLE SUR.

WHEREAS , the Barangay Peace and Order (BPOC) are mandated to formulate PLAN FOR 2018-2020 in consonance
with Section 17 of RA 7160 the delivery of Basics Services in the Barangay.

WHEREAS, this Plan determined what actions to be taken to address the issues and gaps foreseen in the barangay for its
development;

WHEREAS, the Barangay Peace and Order (BPOC) of this barangay formulated this BPOPS which is in line with the
developmental policies and priorities of this barangay;

NOW THEREFORE RESOLVED, as it is hereby resolved to endorse to the Barangay Development Council the
BARANGAY PEACE AND ORDER AND PUBLIC SAFETY PLANS (BPOPS) OF MAGKIANGKANG , BAYUGAN CITY AGUSAN
DLE SUR.

WHEREAS, the Barangay Peace and Order (BPOC) are mandated to formulate PLAN FOR 2018-2020 in consonance WITH

EXECUTIVE ORDER NO. 3 S-2018

RECONSTITUTING THE BARANGAY PEACE AND ORDER COMMITTEE (BPOC) IN BARANGAY

MAGKIANGKANG , BAYUGAN CITY, AGUSAN DEL SUR.

Whereas ,Executive Order No. 366, dates September 5,1996, requires all barangays to organize the
Barangay Peace and Order Committee which shall serve as the implementing arm of the City in the
implementation of the City Peace and Order and Public safety (CPOPS) Plan;

Whereas, criminality continues to pose a serious threat to peace and order, and thus undermining the
peace and development efforts of the government;

WHEREAS, in support to President Duterte’s pronouncement to suppress criminality and in pursuance

to DILG Memorandum Circular No. 2008-101 which provides for the “ Reorganization and Guidelines in
Monitoring the Functionality of barangay Peace and order committee (BPOC).

SECTION 1. COMPOSITION OF THE BARANGAY PEACE AND ORDER COMMITTEE (BPOC). The BPOC is
hereby reconstituted to be composed of the following :

Section 2. POWER AND FUNCTIONS . The Barangay Peace and order Committee shall perform the following
powers and functions;

a) Initiate, coordinate and monitor the implementation of peace and order programs and projects at
the barangay level;
b) Serve as an info-gathering mechanism pertaining to peace and order;
c) Monitor and check the nefarious activities of criminal elements;
d) Supervise barangay tanods in identifying barangay constituents with strong deviant behavior for
referral to appropriate authorities;
e) Maintain continuing dialogue, close coordination and rapport with the city or municipal POC, the city
or municipal Management Coordinating Committee and the law enforcement units operating in the
barangay;
 f) Formulate plan and recommend measures which will improve or enhance peace and order and public
safety in its area of jurisdiction;
g) Supervise, coordinate and monitor the operations of all community-based anti-crime activities
undertaken within the barangay;
h) Undertake periodic assessment of the prevailing peace and order situation in the barangay and
submit report with appropriate recommendations to the city/municipal POC; and
i) Perform such other functions which may be assigned by higher POCs.

Section 3. EFFECTIVITY:
This Executive Order shall take effect immediately upon its approval.

REGULATION OF THE SALE OF CIGARETTES AND ALCOHOLIC BEVERAGES TO MINORS .

WHEREAS, pursuant to House Bill No. 2441 an Act Prohibiting the sale of cigarettes and alcoholic or intoxicating liquor or
beverage to minor.

WHEREAS, pursuant to Section 13 of Article 11 of the Philippine Constitution provides that “ the State recognizes the vital
role or the youth in nation-building and shall promote and protect their physical, moral, spiritual, intellectual and social well-being”.
Furthermore, Section 15 of the same Article provides that “ the State shall protect and promote the right to health of the people
and instill health consciousness among them”.

NOW THEREFORE, on motion of Sir Joseph Badato and duly secondedJImmy L. Gumapit, BE IT RESOLVED as it is
hereby resolved to RECOMMEND THE SANGGUNIANG BARANGAY TO ENACT AN ORDINANCE ON THE REGULATION OF

DEVICES .

WHEREAS, section 16 of the Local Government Code of 1991 , partly states that: Every Local government unit shall
exercise the powers expressly granted those necessarily implied therefrom, aw well as powers necessary, appropriate , or
incidental for its efficient and effective governance , and those which are essential to the promotion of the general welfare”.

WHEREAS, excessive, unnecessary or unusually loud sound from the said audio devices beyond limit of acceptable level
within residences and on the streets , is deemed as noise pollution and cause annoyances,and disturbances and injures and
endangers the comfort, health, peace and safety of others within the City.

NOW THEREFORE, on motion of Jhayvie M. Batingal and duly seconded JImmy L. Gumapit, BE IT RESOLVED as it is

incidental for its efficient and effective governance , and those which are essential to the promotion of the general welfare”.

WHEREAS, the purpose of this Ordinance to safeguard public health and ensure the well being of all its constituents by
protecting them from the harmful effects of amoking and tobacco consumption.

WHEREAS, the designated smoking area should be outdoor , where a person is allowed to smoke without violating the
ordinance , ten meters from entrances or exit, or any place where people usually congregate.

NOW THEREFORE, on motion of Charlita C. Baratas and duly seconded JImmy L. Gumapit, BE IT RESOLVED as it is

incidental for its efficient and effective governance , and those which are essential to the promotion of the general welfare”.

WHEREAS, it is the interest of public order and safety, it is imperative to regulate the movement of the people especially
night time to protect them from cruelty, exploitation and other conditions prejudicial and detrimental to their well being and
development.

WHEREAS, the purpose to revisit the ordinance is to improve and update the ordinance accordance to the national,
local law.
