(With Motion to Transfer Drug Dependency Examination

to Sarangani Provincial Hospital or to any DOH-Accredited Physician)

ACCUSED, through counsel from the Public Attorney’s Office, and

unto this Honorable Court, respectfully states that:

The instant case was set for hearing on 28 May 2018 and the accused
offered to plea bargain under Section 12 of RA 9165. In view of the
foregoing plea, the Honorable Court directed the jail authorities to cause
the accused to undergo Drug Dependency Examination at Balay Silangan,
Nagpan, Malungon, Sarangani Province;

Herein accused, after undergoing drug testing at SOCSARGEN

COUNTY HOSPITAL, General Santos City, proceeded to Balay Silangan at
Nagpan, Malungon, Sarangani Province. However, upon repetitively
trying to get a schedule for Drug Dependency Examination at Balay
Silangan, the same is only catering patients/clients residing in Malungon,
Sarangani Province. Thus, herein accused being a resident of Malapatan,
Sarangani Province was not entertained for Drug Dependency
Examination.

 For this reason, the accused is begging for the mercy and compassion
of this Honorable Court that he be directed for a Drug Dependency
Examination at Sarangani Provincial Hospital or at any DOH-accredited
physician.

WHEREFORE, for the interest of compassionate justice, it is most

respectfully prayed that the accused be directed for a Drug Dependency
Examination at at Sarangani Provincial Hospital or at any DOH-accredited
physician.
