ORDINANCE NO. 2015-005

AN ORDINANCE CREATING AND MAINTAINING A PHILHEALTH TRUST FUND


FROM THE PROCEEDS OF THE PRIMARY CARE BENEFIT 1 (PCIB) TO BE
PROVIDED BY THE PHILIPPINE HEALTH INSURANCE CORPORATION FOR THE
QUALIFIED BENEFICIARIES AND DEPENDENT ENROLLED UNDER THE
SPONSORED PROGRAM (SP), OVERSEAS WORKERS PROGRAM (OFW) AND
ORGANIZED GROUPS (OG) ENLISTED BY THE RURAL HEALTH UNIT (RHU).

WHEREAS, Section 11, Article XIII of the 1987 Philippine Constitution declares
that the State shall adopt an integrated and comprehensive approach to health
development which shall endeavor to make essential good health and other social
services available to all people at affordable cost. Priority for the needs of the
underprivileged sick, elderly, disabled, women and children shall be recognized.
Likewise, it shall be the policy of the State to provide free medical care to paupers;

WHEREAS, to implement the aforementioned constitutional provisions, the


Philippine Congress enacted Republic Act No. 7875 as amended by Republic Act No.
924, “An Act Instituting A National Health Insurance Program (NHIP) and Establishing
Philippine Health Insurance Corporation (PHILHEALTH) Program;

WHEREAS, consistent with the vision and objectives on the State, as mandated
in NHIP’s mandate and in local government autonomy statutes, the Sangguniang Bayan
acknowledges its joint responsibility with the Philippine Health Insurance Corporation to
provide access to basic package of needed personal health services for the social and
economic well-being of the people of the Municipality of Cavinti, specifically the
marginalized and underprivileged through the implementation of the Sponsored
Program;

WHEREAS, in support of the National Government Health Agenda to provide


Universal Health Care for all Filipinos, also known as “Kalusugang Pangkalahatan (KP)
Philhealth aims to ensure that all Filipinos have access to quality health services that
are efficiently delivered, equitably distributed, fairly financed and appropriately utilized
by an informed and empowered public;
WHEREAS, the passage of the Philhealth Board Resolution No. 1587 s. 2012
has amended the implementation of the Outpatient Benefit Package and approved the
Primary Care Benefit (PCBI) Package to expand and increase the number of services in
the Primary Health Care Benefits for Philhealth members, enhance incentive for PCB
provides to promote healthy behavior prevent disease and/or associated complications,
facilitate appropriate referral and ensure complete and timely reporting of health data for
monitoring performance assessment and evaluation purposes;

WHEREAS, the creation and maintenance of the Philhealth Trust Fund for the
Per Family Payment Rate (PFPR) to be released by Philhealth is necessary to attain the
purpose and objectives of the Primary Care Benefit(PCB)

NOW THEREFORE:

On joint motion of SB Members Michael Eric L. Castillo and Pedro O. Villegas,


Jr., duly seconded by SB Members ___________________, and by unanimous consent
of all the members, there being a quorum, it was

BE IT ORDAINED by the Sangguniang Bayan of Cavinti, Laguna, in session


assembled:

SECTION 1. TITLE. This ordinance shall be known as the “Philhealth Trust Fund
for the Per Family Payment Rate”.

SECTION 2. CREATION AND MAINTENANCE OF PHILHEALTH TRUST


FUND. A Philhealth Trust Fund is hereby created and be maintained from the proceeds
of the primary Care Benefit I to be provided by the Philippine Health Insurance
Corporation (Philhealth) for the qualified members and dependents of the Sponsored
Program, Overseas Workers Program and Organized Groups enlisted by the Rural
Health Unit in the Municipality of Cavinti, Laguna.

SECTION 3. MANAGEMENT AND DISPOSITION OF THE PER FAMILY


PAYMENT RATE (PFPR). The Use, Management and Disposition of the Per Family
Payment Rate (PFPR) shall be governed by the following rules:

The Per Family Payment Rate (PFPR) shall be released on a quarterly basis by
Philhealth under the following conditions:

3.1. Eighty per cent (80%) of PFPR is for operation cost and shall be divided as
follows:

a. Minimum of forty (40%) for drugs and medicines (PNPF) to be dispensed at


the facility including drugs and medicines for:

a. Asthma
b. Acute Gastro-enteritis and
c. Pneumonia

b. Maximum of forty per cent (40%) for reagent, medical supplies, equipment
(i.e. ambulance, ambubag, stretchers, etc.) information technology (IT
equipment specific for facility use, needed to facilitate reporting and database
build-up) capacity building for staff, infrastructure or any other use related
necessary for the delivery of required service including referral fees for
diagnostic services if not able in the facility.
3.2. The remaining twenty per cent (20%) shall be exclusively utilized and
honoraria of the staff of the PCBI facility and for the improvement of their
capabilities would enable them to provide better health services:

a. Ten per cent (10%) for the physician;


b. Five per cent (5%) for other health professionals and staff of the facility; and
c. Five per cent (5%) for none-health professionals/staff including volunteers
and community members of health teams (e.g. Women’s Health Team,
Community Health Teams)

SECTION 4. ADVOCACY FOR NHIP PARTICIPATION AND MANDATING


COMPLIANCE TO NHIP RULES. The Sangguniang Bayan agrees to actively advocate
for NHIP participation by private and non-government organizations within its territorial
jurisdictions and mandating compliance to NHIP rules by entities required to obtain LGU
permit/licenses.

SECTION 5. EFFECTIVITY. This ordinance shall take effect immediately upon its
approval.

ORDERED: Let copies of this Ordinance be furnished to the President and Chief
Executive Office of the Philippine Health Insurance Corporation, HON. MILBERT L.
OLIVEROS, Municipal Mayor, Cavinti, Laguna, and DR. EDUARDO P. BANZON for
their information.
