Dear friends,
In addition to 615 of our members, on Saturday, State Bank of India has paid
interest on five years benefit and differential commutation. These 33 members
are not a part of Respondents in Supreme Court and they were also not covered
by Contempt Petition at Hon'ble Supreme Court.
Even before issue of notice in Contempt Petition, these pensioners have received
arrears. They also got 1% additional interest as Hon'ble High Court had allowed
10% interest whereas Supreme Court ordered 9% interest.
Hon'ble High Court of Karnataka has also issued notice to Shri Rajnish Kumar,
Chairman, State Bank of India. Perhaps, this Contempt Petition would also come
up for hearing immediately after Corona - 19 Lock-down ends. We would like to
bring to notice of our friends that our Commune continues to fight mighty State
Bank of India and also understand the consequences of such struggle. With the
support of our members, we are confident of succeeding in our struggle with
flying colours. This is just one among many issues, we are fighting.

Congratulations to Sri.Prasadji and his team once again, for securing benefits
from.SBI to further 33 pensioners,apart from 615 beneficiaries,though they were not
part of case in SC through long drawn legal battle.

Pension should be given as per Pension Regulation 1995. Every Pensioner whether he is first
OPTEE or Second OPTEE , he is receiving pension and the pension is being paid on the basis
of Pension Regulation 1995. The PRE1995 CLEARLY MENTIONS THAT HOW A PENSION
SHOULD BE PAID. ON THAT BASIS ONLY WE ALL ACCEPTED TO GO FOR PENSION OPTION.
THE PRE1995 CLEARLY MENTIONS UNDER REGULATION 37 , HOW A D.A RELIEF SHOULD
BE CALCULATED AND BE PAID. DID IT NOT MENTION THAT THE D.A SHOULD BE PAID IN
ACCORDDACE WITH THE RATES SPECIFIED IN APPENDIX II. AS PER THE APPENDIX II , THE
RATE OF DEARNESS RELIEF AS A PERCENTAGE OF BASIC PENSION IS MENTIONED AS
1148 POINTS. THIS IS APPLICABLE TO ALL RETIREES WHO ARE RETIRED ON OR AFTER
THE IST DAY OF NOV'93. ARE THEY PAYING D.A AT THIS RATE. ??? NO NOT ALL PAYING
FROM THE DATE OF RETIREMENT. EVEN FOR THE SECOND OPTEES, THEY ARE ELIGIBLE .
ONCE THEY START PAYING PENSION MEANS THE BANKS AGREED TO PAY AS PER
PRE1995 ONLY. WHY BOTH THE ASSOCIATIONS ( AIBRF AND AIBPARA) ARE NOT EVEN
PUT FORTH THE D.A RELIEF DEMAND WITH THE BANKS . ACCORDING TO C.N.PRASADJI 'S
ANGEL , IF WE DO NOT CLAIM NOW , THE COURT MAY PRESUME THAT THE NON
CLAIMERS ARE HAPPY WITH THE PRESENT D.A slab system. Think my friends let us wake
up and let the Associations fight in the court along with SBI COMMUNES. IT IS NEED OF THE
HOUR. THINK MY FRIENDS.... WITH REGARDS,

Sairam, Thank you Sir for your clarity on the payment of pension, Date of retirement,
DA Rate etc.
Sir, I took SVRS from BOI in 2000 Dec.,fore going all benefits like any other
superannuated employee , except the 52 months exgratia paid for my 26 years of
completed service, in lieu of fore going my 7 years left over service (80 months) at
that time (which has value of my fringe benefits, future increments, increase in wages
due to bi partiates etc).
In 2009 ,Opted for pension with fond hope the banks will do justice for the loss
suffered by all the SVRS retirees..
Instead the Bank, gave benefit of 1.Pension from 2009 Nov, 2. Tapering DA as of
pension option date. 3.Commutation from date of request considering factor for the
present age instead of retirement age. 4.Ignored Pee 2002 retirees for 100% DA.
The other injustices to all retirees after the several BPS commencing from 8 th in
wards especially in 10 th BPS with Record Note.
The impact and affect of all the injustices is known to every body now.
I am drawing partial pension based on my 26 years service plus 5 yrs notional benefit
though but the bank ignored the service fact for giving the benefit of REMAS.
Bhagawan only has to bless us, for any improvement in pension and the benefits at
far with RBI and Central Government.
Let us wait and see what is in store for us after this COVID 19 Calamity.

Dear Shri Ramakrishnan,
At the outset, I would like to clarify that we are taking the issue of
payment of Dearness Relief in terms of Regulation 37, as a part of
Contempt Petition to be filed immediately after reopening of
Hon'ble Supreme Court, by All India Bank Retired Employees'
Association, which is a party in Civil Appeals connected with Civil
Appeal 5525/2012 - Bank of Baroda Vs. G Palani's case. We have
enough grounds and material to succeed in Contempt Case. In
case, we do not succeed in Contempt Petition, still we are ensuring
that delay and latches would not be applicable.
Leave apart the benefit under Regulation 37, please go through the
circulars/letters of these so called Apex organisations. None of
them even have a mention of order of Supreme Court dated
28.8.2019 in our Contempt Petition.
