1157C(4) For the purposes of subsection (3), if a prohibition on the use of a car,
or on the application of a car for a private use, by a person is not
30 consistently enforced, the person is taken to be entitled to use the car,
or to apply the car to a private use, despite the prohibition.
1157C(5) For the purposes of this section, a car that is let on hire to a person
under a hire-purchase agreement is taken:

(a) to have been purchased by the person at the time when the
person first took the car on hire; and
(b) to have been owned by the person at all material times.
1157C(6) A reference in this Part to a car held by a person (the provider) does
5 not include a reference to:
(a) a taxi let on hire to the provider; or
(b) a car let on hire to the provider under an agreement of a kind that
is ordinarily entered into by persons taking cars on hire
intermittently as occasion requires on an hourly, daily, weekly or
10 other short-term basis.
1157C(7) Paragraph (6)(b) does not apply if the car has been or may reasonably
be expected to be on hire under successive agreements of a kind that
result in substantial continuity of the hiring of the car.

5 Payment to recipient
1157E(1) If:
(a) a person (the provider) pays an amount to another person (the
recipient); and
(b) the amount is for fees for:
10 (i) tuition at primary or secondary level provided by a school;
or
(ii) books or equipment provided by the school in relation to
that tuition; and
(c) the tuition, books or equipment is provided to:
15 (i) a dependent child of the recipient or the recipient’s partner;
or
(ii) a person who would be a dependent child of the recipient or
the recipient’s partner if the person was not receiving a
newstart allowance or a sickness allowance;
20 the payment constitutes a school fees benefit provided by the provider
to the recipient.
Note: For school see section 10A.
1157E(2) If:
25 (a) a person (the provider) pays an amount to or on behalf of a
school; and
(b) the amount is for fees for:
(i) tuition at primary or secondary level provided by the
school; or
30 (ii) books or equipment provided by the school in relation to
that tuition; and

10 Boarding fees
Payment to recipient
1157F(1) If:
20 (a) a person (the provider) pays an amount to another person (the
recipient); and
(b) the amount is for the cost of health insurance; and
(c) the health insurance covers:
(i) the recipient; or
25 (ii) the recipient’s partner; or
(iii) a dependent child of the recipient or the recipient’s partner;
or

1157F(2) If:
(a) a person (the provider) pays an amount to a health insurance
fund; and
10 (b) the amount is for the cost of health insurance; and
(c) the health insurance covers:
(i) a person (the recipient); or
(ii) the recipient’s partner; or
(iii) a dependent child of the recipient or the recipient’s partner;
15 or
(iv) a person who would be a dependent child of the recipient or
the recipient’s partner if the person was not receiving a
newstart allowance or a sickness allowance;
the payment constitutes a health insurance benefit provided by the
20 provider to the recipient.
25 1157G(1A) The making of the loan does not constitute a loan benefit provided by
the provider to the recipient if:
(a) the provider is the Defence Force, or a body one of the objects or
functions of which is making loans to employees of the Defence
Force; and
30 (b) the recipient is an employee of the Defence Force.

1157G(5) For the purposes of this section, if a person (the provider) makes a
deferred interest loan (the principal loan) to another person (the
recipient), the following provisions apply:
(a) the provider is taken, at the end of:
5 (i) the period of 6 months starting on the day on which the
principal loan was made; and
(ii) each subsequent period of 6 months;
to have made a loan (the deemed loan) to the recipient;
(b) the amount of the loan is taken to be equal to the amount by
10 which the interest (the accrued interest) that has accrued on the
principal loan in respect of the period exceeds the amount (if
any) paid in respect of the accrued interest before the end of the
period;
(c) if any part of the accrued interest becomes payable or is paid
15 after the time when the deemed loan is taken to have been made,
the deemed loan is to be reduced accordingly;
(d) the deemed loan is taken to have been made at a nil rate of
interest.

(c) the amount of the loan is not substantially greater than the
amount of those expenses that could reasonably be expected to
be incurred by the employee; and
(d) the employee is required:
5 (i) to account to the employer for expenses met from the loan;
and
(ii) to repay (whether by set-off or otherwise) any amount not
so accounted for.

5 1157I(4) This subsection applies to a loan made to, or used by, a person
(whether in his or her own right or jointly with his or her partner)
wholly:
(a) to enable the person to acquire a prescribed interest in land on
which a dwelling or a building containing a dwelling was
10 subsequently to be constructed; or
(b) to enable the person to acquire a prescribed interest in land and
construct, or complete the construction of, a dwelling or a
building containing a dwelling on the land; or
(c) to enable the person to construct, or complete the construction of,
15 a dwelling or a building containing a dwelling on land in which
the person held a prescribed interest; or
(d) to enable the person to acquire a prescribed interest in land on
which there was a dwelling or a building containing a dwelling;
or
20 (e) to enable the person to acquire a prescribed interest in a stratum
unit in relation to a dwelling; or
(f) to enable the person to extend a building that:
(i) is a dwelling or contains a dwelling; and
(ii) is constructed on land in which the person held a prescribed
25 interest;
by adding a room or part of a room to the building or part of the
building containing the dwelling, as the case may be; or
(g) if the person held a prescribed interest in a stratum unit in
relation to a dwelling—to enable the person to extend the
30 dwelling by adding a room or part of a room to the dwelling; or
(h) to enable the person to repay a loan that was made to, and used
by, the person wholly for a purpose mentioned in paragraph (a)
to (g).
Note 1: For dwelling see subsection 10A(7).

1157I(6) For the avoidance of doubt, subsection (5) does not apply to payments
to which subsection (2) or (3) applies.

Method statement
Step 1. Work out the engine capacity of the car and go to the
relevant Part of the Car Fringe Benefits Value Table.
Step 2. Work out how old the car is and go to the appropriate row
15 in the Table.

(b) the person’s partner receives a car fringe benefit in the
appropriate tax year; and
5 (c) the person’s and the partner’s car fringe benefits relate to the
same car;
the value of the car fringe benefit is to be halved.

15 Step 2. Work out the notional rate of interest for the loan using
subsection (2), (3) or (4).
Step 3. Work out the actual rate of interest for the loan in the
appropriate tax year using subsection (5).
Step 4. Work out whether the actual rate of interest exceeds the
20 notional rate of interest.

Step 6. If the actual rate of interest is less than the notional rate of
interest, take the actual rate of interest away from the
notional rate of interest.
Step 7. Work out the amount of the loan (both the principal and
5 interest) that is outstanding in the appropriate tax year
using subsection (6).
10 Step 9. Work out how many complete weeks in the appropriate tax
year the person had or will have the loan: the result is the
number of allowable weeks.
20 1157Q(2) The notional rate of interest for the tax year ending 30 June 1993 is:
(a) 10% for a housing loan; and
(b) 13.5% for any other loan.
1157Q(3) The notional rate of interest for the tax years ending 30 June 1994 and
30 June 1995 is:
25 (a) 6.95% for a housing loan; and
(b) 11.75% for any other loan.

1157Q(4) The notional rate of interest for any subsequent tax year is the market
rate of interest for 1 April in the preceding tax year.

(a) the person is a member of a couple; and
(b) the person’s partner receives a loan fringe benefit in the
appropriate tax year; and

(c) the person’s and the partner’s loan fringe benefits relate to the
same loan;
the value of the loan fringe benefit obtained in Step 11 of the Method
statement is to be halved.

1157S(3) If:
15 (a) a determination is in force under section 1157U; and
(b) the determination applies to housing fringe benefits to which
subsection 1157I(1) applies;
the value of a housing fringe benefit to which subsection 1157I(1)
applies is to be worked out in accordance with the determination.

(a) the person is a member of a couple; and
(b) the person’s partner receives a housing fringe benefit in the
15 appropriate tax year; and
(c) the person’s and the partner’s housing fringe benefits relate to the
same unit of accommodation;
the weekly market rent obtained in Step 2 of the Method statement and
the allowable rent obtained in Step 5 of the Method statement are both
20 to be halved.

20 (c) the person’s and the partner’s housing fringe benefits relate to the
same unit of accommodation;
the weekly market rent obtained in Step 1 of the Method statement and
the allowable rent obtained in Step 4 of the Method statement are both
to be halved.

15 benefits or only to specified kinds of housing fringe benefits.

1157V(2)If there is no market exchange rate for 1 July in the appropriate tax year
(for example, because of a national public holiday), the market
exchange rate to be used is the market exchange rate that applied on
the last working day immediately before that 1 July.
15 1157V(3) For the purposes of this section, the market exchange rate of a foreign
currency is the on-demand airmail buying rate for that currency
available at the Commonwealth Bank of Australia.

Part 3.13—Imprisonment
1158 Some social security payments not payable during period in gaol
5 or in psychiatric confinement following criminal charge
An instalment of a social security pension, a social security benefit, a
parenting payment or a pensioner education supplement is not payable
to a person in respect of a day on which the person is:
(a) in gaol; or
10 (b) undergoing psychiatric confinement because the person has been
charged with an offence.
Note 1: For in gaol see subsection 23(5).
Note 2: For psychiatric confinement see subsections 23(8) and (9).
25 1159(2) If:
(a) a social security pension (other than pension PP (single)) is not
payable to a person on a pension payday because of section
1158; and

1163(2) If the person is or may be entitled to compensation and does not take
10 reasonable action to claim or obtain the compensation, the
compensation affected payment might not be payable to the person.
1163(5) Subject to subsections (5A), (6), (7), (8), (8A), (10) and (11), payments
30 of a compensation affected payment will only be affected under this
Part if:

1163(8) The amendments of this Part relating to carer pensions made by the
Social Security Legislation Amendment Act (No. 2) 1992 affect carer
pensions only if:
(a) the compensation is received on or after 1 January 1993; and
5 (b) the claim for the pension is made on or after 1 January 1993.
1163(8A) A mature age allowance or mature age partner allowance will only be
affected under this Part if:
(a) the compensation is received on or after 20 March 1994; and
(b) the claim for the allowance was made on or after
10 20 March 1994.
20 1163(10) A partner allowance will only be affected under this Part if:
(a) the compensation is received on or after 20 September 1994; and
(b) the claim for the allowance is made on or after
20 September 1994.
1163(11) An age pension will only be affected under this Part if:
25 (a) the compensation is received on or after 20 March 1997; and
(b) the person’s provisional commencement day for the age pension
is on or after 20 March 1997.

number of fortnights in the period is the number of whole
fortnights in the period referred to in paragraph (c).
20 1163A(2) This section does not apply in respect of a lump sum to which a person
is entitled if section 1165 applies in respect of the lump sum.

1164(2A) Even though a person has entered into an agreement to give up the
person’s right to compensation, the Secretary may form the opinion
that the person may be entitled to compensation if the Secretary is
satisfied that the agreement is void, ineffective or unenforceable.
20 1164(2B) For the purposes of subsection (2A), a person enters into an agreement
to give up the person’s right to compensation if the person:
(a) enters into an agreement to waive the person’s right to
compensation; or
(b) enters into an agreement to withdraw the person’s claim for
25 compensation.
1164(3) The action specified by the Secretary is to be the action that the
Secretary considers reasonable to enable the person to claim or obtain
the compensation.

1164(4B) Subsection (4A) does not affect the payability of a parenting allowance
to the person unless the person’s maximum basic rate of parenting
allowance exceeds the maximum basic component of parenting
allowance.

point 1068A-B6 of the Parenting Allowance Rate Calculator at the end of
section 1068A.
1164(5) If, under subsection (2), the Secretary requires a person who receives
or claims a compensation affected payment to take action to claim or
10 obtain compensation, the compensation affected payment is not to be
granted and is not payable to the person unless the person complies
with the requirement.
1164(6) If, under subsection (2), the Secretary requires the partner of a person
who receives or claims a compensation affected payment to take action
15 to claim or obtain compensation, the compensation affected payment is
not to be granted and is not payable to the person unless the partner
complies with the requirement.

1165(1) Where:
(a) a person receives or claims a compensation affected payment;
and
10 (b) the person is not a member of a couple; and
(c) the person receives a lump sum compensation payment (whether
before or after the person receives or claims the compensation
affected payment) before 20 March 1997;
a compensation affected payment referred to in paragraph (a) is not
15 payable to the person for the old lump sum preclusion period.
Note 1: For old lump sum preclusion period see subsections (3) to (4).
Note 2: A series of lump sum payments can be taken to be one lump sum
compensation payment under subsection 17(2B).
1165(1A) If:
(a) a person receives or claims a compensation affected payment;
and
(b) the person is not a member of a couple; and
25 (c) the person receives a lump sum compensation payment (whether
before or after the person receives or claims the compensation
affected payment) on or after 20 March 1997;
no compensation affected payment is payable to the person for the new
lump sum preclusion period.

Note 2: A series of lump sum payments can be taken to be one lump sum
compensation payment under subsection 17(2B).
5 1165(2) If:
(a) a person receives or claims a compensation affected payment;
and
(b) the person is a member of a couple; and
(c) the person, or the person’s partner, receives a lump sum
10 compensation payment (whether before or after the person
receives or claims the compensation affected payment) before 20
March 1997;
the following provisions have effect:
(d) no compensation affected payment is payable to the person for
15 the old lump sum preclusion period;
(e) no compensation affected payment is payable to the person’s
partner for the old lump sum preclusion period.
Note 1: For old lump sum preclusion period see subsections (3) to (4).
Note 2: A series of lump sum payments can be taken to be one lump sum
20 compensation payment under subsection 17(2B).
1165(2AA) If:
(a) a person receives or claims a compensation affected payment;
25 and
(b) the person is a member of a couple; and
(c) the person receives a lump sum compensation payment (whether
before or after the person receives or claims the compensation
affected payment) on or after 20 March 1997;
30 no compensation affected payment is payable to the person for the new
lump sum preclusion period.

1165(3C) If neither subsection (3) nor (3A) applies, the old lump sum
preclusion period is the period that:
(a) begins on the day on which the loss of earnings or loss of earning
capacity began; and
20 (b) ends after the number of weeks specified in subsection (4).
1165(4) The number of weeks in the old lump sum preclusion period is the
number worked out under the following formula:

1165(7) If neither subsection (5) nor (6) applies, the new lump sum preclusion
period is the period that:
20 (a) begins on the day on which the loss of earnings or loss of earning
capacity began; and
(b) ends after the number of weeks worked out under subsections (8)
and (9).

1165(9) If the number worked out under subsection (4) or (8) is not a whole
number, the number is to be rounded down to the nearest whole
number.
1166 Person may have to repay amount where both lump sum and
5 payments of compensation affected payment have been
received [see Note 5]
1166(1) If:
(a) a person receives a lump sum compensation payment; and
(b) the person receives payments of a compensation affected
10 payment for the lump sum preclusion period;
the Secretary may, by written notice to the person, determine that the
person is liable to pay to the Commonwealth the amount specified in
the notice.
Note 2: A series of lump sum payments can be taken to be one lump sum
15 compensation payment under subsection 17(2B).
1166(2) Subject to subsection (5), the amount specified in the notice is the
recoverable amount and is worked out under
subsections 5(3), (4), (4A) and (4C).
1166(4) If:
30 (a) the person is a member of a couple; and

1166(4A) If:
(a) the person is a member of a couple; and
15 (b) the person receives a lump sum compensation payment before 20
March 1997; and
(c) the person’s partner receives a compensation affected payment, a
youth training payment, or a compensation affected pension
under the Veterans’ Entitlements Act, for the old lump sum
20 preclusion period;
the recoverable amount is equal to the smaller of the following
amounts:
(d) the compensation part of the lump sum compensation payment;
(e) the sum of:
25 (i) the payments of the compensation affected payment made
to the person for the old lump sum preclusion period; and
(ii) the payments of the compensation affected payment and (if
applicable) the payments of youth training payment or a
compensation affected pension under the Veterans’
30 Entitlements Act made to the person’s partner for the old
lump sum preclusion period.
1166(4C) If:
(a) the person is a member of a couple; and

1166(5) If:
(a) subsection (1) applies to payments of a compensation affected
10 payment paid to a person for a particular period (in this section
called the overpayment recovery period); and
(b) the Secretary is satisfied that family allowance supplement
would have been payable to the person, or the person’s partner,
for some or all of the overpayment recovery period if:
15 (i) the person or the person’s partner had claimed family
allowance supplement for that period; and
(ii) neither the person nor the person’s partner had been
receiving a social security pension or benefit during that
period;
20 the amount specified in the notice under subsection (1) is to be reduced
by the notional FAS entitlement.
1166(6) For the purposes of subsection (5), the notional FAS entitlement is the
amount of family allowance supplement that the person or the person’s
partner would, in the Secretary’s opinion, have received during the
25 overpayment recovery period if:
(a) the person or the person’s partner had claimed family allowance
supplement for that period; and
(b) neither the person nor the person’s partner had been receiving a
social security pension or benefit during that period.

their social security payments. For example, if a wife pensioner receives

1168(3) If the person is not a member of a couple, the person’s fortnightly rate
of the compensation affected payment is reduced by the fortnightly
30 rate of periodic compensation.
1168(3A) If:
(a) the person is a member of a couple; and

(b) the person’s partner receives or claims a compensation affected
payment, or a compensation affected pension under the Veterans’

(c) the person’s partner receives or claims a social security benefit

(d) the person was not, at the time of the event that gave rise to the
entitlement of the person, or the person’s partner, to the
compensation, receiving a social security benefit;
the rate of the person’s social security benefit is to be reduced, under
30 subsection (5), for the periodic payments period.

applicable) the payments of youth training allowance or
30 compensation affected pension under the Veterans’
Entitlements Act made to the person’s partner for the
periodic payments period.

Note 1: Subsection 4B(2) of the Crimes Act 1914 allows a court that convicts an
individual of an offence to impose a fine instead of, or in addition to, a
term of imprisonment. The maximum fine that a court can impose on the
individual is worked out by multiplying the maximum term of
5 imprisonment (in months) by 5, and then multiplying the resulting number
by the amount of a penalty unit. The amount of a penalty unit is stated in
section 4AA of that Act.
Note 2: If a body corporate is convicted of the offence, subsection 4B(3) of the
Crimes Act 1914 allows a court to impose a maximum fine of an amount
10 that is 5 times the maximum fine that could be imposed on an individual
convicted of the same offence.
1174(1) If:
15 (a) a compensation payer:
(i) is liable to pay compensation to a person for a disease,
injury or condition of the person; or
(ii) has determined that a payment by way of compensation is
to be made to a person in respect of a disease, injury or
20 condition of the person; and
(b) the person receives or claims a compensation affected payment
for the periodic payments period or the lump sum preclusion
period;
the Secretary may give written notice to the compensation payer that
25 the Secretary proposes to recover the amount specified in the notice
from the compensation payer.

1174(3) Subject to subsection (6A), the amount specified in the notice is the
recoverable amount and is worked out under
subsections (4), (5) and (6).

(a) the person claiming compensation is a member of a couple; and
(b) the person’s partner neither receives nor claims a compensation
affected payment for the periodic payments period or the lump
sum preclusion period;
25 the recoverable amount is equal to the smallest of the following

payable to the person for:
(i) the periodic payments period; or
30 (ii) if a lump sum compensation payment is received before 20

(a) the person claiming compensation is a member of a couple; and
(b) the person’s partner receives or claims a compensation affected
payment for either:
15 (i) the periodic payments period; or
(ii) if a lump sum compensation payment is received by the
person before 20 March 1997—the old lump sum
preclusion period;
the recoverable amount is equal to the smallest of the following
20 amounts:
(c) the sum of:
(i) the payments of the compensation affected payment payable
to the person; and
(ii) the payments of the compensation affected payment and (if
25 applicable) amounts of youth training allowance or
compensation affected pension under the Veterans’
Entitlements Act payable to the person’s partner;
for the periodic payments period or old the lump sum preclusion

10 (a) subsection (1) applies to payments of the compensation affected
payment paid to a person for a particular period (the
overpayment recovery period); and
(b) the Secretary is satisfied that family allowance supplement
would have been payable to the person, or the person’s partner,
15 for some or all of the overpayment recovery period if:
(i) the person or the person’s partner had claimed family
allowance supplement for that period; and
(ii) neither the person nor the person’s partner had been
receiving a social security pension or benefit during that
20 period;
the amount specified in the notice under subsection (1) is to be reduced
by the notional FAS entitlement.
1174(6B) For the purposes of subsection (6A), the notional FAS entitlement is
the amount of family allowance supplement that the person or the
25 person’s partner would, in the Secretary’s opinion, have received
during the overpayment recovery period if:
(a) the person or the person’s partner had claimed family allowance
supplement for that period; and
(b) neither the person nor the person’s partner had been receiving a
30 social security pension or benefit during that period.

section 1176 so far as it relates to a recovery notice.

amounts:
(c) the sum of:
(i) the payments of the compensation affected payment payable
to the person; and
20 (ii) the payments of the compensation affected payment payable
to the person’s partner;
for the periodic payments period or the old lump sum preclusion

(d) the compensation part of the lump sum payment or the sum of
25 the amount of the periodic compensation payments;
(e) the maximum amount for which the insurer is liable to indemnify
the compensation payer in relation to the matter at any time after
receiving:
(i) a preliminary notice under section 1177 in relation to the
30 matter; or
(ii) if the insurer has not received a preliminary notice—the
recovery notice under this section in relation to the matter.

payment paid to a person for a particular period (the

20 (a) a person receives or claims a compensation affected payment;
and
(b) the person’s partner receives compensation; and
(c) the set of circumstances giving rise to the compensation are not
related to the set of circumstances that give rise to the person’s
25 receipt of or claim for the compensation affected payment;
the fact that those 2 sets of circumstances are unrelated does not in
itself constitute special circumstances for the purposes of subsection
(1).

Security Appeals Tribunal under section 1247; and
20 (b) at the time of the application the Secretary has not taken the

1185B(4) If a person transfers a qualifying interest that the person has in a farm
or a relevant farm asset, then:
(a) if paragraph (b) does not apply—the value for the purposes of
this section of the farm or relevant farm asset is its value when
5 the transfer is completed; or
(b) if, immediately before the transfer by the person of his or her
qualifying interest in the farm or relevant farm asset, the
transferee had a qualifying interest in the farm or relevant farm
asset—the value for the purposes of this section of the farm or
10 relevant farm asset is its value when the transfer is completed
less the value of the transferee’s qualifying interest in it at that
time.
1185B(5) For the purposes of paragraphs (1)(d) and (2)(d), a person is taken to
have been actively involved with a farm during a particular period if,
15 during that period, the person:
(a) has contributed a significant part of his or her labour to the
development of the farm; or
(b) has undertaken educational studies or training in a field that, in
the opinion of the Secretary, is relevant to the development or
20 management of the farm enterprise.
1185C(1) If:
(a) a transfer of a kind referred to in paragraph 1185B(1)(a) or (2)(a)
25 is completed after 14 September 1997; and
(b) at any time before the transfer but after 14 September 1997, the
person making the transfer entered into a transaction or
transactions as a result of which:
(i) the value of the farm or farms in which the person had a
30 qualifying interest immediately before the transfer is less
than the value that that farm or those farms would have had
immediately before the transfer if the person had not

15 1185C(2) If, when transferring by way of gift to another person his or her
qualifying interest in a farm, a person retains a freehold estate, a
leasehold interest or a life interest in the dwelling-house on the farm,
and the adjacent private land, that constitute the person’s principal

20 (a) the person is taken to have transferred the whole of his or her
qualifying interest in the farm by way of gift; but
(b) when assessing the value of the farm, the value of the
dwelling-house and the adjacent private land is not to be

(b) this Part applies because of a transfer of qualifying interests by
the person or the person’s partner; and
(c) the person is receiving a social security payment under this Act;

(d) the value of the qualifying interests has been included in the
value of the person’s assets, or the partner’s assets, when
calculating the rate of the person’s social security payment.

5 1185K(1) This is how to work out whether a person who has transferred his or
her qualifying interest in a farm or farms satisfies the farmers’ income
test for the purposes of this Part:

5 (a) the provisions of Part 3.10 other than Division 1B apply to the
person and so apply as if any reference in Division 1A to a tax
year were a reference to that financial year;
(b) any return on a financial asset that the person has actually
received during the financial year is taken to be ordinary income
10 of the person.
1185K(3) For the purpose of working out a person’s ordinary income from
farming during a financial year, the following provisions have effect:
(a) the provisions of Part 3.10 other than Division 1B apply to the
15 person and so apply as if:
(i) any reference in subsection 1074(1) to a tax year were a
reference to that financial year; and
(ii) subsection 1074(2) and section 1075 were omitted;
(b) any return on a financial asset that the person has actually
20 received during the financial year and that relates to a farm or a
relevant farm asset is taken to be ordinary income of the person
from farming;
(c) if, at the end of the financial year, the value of all trading stock
on hand that relates to a farm is less than the value of all such
25 trading stock on hand at the beginning of that financial year—the
amount of the difference is to be deducted from that part of the
person’s ordinary income from farming for that financial year
that is income in the form of profits;
(d) there is also to be deducted from the person’s ordinary income
30 from farming:
(i) losses and outgoings that relate to a farm and are allowable
deductions for the purposes of section 51 of the Income Tax

1185K(4) For the purposes of Step 4 in the Method statement in subsection (1),
the maximum basic rate for age pension applicable to the person is:
(a) if the person was a member of a couple at any time during the 3
years immediately preceding the operative day—an amount
20 equal to twice the amount that was, on the operative day, the
maximum basic rate for a partnered person under Module B of
Pension Rate Calculator A in section 1064; or
(b) if paragraph (a) does not apply—an amount equal to the amount

person would suffer severe financial hardship if the advance payment

Reduction
1206L(1) Subject to subsection (2) and sections 1206M and 1206N, if:
15 (a) the person applies in writing to the Secretary for an advance
payment deduction to be decreased, or to be stopped, because of
severe financial hardship; and
(b) the Secretary is satisfied that:
(i) the person’s circumstances are exceptional and could not
20 reasonably have been foreseen at the time of the person’s
application for the advance payment; and
(ii) the person would suffer severe financial hardship if the
advance payment deduction that would otherwise apply
were to continue;
25 the Secretary may determine in writing that, for the period specified in
the determination, the advance payment deduction is to be a lesser
amount (which may be a nil amount) specified in the determination.
Review of reduction
1206L(2) At any time while the determination is in force, the Secretary may:

rate referred to in the Method statement in point 1065-A1 in

Method statement in point 1065-A1 in Pension Rate Calculator B
is less than the advance payment deduction would be apart from
15 this subsection;
the advance payment deduction is taken to be equal to the provisional
payment rate referred to in paragraph (b).

(a) a person’s rate of pension is the non-income/assets tested rate
20 referred to in the Method statement in point 1065-A1 in Pension

25 the advance payment deduction is taken to be equal to the maximum
payment rate referred to in paragraph (b).

(a) a person’s rate of pension is the notional income/assets tested
rate referred to in the Method statement in point 1066B-A1 in

than the deduction (if any) previously applying under the

1207(1) If:
(a) the rate of a social security pension or benefit applicable to a
person is increased under the pharmaceutical allowance Module
10 of a Rate Calculator or the rent assistance Module of a Rate
Calculator; and
(b) the rate of that pension or benefit is to be reduced under:
(i) the income test Module or the assets test Module of the
Rate Calculator; or
15 (ii) section 1168 (compensation reductions);
the reduction is to be applied:
(c) first, to the rate of the pension or benefit apart from any increase
under the pharmaceutical allowance Module or the rent

social security benefits and parenting payment are not payable to a
person who is outside Australia because presence in Australia is
10 specified as an essential condition of qualification
(see paragraphs 408BA(1)(e), 408BA(2)(e), 593(1)(g), 593(2)(g),
660XBA(1)(f), 660XBI(1)(c), subsection 660YBA(8), and paragraphs
666(1)(h), 729(2)(fa), 500(1)(c), 771HA(1)(d) and 1069-D2(a)).
Note 1: Subsection 408BA(4) provides that a person is taken to be in Australia for
15 the purposes of subsection 408BA(1) or (2) (qualification for widow
allowance) if the woman is temporarily absent from Australia for a period
of 3 months or less.
Note 1A: Subsection 513(1B) provides that a person is taken to be in Australia for
the purposes of subsections 513(1) and (1A) (qualification for job search
20 allowance) if the person is, because of incapacity, not required to satisfy

Note 6: Subsection 771HA(4) provides that a person is taken to be in Australia for
15 the purpose of subsection 771HA(1) (qualification for partner allowance) if
the person is temporarily absent from Australia for a period of 3 months or

Note 7: A person is taken to be in Australia for the purposes of paragraph 500(1)(c)
(qualification for parenting payment) if the person is temporarily absent
20 from Australia for a period of 26 weeks or less.
General
1212(1) A person may be granted a social security pension when the person is
outside Australia if, immediately before the person left Australia:
25 (a) the person was qualified for the pension; and
(b) the person had lodged a claim for the pension.
1212(2) Subsection (1) does not apply to a carer payment, a pension PP (single)
or a rehabilitation allowance.
30 1212(3) If:
(a) a person who is outside Australia is receiving:
(i) an age pension; or
(ii) a disability support pension; or

1212(3AA) If:
(a) a person outside Australia becomes qualified for an age pension;
and
(b) if the person had been in Australia, subsection 48(3) would have
25 applied to the person in relation to the age pension;
subsection (3) of this section applies to the person in relation to the age
pension as if paragraph (d) were omitted.
30 1212(4) If a person who has been granted a disability support pension under
subsection (3) ceases to be severely disabled, the person ceases to be
qualified for that pension.

proper claims for the second pension or allowance.
Note 2: subsection (3) has the effect of allowing the person to make a proper claim
for the new pension or allowance even though the person is not, at the time

(a) a person is receiving a disability support pension granted on or
5 after 12 November 1991; and
(b) the person leaves Australia on or after that day; and
(c) the Secretary decides that the person is not severely disabled
when leaving; and
(d) the person continues to be absent from Australia for a period of
10 12 months;
the person ceases to be qualified for disability support pension on the
day after the 12 month period ends.
15 1213A(3) If:
(a) a person is receiving a disability support pension granted on or
after 12 November 1991; and
(b) the person leaves Australia on or after that day; and
(c) the person is severely disabled when leaving; and
20 (d) the Secretary decides that the person has ceased to be severely
disabled; and
(e) the person continues to be absent from Australia for a period of
12 months after the decision;
the person ceases to be qualified for disability support pension on the
25 day after the 12 month period ends.

as a transit passenger on an unbroken journey between 2 specified
foreign countries.

15 1216A(2) Subject to section 1216B, if, after the 12 month period ends, the
woman:
(a) enters a country that is not a specified foreign country; or
(b) is in a country when it ceases to be a specified foreign country;
she is disqualified for that pension as from the time:
20 (c) she enters the country; or
(d) the country ceases to be a specified foreign country;
as the case may be.
1216A(3) Subsection (2) does not apply if the woman enters, or is in, a country
as a transit passenger on an unbroken journey between 2 specified
25 foreign countries.
Note 1: for the period of 12 months after the woman leaves Australia her right to
continue receiving the pension referred to in this section is not affected by
her leaving Australia.
Note 2: if a woman lodges a claim for the pension before leaving Australia and the
30 pension is granted to her after she has left Australia, she is to be taken to
have been receiving the pension as from the earliest day on which the
pension is payable to her (see subsection 23(2)).

1218(1) This section and sections 1218A, 1218B and 1218C apply in relation
to the following social security payments:
(a) age pension;
(b) disability support pension;
10 (c) wife pension;
(e) bereavement allowance;
(f) widow B pension.
1218(2) Subject to sections 1218A and 1218B, a person who is absent from
15 Australia for more than 6 months ceases to be qualified for a social
security payment 6 months after the person’s departure from Australia,
unless the person has been given a departure certificate under section
1219 relating to the departure.

1218A(1) A person is taken not to cease being qualified, or not to have ceased to
5 have been qualified, for a social security payment as a result of
subsection 1218(2) for a period of not more than 18 months specified
in writing by the Secretary.

Example 1:
Facts: Joe receives age pension. He leaves Australia on 1 January 1996 without a
departure certificate, intending to spend 2 months outside Australia. While
outside Australia, he suffers a serious illness that prevents him from
5 communicating with people in Australia and from returning to Australia.
The Secretary finds out about Joe’s departure on 1 May 1996 and sends a
recipient statement notice to Joe’s last known address in Australia. The
notice is not returned and Joe’s age pension is cancelled with effect from 1
July 1996. Joe returns to Australia on 28 January 1997. The Secretary finds
10 out about Joe’s illness on 1 February 1997, considers that Joe’s illness is a
circumstance beyond Joe’s control and specifies that Joe should be taken
not to have ceased to have been qualified for age pension for the period
from 1 July 1996 until 28 January 1997 (inclusive).
Application: Joe is qualified for age pension from 1 January 1996 until 28 January
15 1997 (inclusive), despite the fact that he was outside Australia and despite
the cancellation of his pension with effect from 1 July 1996. (He continues
to qualify for age pension once he is back in Australia on and after
28 January 1997.)
Example 2:
20 Facts: Jane receives age pension. She leaves Australia on 1 February 1996
without a departure certificate. The Secretary finds out about Jane’s
departure on 10 August 1996 and sends a recipient statement notice to
Jane’s last known address in Australia. On 25 August 1996, a major natural
disaster strikes the remote region where Jane is. The disaster cuts all
25 communications with the rest of the world and is expected to prevent
people from leaving the region for several months. On 12 September 1996
the Secretary finds out from Jane’s daughter how the natural disaster has
affected the region where Jane is. The Secretary considers the natural
disaster is a circumstance beyond Jane’s control that justifies Jane
30 continuing to be qualified for age pension from 1 August to 30 November
1996 (the day by which Jane could reasonably be expected to have
provided information about her continuing qualification or to have returned
to Australia). On 13 September 1996, the Secretary specifies under section
1218A that Jane should continue to be qualified for that period.
35 Application: Jane is qualified for age pension from 1 February to 30 November 1996.
(If Jane is still outside Australia after 30 November 1996, the question
whether she qualifies for age pension then will depend on whether
subsection 1218A(3) or section 1218B or 1218C applies to her.)

1218B(1) If:
(a) the Secretary becomes aware of a person’s departure from
Australia less than 12 months after the departure; and
(b) the Secretary has reason to believe that the person may have been
5 qualified for a social security payment at the time of the person’s
departure; and
(c) the Secretary has not given the person a departure certificate
relating to the person’s departure; and
(d) the Secretary is not aware that the person has returned to
10 Australia within 6 months after the person’s departure;
the Secretary must send a recipient statement notice to the person.

1218C(2) A person becomes qualified under subsection (1) on the day the
10 Secretary receives the returned notice.
Recipients
1219(1) If:
(a) a person is receiving:
15 (i) an age pension; or
(ii) a disability support pension; or
(iii) a wife pension; or
(v) a bereavement allowance; or
(vi) a widow B pension; and
20 (b) the person proposes to leave Australia; and
(c) the person notifies the Department of the proposed departure as
required by a recipient notification notice; and
(d) the Secretary is satisfied that the person is qualified for the
pension or allowance;
25 the Secretary must give the person a certificate that:
(e) acknowledges that the person has notified the proposed departure
under this section; and
(f) states that the Secretary is satisfied that the person is qualified for
the pension or allowance.

1219(2) If:
(a) a person claims:
(i) an age pension; or
5 (ii) a disability support pension; or
(iii) a wife pension; or
(v) a bereavement allowance; or
(vi) a widow B pension; and
(b) the person proposes to leave Australia; and
10 (c) the person notifies the Department of the proposed departure
before the claim is determined;
the Secretary must give the person a certificate that acknowledges that
the person has notified the proposed departure under this section.

1220(2) If:
(a) a person resides in an area that is, at the time of residence, an
external Territory; and
(b) the person has never before resided in Australia; and
5 (c) the person then arrives in Australia; and
(d) within the period of 12 months after the person arrives in
Australia, the person is granted, or is transferred to:
(i) an age pension; or
(ii) a disability support pension; or
10 (iii) a bereavement allowance; and
(e) after the pension or allowance is granted, or the person is
transferred to the pension or allowance, as the case may be, but
before the end of that period of 12 months, the person leaves
Australia; and
15 (g) there is no determination in respect of the person under
subsection (3);
a pension or allowance based on that claim is not payable to the person
during any period during which the person is outside Australia.
1220(3) The Secretary may determine that subsection (1) or (2) is not to apply
20 to a person if the Secretary is satisfied that the person’s reasons for
leaving Australia before the end of the 12 month period arose from
circumstances that could not be reasonably foreseen when the person
returned to or arrived in Australia.
