MOTION TO FORFEIT APPEAL BOND AND RELEASE TO

COMPLAINANT AS PARTIAL PAYMENT

______________, (“Complainant”), unto this Honorable

Office most respectfully avers:

1. Pursuant to the Writ of Execution issued in this case,

Complainant respectfully request that the appeal bond in the amount
of ___________ be forfeited against Respondent and the same be
released to Complainant to satisfy, at least partially, the monetary
award per the Honorable Labor Arbiter’s decision dated
______________.

2. This request is made without prejudice to the full

satisfaction of the amount of the judgment through garnishment or
otherwise of the properties, bank accounts, etc. of Respondent.

PRAYER

WHEREFORE, premises considered, it is respectfully prayed that the

appeal bond be forfeited in favour of the Complainant and released
to her to satisfy, at least partially, the judgment award without
prejudice to the full satisfaction thereof.

Other reliefs, just and equitable in the premises, are likewise

prayed for.
