Annexure A : Special Conditions of Contract


The Special Conditions of Contract ("SCC") complement the General Condition of Contract (GCC). Whenever there is a conflict, the provisions herein shall
prevail over those in the GCC.

4 1.33 Time for Completion Entire works shall be completed in 12 Months including mibilization from the date of LOI.
5 39 Mobilization Advance The Owner will provide an interest free Mobilization Advance Payment of 10% of Contract Price
including taxes against the Contractor furnishing an irrevocable bank guarantee from a nationalized
bank or from a reputed commercial bank acceptable to the Owner for an equivelent amount. The
format approved by the Owner shall be used for the Bank Guarantee. The Bank Guarantee shall be
valid up to Completion Period.

6 Recovery of Mobilization Advance paid will be recovered from each R.A. bill at the rate of 12.5 % of gross invoice
Mobilization Advance value (including GST) so as to recover 100% of advance paid at the completion of 80% of Contract
Price.

7 38 Retention Money An amount of 7.5 % of gross invoice value (including taxes) of each Running Account Bill will be
deducted by the Owner towards Retention Money amounting to maximum 7.5% of the Contract Price.
50% of retention money will be released with final bill payment and the balance will be retained in the
form of retention bank guarantee in approved format to be released after the expiry of the Defects
Liability Period duly certified by Engineer-in-Charge.

8 31 Liquidated Damages for Time is the essence of Contract. In case of any delay in the completion of Works, for reasons
Delay attributable to the Contractor, beyond the Time for Completion, an amount equal to 1% of the
Contract Price for every week or part thereof delay, subject to maximum of 10% of Contract Price will
be recoverable from the Contractor as liquidated damages. The liquidated damages are recoverable
from the Contractor whether or not actual damage or loss is proved to have been caused thereby. The
liquidated damages recovered by the Owner from the Contractor are for the delay and not as penalty.

9 13 Performance Security Within fifteen (15) days of receipt of the Letter of Intent, the Contractor shall furnish Performance
Security in the form of an irrevocable bank guarantee from a nationalized bank or from a reputed
commercial bank acceptable to the Owner for an amount of five (5) percent of the Contract Price. The
approved format provided along with tender documents or any other form approved by the Owner
shall be used for the Bank Guarantee. The Bank Guarantee shall be valid up to 3 months beyond the
Completion Period.

10 34 Defect Liability Period 12 Months from the date of issue of virtual completion certificate or Two Monsoons , whichever is
later.
11 20.6 Recovery rate for excess Material consumed in excess of theoretical consumption shall be recovered at prevailing landed
consumption market price + 25 % towards processing charges.

12 42 Procurement of basic The process for reconciliation of the basic rates and actual rates, at which the basic rate materials are

Payment/ Recovery of difference rate on basic rate material - Difference between actual
procurement rate approved by purchase and basic rate mentioned in BOQ + wastage factor (%)
specified in BOQ will be paid/ recovered.
Payment of wastage material beyond specified % mentioned BOQ - Contractor shall get
reconciliation statement approved by EIC/ Consultant/Architect. Approved procurement rate will be
paid for approved wastage quantity.

13 40 R A Bill frequency. 1) Contractor shall submit not more than one R.A. bill for every 30 days with all supporting documents

Annexure A : Special Conditions of Contract


The Special Conditions of Contract ("SCC") complement the General Condition of Contract (GCC). Whenever there is a conflict, the provisions herein shall

14 40.16 Payment GST (Goods & Service Tax) at 18% will be paid extra on basic amount as applicable. Contractor has to
submit GST paid challans with all supporting documents every month / as and when asked by EIC. Else
equivalent amount with applicable penalty will be charged. The taxes as charged on the day of
submission of the invoice is applicable and no deviation would be entertained on later date. Under the
anti profiteering clause of MGL the contractor should pass the benefits of GST under this contract. GST
TDS & Income Tax TDS will be deducted from the bills as applicable.
“as per the terms of this LOI/WO subject to the Contractor raising the appropriate GST compliant tax
invoice, e-waybill, credit note and undertake GST compliances and filing the correct GST returns
enabling the Principal/Company to avail input credit, if any against the GST. In case, there is any error
on providing the same to us or in filing appropriate returns, which results in higher tax incidence or
interest penalty on us, the same shall be reimbursed from the Contractor by way of credit note.”

15 Labour Cess In Contractor's scope if applicable & the same shall be shown separately in the summary.
16 42.1 Changes This is a firm rate contract, quantity may vary to any extent. No escalation in rates is applicable for
what so ever reasons during the completion period or authorised extention of time except for the
Basic Rate Materials under this contract if applicable.
17 19 Power and Water The Contractor shall be responsible, at his own cost, for the provision of power, water and other
services he may require. Owner may provide water and/or power (if available and to the extent
available at the discretion of the Owner) to use for the purpose of the Works at one point on
chargeable basis (at applicable charges). Contractor shall, at his own cost, shall provide necessary
arrangements for further distrubution and necessary water and power meters for measuring the
quantities consumed.

18 QRO items QRO items of BOQ are subject to re-negotiation by the Client prior to executing such items.
19 Scaffolding/Staging Rates are inclusive of scaffolding required to carry out the work. If scaffolding will be provided by
Client, charges will be debited to contractor.
20 Safety The contractor shall follow the applicable construction safety guidelines in Construction Safety Manual
while execution of the works as applicable.
21 Labour accomodation Contractor shall make his own arrangements for labour accommodation outside the Site premises.

22 Compliances required 1. Contractor has to issue pay slip to every employees.

All compliances (i.e. PF, ESIC, MLWF, labour Licence, etc.)

23 Space for office / stores Only space for Contractor's office/ store shall be provided by the Owner free of cost. Barricading with
lockable arrangements shall be done by the contractor at his own cost.
24 Dewatering One time dewatering if required before handing over the Area to the Contractor will be in Owner's
scope
25 Inspection All stage wise inspection by EIC shall be carried out as per Approved Manufacturer's Methodology and
Checklists Enclosed.
26 Testing Contractor shall bear all the charges for laboratory testing of the material. List of test to be conducted
shall be submitted by contractor. Testing shall be done from the approved testing lab, when ever
required & as per instruction of engineer in charge/Owner's QA & QC team as per the QAP materials
(Annexure C) & applicable technical specifications.

27 Contractor's All Risk Contractor shall take his own 'Contractors All Risk Policy' including the third party liability.

28 The Contractor shall submit for Owner's approval project specific Work Methodology for key
activities, Quality Plan, Health Safety & Environment (HSE) Plan, Project Schedule, Logistics
Plan and such other documents as required with respect to "Work", in line with the Owner's
Technical Specification, Quality Assurance Plan, Construction Safety Manual & other
applicable professional standards & IS Codes etc

29 Waterproof Guarantee Contractor Shall furnish Guarantee for Waterproofing works for the entire structure including
Waterproofing works done by earlier agency for a period of Ten years from the date of Completion on
Rs 100/- Stamp paper in format approved by Owner.

General Notes
1 The item description in the BOQ shall be read in conjunction with the manufacturer's Technical Data Sheets for the respective approved waterproofing chemicals/brand.
2 Vertical transportation by means of Tower Crane /Man Material hoist shall be included in rates and shall be as per the site logistics required and approved by company.
3 All waterproofed mortar will be prepared in mechanical mixer along with availability of 35 lit farma & measuring jar for material volumetric batching by 500/250 ml measuring
jar & tray for mortar.
4 Testing of waterproofing by storing of water as directed by the Owner for 7 days. In case of failure, or leakages, the contractor to carry out remedial measures as suggested by
the Engineer in Charge. In extreme cases, the contractor to re-do the entire waterproofing after breaking the faulty one. No extra payments to be done.

Surface Preparation by compressed air to remove any dust and laitance, wire-brushing the surface, removing foreign particles, pressure grouting of construction joints and
honey comb areas with cement grout /specialised non-shrink Cementitious compound, Crack repairing, Grinding slab or wall, chasing, Cleaning, sealing of joints, making watta
at corners/junctions, river sand screened and washed, Tools, Tackles, plant and machinery, overheads, work as per QAP, Supporting System to finish the BOQ work items etc..
In all cases detailed method statements with sectional drawing details & all stages check lists will be provided & maintained by contractor after approving from EIC.

6 The rate shall include installation for water line for curing with pumping arrangement as well as lighting arrangement on each floor and after completion of work contractor
shall hand over the entire system to the company in working condition.
7 GI/PVC Spout at require location with required slope & protection.
8 Curing for 10 days or as per manufacturers requirement.
9 Only plan area will be measured and paid. No extra will be paid for forming Wattas (gola) at the junction of slab and wall/parapet/column if not specified in the individual BOQ
items.
10 All works to be as per MOEF guideline/Norms.
11 The rates shall be considered inclusive of coordination with other specialised agency, loading, unloading, transport, madadi, insurances, PF,ESIC, MLWF or other Labour
Compliances, local issues, debris disposal, scaffolding etc in relation to the works.
12 All Slab, sunks, other - Cleaning the surface to our requirements, ponding the slab with water for 48 hours to identify the existing leaking spots, marking the same and
grouting all leaking spots, construction joints, honeycomb locations, cracks etc., with non shrink cementitious grout to full saturation, making small fillets (wattas) around the
periphery junctions etc. complete.
13 Ultratech , ACC (43 Grade) or any other brand of Cement approved by the Owner shall be used for all activities
14 Machine Grade Crushed sand shall be used for Filling and Zone -2 River sand (coarse sand) shall be used for top finishing works
15 The Density of Broken Light weight blocks to be used for filling shall not exceed 650 Kg/Cum

Sunken Portion:- Providing and laying broken lightweight block bat waterproofing treatment to specified
areas viz toilets, kitchen, wet areas etc. The slab shall be laid over with broken lightweight block bat coba
laid & joints filled in with cement mortar 1:5 in true lines & levels gradient as required slope at outlet /
nahni trap (for easy flow of water/rain water).

Finishing/ Protective/ Final coat


Finally the top surface of broken lightweight block bat coba shall be laid over and joints finished with
20mm waterproofing layer with CM 1:4 and admixture Conplast WL of Fosroc finished rough to receive
further finishes. The treated surface after 12 to 15 hrs. shall be kept ponded for continuous period of 10
days to detect any seepage/ leakage/ dampness if any, the surface then shall be cleaned. Conplast WL of

canopies, chajjas, exposed slabs etc. The slab shall be laid over with brick / block bats coba laid & joints
filled in with cement mortar 1:5 in true lines & levels gradient with avg thickness of 125mm and as
required slope at rain over let (for easy flow of water/rain water) Finally the top surface of brick / block
bat coba shall be laid over and joints finished with waterproofing layer with CM 1:4 and admixture
Conplast WL of Fosroc finished smooth with cement slurry. The treated surface after 12 to 15 hrs.
thereafter shall be kept ponded for continuous period of 7 days to detect any seepage/ leakage/
dampness if any, the surface then shall be cleaned to withstand weather and domestic use. Plan area Conplast WL of
