Objection to election affidavit filed by candidate Dr. Debamoy Sanyal from


Assembly Constituency Dhubri (AC:23)

I, Saket S Gokhale i.e. the undersigned, state on the record that the facts mentioned in
this objection affidavit below are true to the best of my knowledge.

This is to record the complainant’s official objection raised against the election
affidavit filed by Dr. Debamoy Sanyal, nominee candidate from AC:23 Dhubri, for the
Assam Legislative Assembly Elections, 2021.

The objections raised against the affidavit filed by the candidate are as follows:

1. Please refer Part A, Clause 7 (vii) of the candidate’s Form 26 affidavit. The column
(vii) in Clause 7 requires the candidate to submit details and value of “jewellery,
bullion, and valuable thing(s) giving details of weight and value.

The candidate has declared ownership of 210 gms of gold with current valuation of
₹5,15,657 for SELF and 115 gms of gold with current valuation of ₹2,37,808 for
SPOUSE as on date of the notarized affidavit i.e. 15/03/2021.

However, on 15/03/2021, market price of gold in India stood at ₹4488 per gram.

This brings the current valuation of candidate’s 210 gms of gold to ₹9,42,480 (as
opposed to ₹5,15,657 declared by him in Form 26 affidavit) and the current
valuation of candidate’s spouse’s 115 gms of gold to ₹5,16,120 (as opposed to
₹2,37,808 as declared in the Form 26 affidavit).

This is a clear case of declaring a false and lower current value of the movable asset
i.e. gold owned by the candidate and his spouse declared in the Form 26 affidavit
and tantamounts to furnishing false information under oath in the Form 26 affidavit.

2. Please refer Part B, Clause 7 (iv) of the candidate’s Form 26 affidavit pertaining to
immovable property owned by the candidate and his spouse.

Clause 7 (iv) refers to “details of property in residential buildings” where the
candidate has declared the following 2 residential properties:

(a) Ward No. -2, A.C. Dasgupta Road, Dhubri Town, Circle: Dhubri, Dist: Dhubri,
Assam (owned fully by the candidate) and

(b) 101-B, Puja Garden, 272 NSC Bose Road, Kolkata - 40 (which is 50% owned
by the candidate and 50% by his spouse)

The candidate has declared that NONE of these 2 properties are inherited.

However, in the next 2 rows, i.e. “date of purchase of property” and “cost of
property”, the candidate has NOT furnished information regarding the property
owned in Dhubri, Assam and has only declared information regarding the property
owned 50-50% by him and his spouse in Kolkata.

This is a clear case of failure to declare information and declaring incomplete


information in the Form 26 affidavit of the candidate.

You’re, hereby, requested to

(a) take cognizance of this objection under ECI rules during scrutiny of nominations
for Phase 3 of the Assam Assembly Elections, 2021,

(b) paste this objection on the notice board in the RO’s office under ECI rules, and

(c) issue a notice to the candidate Dr. Debamoy Sanyal asking for a clarification on the
above failing which his nomination must be rejected for furnishing false information
as well as for furnishing incomplete information in his Form 26 affidavit.
