None RESOLUTION N 158, SERIES OF 2005 ENACTING MUNICIPAL ORDINANCE NO. 01 $ WHEREAS, RA 9003, otherwise known asthe “Ecological Solid Waste Management Act ‘of 2000" provides the legal framework for the country's systematic, comprehensive and ecological solid waste management program that shail ensure protection of public health and the environment. It underscores, among other things, the need to create the necessary institutional mechanism and incentives, as well as imposes penalties for acts in violation of any of its provisions; WHEREAS, on November 8, 2004, the Sangguniang Bayen thru SB Resolution No. 142 has adopted the Solid Waste Management Plan for the Municipality of Bamban which was prepared thru the assistance of the DILG - Clark Area Municipal Development Project (CAMDP) — Project Management Office and prepared pursuant to the provisions of RA 7160 (Local Government Code of 1981) and RA 9003 or the Ecological Solid Waste Management Act 2000; WHEREAS, the Sangguniang Bayan believes that the Solid Waste Management Plan of the Municipality can only be concretely carried out thru the enactment of an ordinance that will compel all concerned to practice the very essence of ecological waste management ~ that is, SEGREGATION AT SOURCE; NOW THEREFORE, on motion of Councilor Carlito M. Policarpio, unanimously seconded BE IT RESOLVED, to enact: MUNICIPAL ORDINANCE NO. 01 AN ORDINANCE REQUIRING EVERY HOUSEHOLD, ESTABLISHMENT AND INSTITUTION IN THIS MUNICIPALITY TO SEGREGATE WASTE DISPOSAL, DESIGNING A SYSTEM OF GARBAGE COLLECTION, IMPOSING PENALTIES FOR VIOLATION ‘THEREOF, AND FOR OTHER PURPOSES Be it promulgated by this Body in session assembled, that: Section 1. TITLE. This Ordinance shall be otherwise known as “Solid Waste Segregation Ordinance” Section 2. SCOPE AND COVERAGE. DECLARATION OF POLICY AND PURPOSE. This ordinance is enacted in order to effectively carry out the Solid Waste Management Pian of the Municipality, Section 4. DEFINITION OF WORDS AND PHRASES. When found in this ordinance, the following words and phrases are explained thus: Buy-back center - shall refer to 2 recycling center that purchases or otherwise accepts recyclable materials from the public for the purpose of recycling such materials, examples of which are junk shops Collection — shall refer to the act of removing solid waste from the source or from @ communal storage point. Composting - shall refer to the controlled decomposition of organic matter by micro~ organisms, mainly bacteria and fungi, into a humus-like product. Controtled dump — shall refer to 2 disposal site at which solid waste is deposited in accordance with the minimum prescribed standards of site operation. Ecological solid waste management — shall refer fo the systematic administration of activities which provide for segregation at source, segregate at source, segregated transportation, ‘storage, transfer, processing, ‘reaiment, and disposal of solid waste and all other waste ‘management activities which do not harm the environment. Materials recovery facility — shall include solid waste transfer station or sorting station drop-off center, a composting facility, and a recycling facility Municipal wastes - shall refer to wastes produced from activities within local government units which includes 2 combination of domestic, commercial, institutional and industrial wastes and street liters. Open burning — shall refer to the thermal destruction of wastes by means of direct exposure to fire. Furthermore, this definition shall apply to traditional small-scale methods of ‘community sanitation “siga’. Open dump ~ shall refer to a disposal area within the solid wastes are indiscriminately thrown or disposed of without due planning and consideration for environmental and health standards. Receptacles ~ shall refer to individual containers used for the source separation and the collection of recyclable materials. Receptacles may be made of large plastic bags, sacks or boxes. Reeyelable material ~ shall refer to any waste material retrieved from the waste stream land free from contamination that can sill be converted into suitable beneficial use or for other purposes, including, but not limited to, newspaper, ferrous scrap metal, non-ferrous scrap metal used oll, corrugated cardboard, aluminum, glass, office paper, tin cans, plastics and other materials as may be determined by the Commission. Recycling — shall refer to the treating of used or waste materials through @ process of making them suitable for beneficial use and for other purposes, and includes any process by which solid waste materials are transformed into new products in such a manner that the original products may lose their identity, and which may be used as raw materials for the production of other goods or services: Provided, that the collection, segregation and re-use of previously used packaging material shall be deemed recycling under the Act. This also refers to the Kalangitan Sanitary Landfill ‘Segregation — shall refer to sorting and segregation of different materials found in solid waste in order to promote recycling and re-use of resources and to reduce the volume of waste for collection and disposal, ‘Segregation at source ~ shall refer to @ solid waste management practice of separating, at the point of origin, different materials found in solid waste in order to promote recycling and re- use of resources and to reduce the volume of waste for collection and disposal. Solid waste — shell refer to all discarded household, commercial waste, non-hazardous institutional, ports / harbour and industrial waste, street sweepings, construction debris agriculture waste,.and other non-hazardous/non-toxic solid waste. Unless specifically noted othenvise, the term "solid waste” as used in the Act shall not include: @. waste identified or listed as hazardous waste of a solid, liquid, contained gaseous or ‘semisolid form which may cause or contribute to an increase in mortality or in serious or incapacitating reversible iiness, or acute/chronic effect on the health of persons and other organisms; 5. infectious waste from hospitals such as equipment, instruments, utensils and fomites of a disposable nature from patients who are suspected to have or have been diagnosed as having communicable diseases and must therefore be isolated as required by public health agencies, laboratory wastes such as pathological specimens (.e., all tissues, specimens of blood elements, excreta, and secretions obtained from patients or laboratory animals), and disposable fomites that may harbor or transmit pathogenic organisms, and surgical operating roam pathologic specimens and disposable fomites attendant thereto, and similar disposable ‘materials from outpatient areas and emergency rooms; and ©. waste resulting from mining activities, including contaminated soll and debris. Section MANDATORY WASTE SEGREGATION AT SOURCE 5.2. Every household, establishment and institution in this municipality is strictly required to segregate its daily waste. Garbage must be placed in three (3) different receptacies as: 1. Biodegradable (Nabubulok o natutunaw) compostable 2. Non-Biodegradable or recyctable (Hindi nabubulok) 3. Refuse (Patapon) 5.b. Receptacles or garbage containers either in the form of sacks or plastic bags must be produced by the household, establishment or institution. 5.0. Households/institutions/establishments are strongly encouraged to practice Composting, re-using and recycling of waste, if possible, right within their respective backyard or premises. 5.d. Open dumping and open burning in barangay or household level is strictly prohibited Section6 “NO SEGREGATION, NO COLLECTION POLICY’ 6.a, No household, establishment or institution in this municipality shall be collected of its waste based on 2 regular schedule unless it complies with Section 5 of this ordinance, &.b. The municipal govemment's garbage trucks assigned in the area of Poblacion and Dapdap Resettlement shall collect the segregated wastes based on an approved schedule, which shall form an integral part of this ordinance (ANNEX 1), 6.c, The LGU garbage trucks shall be so designed as to have separate container for the different kinds of garbage collected, ee Kg Republic ofthe Philippines & 2) Province of Tarlac 3 2 MUNICIPALITY OF BAMBAN sere ptt renee a « Y./__ OFFICE OF THE SANGGUNIANG BAYAN Seats 64d. Barangays in Sacobia Area (Sto. Nifio and San Vicente) Mainang, Matagpo and ‘Sacot Resettlement shall be exempted from the garbage collection coverage because of their remote location. (SACOT Resettlement on the other hand, already practices ‘garbage composting and has its own garbage collection system) 6. These barangays and sitios namely, Sto. Nifio, San Vicente, Sitio Mainang and Matagpo are likewise required to practice waste segregation, and have an option to establish a Material Recovery Facility in their barangayisitio. Small scale backyard composting is hereby strongly encouraged, since many houscholds have spaces within which backyard composting may be done. Section? ROLE OF JUNK SHOP OPERATORS 7.a. The Municipal Government shall coordinate with junkshop operators or owners of buy back centers to which recyclable waste materials, gathered from the collected waste may be brought and sold. These include empty botties, steel, newspapers, plastic containers, softdrink cans, ete. 7b, Barangays shall have the option to establish ties with junk shop operators in their barangays who shall accept recyclable wastes from households in the barangay. Only refuse (patapon) will then be collected by the LGU garbage truck. Section ROLE OF BARANGAY SOLID WASTE MANAGEMENT COMMITTEE As provided under Section 7 (IRR) of RA 9003, the BWC which shall be duly organized by every barangay thru an ordinance, shall have the following functions and responsibilities: a.) Formulate solid waste management plan consistent with this municipal ordinancefor ‘municipal plan; 'b.) implement segregation and collection of biodegradable, compostable and reusable wastes; ) Establish materials recovery facility; i necessary ) Allocate barangay funds, or look for sources of funds; ) Organize core (purok) coordinators; and ) Submit quarterly report to municipality. In addition, the BSWC shall undergo re-echo training on Solid Waste Management practices to be conducted by the Solid Waste Management Unit and Local Trainers Poo! of the Municipal Government. Section9 ROLE OF MUNICIPAL SOLID WASTE MANAGEMENT BOARD (MSWDB) ‘The Board, which shall be duly constituted thru an Executive Order, shall have the following duties and responsibilities as provided under Section 4 (IRR) of RA 9003: 1a. Revise the Municipal Solid Waste Management Pian every 2 years if the need arises toensure the fong-term management of solid waste, as well as integrate the various solid waste management plans and strategies of the barangays in its area of jurisdiction. In the development of the Solid Waste Management Pian, it shall conduct consultations with the various sectors of the community; 9.b, Adopt measures to promote and ensure the viability and effective implementation of solid waste management programs in its component barangays; 8.¢. Monitor the implementation of the Municipal Solid Waste Management Plan or ordinance through its various political subdivisions and in cooperation with the private sector and the NGOs; ‘9.4. Convene regular meetings for purposes of planning and coordinating the implementation of the solid waste management plans of the respective component barangays; 84. Oversee the implementation of the Municipal Solid Waste Management Plan and this ordinance; 8.g. Develop the specific mechanics and guidelines for the implementation of the Municipal Solid Waste Management Plan/ordinance 81h. Provide the necessary logistical and operational support to its component barangays in consonance with subsection (f) of Section 17 of the Local Government Code: 911, Recommend measures and safeguards against pollution and for the preservation of the natural ecosystem; and 9). Coordinate the efforts of its component barangays in the implementation of the ‘Municipal Solid Waste Management Plan/ordinance 91k Propose the appropriation of funds for the sustainability of this project such as for procurement of composting equipment, improvement of MRF and others. Section 10 MATERIAL RECOVERY FACILITY (MRF) ‘The unutilized Public Market building located at Sitio Dulupon, Anupul, is hereby identified as the Material Recovery Facility of the municipality where garbage will be sorted and segregated as recyclables and compostables. The municipal government shall introduce improvement of the facility to include provisions for receiving, waste Segregation, hammer-milling, composting drums, storage for both organic fertilizers produced and recyclables, toilet, and office space. Only refuse or residuals will then be dumped at the nearby Kalangitan Sanitary Landfil Barangays shall have the option to establish their own MRF even a modest version. Section 11 MASSIVE INFORMATION AND EDUCATION CAMPAIGN (IEC) The Municipal Goverment shal undertake massive information campaign to be designed by the Municipal SWMC, the MSW Unit and LTP. The activities shall include among thers, the following: 1, Trainings and seminars to BSMC (waste segregation, livelihood from recyclables & compost, etc) Display of posters and streamers, placing of appropriate signs Launching of project thru motorcade or simple program Distribution of leaffets and flyers Incorporation of SVM information in regular meetings of the Municipal Government such as with the SK, ABC, local special bodies, etc. 6. As @ matter of setting an example, solid waste segregation should be practiced within the Municipal Hall Offices, Section 12 PILOT BARANGAYS Two (2) barangays in the Poblacion area shall serve as project pilot areas in the waste segregation at source, to include: 4. Barangay San Nicolas 2. Barangay Anupu! 12.1 Inal implementation of the project shall cover the aforementioned barangays. Littering, throwing, dumping of waste matters in public places, such as roads, sidewalks, canals, esteros o parks, and establishments or permitting the same; ». Open burning of solid waste; c. Causing or permitting the collection of non-segregated or unsorted waste; 4d. Squatting in open dumps and landfils; . Open dumping, burying of bio or non-biodegradable waste especially in flood-prone areas; 1. Unauthorized removal of recyclable materials intended for collection by authorized persons; 9. Mixing of source-separated recyclable materials with other solid waste in any vehicle or container used in solid waste collecion/disposal; h. AN ORDINANCE REQUIRING EVERY HOUSEHOLD, ESTABLISHMENT AND INSTITUTION IN THIS MUNICIPALITY ‘TO SEGREGATE WASTE DISPOSAL, DESIGNING A SYSTEM OF GARBAGE COLLECTION, IMPOSING PENALTIES FOR VIOLATION THEREOF, AND FOR OTHER PURPOSES: Be it promulgated by this Body in session assembled, that Section 1. TITLE. This Ordinance shall be otherwise known as "Solid Waste Segregation Ordinance" Section2. SCOPE AND COVERAGE. The fifteen (16) barangays of the Municipality including the Depdap Resettlement, Mainang and other resettlement areas in the munjepaty shal be covered bythe implementation ofthis ordinance
