350.010. D e f i n i t i o n s . - F o r t h e p u r p o s e s o f t h is s e ct i o n , t h e t e r m s d e f in e d

( 1 ) " Ag r i c u l t u r a l l a n d " m e a n s l a n d u s e d f o r f a rm in g .

or aff inity includin g the spouses, sons-in-la w and daughters-in-la w of any such
family member according to the rules of the common law, and at least of whose stockholders is
a person residing on or actively operating the farm, and none of whose
stockholders a re a c o rp o ra t ion p roh ib it e d b y s e c t io n 35 0 . 01 5 f ro m e n te rin g in t o
f a rm in g, o r a n co rp o ra t ion wh ic h is subject to the controlled expansion provisions
of section 350.015; provided that a family f arm corporation shall not cease to

to, a person who has an ownership interest in the family farm corporation and exercises some
management control or direction.

3 5 0 . 0 1 5 . Corporations not to engage in farming-exceptions.-After September 28, 1975,
no corporation not already engaged in farming shall engage in farming; nor shall any
corporation, directly or indirectly, acquire, or otherwise obtain an interest, whether
legal, beneficial or otherwise, in any title to agricultural land in this state; provided,
however, that the restrictions set f o rt h in t h is se ct io n sh a ll no t a pp ly t o t h e
f o l l o win g:

(3 ) A gr ic u lt u ra l la n d a n d lan d c a pa ble o f be in g u s e d f o r f a rm in g o wn e d b y a
c o rp o ra t ion a s of S e p te mb e r 2 8 , 197 5 , in c lu d in g th e n o rma l e xp a n s io n of s u ch
o wn e rs h ip a t a ra te n ot to e xce e d twenty percent, measured in acres, in any f ive -
year period, or agricultural land and land capable of b e in g u s e d f o r f a rm i n g wh i c h
i s l e a s e d b y a c o rp o ra t i o n i n a n a m o u n t , m e a s u r e d i n a c r e s , n o t t o exceed the
acreage under lease to such corporation as of September 28, 1975, and the

be owned or leased by a corporation, to meet the requirements of pollution control
regulations;
(4) A f arm operated wholly f or research or experimental purposes, including
seed research and experim entation a n d se e d s t o c k p r o d u ct i o n f o r g e n e t i c
im p ro ve m en t s , p ro vid e d t h at an y commercial sales f rom such farm shall be
incidental to the research or experimental objectives of the corporation;
(5) A gricultural land operated by a corporation f or the purposes of growin g
nursery plants, vegetables, grain or f ruit used exclusively f or brewing or
winemaking or dist illing purposes and not f o r re sa le , f o r f o re st cro p lan d o r f o r th e
p ro d u c t io n of p ou lt ry, p o u lt ry p ro d u ct s , f is h o r m u sh roo m f arming, production of
registered breedin g stock f or sale to f armers to improve their breedin g herds, for
the production of raw materials for pharmaceutical manufacture, chemical
processing, f ood additives and relate d products, and not f or resale;
(6) Agricultural land operated by a corporation for the purposes of alfalfa dehydration
exclus ively and only as to said lands lyin g within f if teen miles of a dehydrat in g
plant, and provided f urther said crops raised thereon shall be used only for f urther
processing and not f or resale in its original f orm;
(7) Any interest, when acquired by an educational, religious, or charitable not
f or prof it or pro f o rm a co rp o ra t io n o r a s s o c ia t ion ;
(8) A gricultural la nd or an y interest therein acquired by a corporation other
than a f amily f arm corporation or authorized farm corporation, as defined in section 350.010,
for immediate or potential use in nonfarming purposes. A corporation may hold such agricultural
land in such a cre a ge a s m a y b e n e ce s s a ry t o it s n o nf a rm b u s ine s s o pera t io n ;

enforcement of a lien or claim thereon, whether created by mortgage or otherwise;
provided, that any corporation may hold f or ten years real estate a c qu ire d in
p a ym e n t of a de b t, b y f o re c lo s u re or o t h e rwis e , a n d f o r s u c h lon ge r p erio d a s
m a y b e provided by la w;
( 1 0 ) The provisio ns of sections 350.010 to 350.030 shall not apply to the
raisin g of hyb rid hogs in connection with operations designed to improve th e
qualit y, characteristics, prof itabilit y, or marketability of hybrid hogs through
selective breeding and genetic improvement where the primary purpose of such
livestock raising is to produce hybrid hogs to be used by f armers and livestoc k
raisers f or the improvement of the qualit y of their herds;

350.020. Reports required, when-penalty for failure to file or false report.-1. Every
c o rp o ra t ion e n ga ge d in f a rm in g, o r pro p o s in g t o c om me n c e f a rm in g, in th is s t a t e
af t e r Se p te mb e r 28, 1975, shall f ile with the director o f the state department of
agriculture a report containing the f o llo win g in f o rm at io n :
(1) The name of the corporation and its place of incorporation;
(2) The address of the registered off ice of the corporation in this state, the
name and address of its registered agent in this state an d, in the case of a f oreign
corporation, the address of its principal off ice in its place of incorporation;
(3) The acreage and location listed by section, township, and county of each
lot or parcel of la nd in th is s t a te o wne d o r lea s ed b y t he c o rp o ra t io n a nd u s e d f o r
f a rm i n g; an d
(4 ) T he na me s an d a d d re sse s of t he of f ice rs an d th e me m be rs of t he bo a rd of
d ire ct o rs of t he corporation.
2 . The report of a corporation seeking to qualit y hereunder as a family f arm
corporation or an authorized f arm corporation shall contain the f ollowin g a dditional
inf ormation;
(1) The number of shares owned by persons residing on the farm or actively engaged in
f arming, or their relatives within th e third degree of consanguinit y or aff inity
including their spouses, so n s-in -la w a n d da u gh t e rs-in -la w a c c o rd in g t o t h e ru le s
of t he c omm on la w;
(2 ) T he na me , a d dre s s a n d n umb e r of sh a re s o wn e d b y e a c h sh a reh o lde r;
and
(3) A statement as to percentage of net receipts of the corporation derived
f rom any sources o t h e r th a n f a rm in g.
3. No corporation shall commence farming in this state until it has f iled the
report required by t h is se ct ion .
4. Every co rporatio n, except a f amily f arm corporation, engaged in f arming in
this state shall f ile with the director of the state department of agriculture a report
containing the information required in subsection 1 of this section. Said reports
shall be f iled:
(1 ) W hen e ve r a n y of t he inf o rma t io n re qu ire d in s u b se ct io n 1 c h an ge s ;
(2 ) W hen e ve r o wn e rsh ip of the con t ro llin g in te re st in the co rp o ra t io n
c h a n ge s ; a nd

f o r f a rm i n g o r i s s o l d b y t h e c o rp o ra t i o n .

350.025. Farm cooperatives to file reports.-All farm cooperatives who own farm land
shall report under section 350.020 hereof. (L. 1975 H.B. 655 § 5)
350.030. Attorney general to enforce-venue-divestment of lands, failure, effect of. If
the attorney general finds a corporation is violating sections 350.010 to 350.030, he shall
institute an action in the circuit court of Cole County, Missouri, if a foreign corporation, and if a
Missouri corporation in the circuit court of any county in which the corporation owns any
agricultural lands or if the land is located in two or more counties, then in the circuit court of a
county in which a part of the land is located. The attorney general shall file a notice of the
pendency of the action with the recorder of deeds of each county in which any portion of said
lands are located. If the court finds that the lands in questions are being held or used in
violation of sections 350.010 to 350.030, it shall enter an order so declaring. The court shall
file for record its order with the recorder of deeds of each county in which any portion of said
lands are located. Thereafter, the corporation owning the land shall comply with the orders of
the court, or if so ordered shall have a period of two years from the date of such order to divest
itself of such land. The two-year limitation period shall be a covenant running with the title to
the land against any corporate grantee or corporate assignee or the successor corporation of
such corporation, except those corporations excluded by section 350.015. Any lands not
divested within the time prescribed shall be ordered sold by the court at public sale in the
manner prescribed by law for the foreclosure of a mortgage on real estate for default in
