ARAHAN KEPADA CALON:

1. Jawab 1 (SATU) soalan yang diberikan.

2. Jangkamasa peperiksaan ini adalah dengan ketatnya ditetapkan selama 4

JAM. Calon dinasihatkan menggunakan 3 JAM pertama untuk
melengkapkan jawapan calon di dalam format yang ditetapkan. Calon boleh
menggunakan 1 jam berikutnya untuk menyelesaikan isu-isu capaian talian
(sekiranya ada), dan memuatnaik jawapan ke Spectrum.

Calon boleh merujuk buku, artikel, nota dan slaid tetapi calon tidak
dibenarkan menyalin perkataan demi perkataan dari buku, artikel, nota dan
slaid.

3. Had bilangan perkataan yang dibenarkan adalah 1,500 perkataan. Jawapan

yang melebihi bilangan perkataan tidak akan diambil kira. Pelajar WAJIB
meletakkan bilangan perkataan di akhir kertas jawapan.

4. Jawapan mesti ditaip dengan font Arial 12 dan dilangkah dua baris.

5. Muatnaik jawapan ke Spectrum dan emel kepada drfaizahnazri@gmail.com

6. Peperiksaan adalah pada hari Jumaat 11.6.2021 bermula jam 10 pagi

sehingga 2 petang. Calon mesti memuatnaik dan emel jawapan sebelum
jam 2 petang pada 11.6.2021

1. Anne bersekolah di sebuah sekolah berasrama penuh, Green Gables di luar

bandar. Pada musim pandemik Covid 19 semua murid telah diarahkan untuk
pulang ke rumah berikutan peningkatan kes-kes jangkitan. Hanya pelajar
tingkatan 5 sahaja yang kekal di sekolah kerana persediaan untuk peperiksaan
SPM.

Sekolah Green Gables telah mendapatkan kontraktor untuk mengubahsuai satu

blok bangunan asrama di dalam kawasan asrama pelajar perempuan. Kerja
pengubahsuaian telah dimulakan semasa cuti sekolah tetapi setelah cuti tamat,
kerja-kerja tersebut masih belum selesai.

Sebahagian pagar asrama itu juga telah dirobohkan untuk membolehkan lori
kontraktor keluar masuk. Pekerja-pekerja kontraktor sepatutnya bekerja dari jam
9 pagi hingga 5 petang sahaja. Namun oleh kerana berlakunya kelewatan di dalam
menyiapkan kerja, pihak sekolah membenarkan waktu bekerja mereka
dipanjangkan sehingga 12 malam.

Pengawal keselamatan telah ditugaskan oleh pihak sekolah di kawasan asrama

pelajar perempuan tetapi pelajar sering mengadu bahawa pada waktu malam,
pengawal hanya tidur sahaja.

Pada satu malam dua orang lelaki telah menceroboh masuk ke dalam asrama
pelajar perempuan dan menyentuh kawan Anne, Josie Pye semasa beliau sedang
tidur. Josie tersedar dan jeritan beliau mengejutkan seluruh asrama. Beliau
nampak mereka lari memakai baju perempuan tetapi tidak dapat mengenal pasti
siapakah lelaki-lelaki berkenaan. Di sekolah tersebut terdapat juga guru, staf dan
pelajar lelaki.

Josie, Anne dan beberapa orang pelajar lain kini mengalami trauma untuk tidur di
asrama. Peperiksaan SPM bakal tiba kurang dari 2 minggu sahaja lagi. Aduan
telah dibuat kepada Pengetua Ms Stacy tetapi beliau hanya membuat laporan
polis dan memarahi pelajar yang mengadu kepada ibu bapa.

Nasihatkan pihak-pihak yang berkenaan sama ada apa-apa liabiliti Tort timbul.

INSTRUCTIONS TO CANDIDATES:

1. Answer the 1 (ONE) question provided.

2. This is a strictly 4 hour examination. Candidates are advised to use the first 3
hours to complete their answers in the required format. Candidates are to use
the remaining 1 hour to resolve connectivity issues (if any), and upload their
answers to Spectrum.

You may refer to books, articles, notes and slides but you are not permitted
to copy word for word from the books, articles, notes and slides.

3. The word limit allowed is 1,500 words. Answers beyond the word limit will not
be taken into account. Students MUST state the word count at the end of their
answer script.

4. Answers must be typed in Arial font size 12 with double-spacing.

5. Upload and email the answers to Spectrum and email to

6. The examination is on Friday 11.6.2021 from 10 am to 2pm. Candidates must

upload and email their answers before 2pm on 11.6.2021

1. Anne goes to a boarding school, Green Gables which is located in a rural area.
During the Covid 19 pandemic all students were instructed to go home following a
rise in cases of infection. Only the Form 5 students remained at school for the SPM
exam preparations.

Green Gables procured a contractor to renovate one block of dormitory building

within the girls’ dormitory area. Renovation work began during the school break but
at the end of the break, the work was still not completed.

Part of the dormitory fence were also demolished to allow the contractor’s lorry to
enter and leave. The contractor’s workers were supposed to work from 9 am to 5
pm only. However due to the delay in completing the work, the school allowed their
working hours to be extended to 12 am.

Security guards were placed on duty by the school in the girls’ dormitory area but
the students frequently complain that during the night they only sleep.

One night two men trespassed into the girls’ dormitory and touched Anne’s friend,
Josie Pye while she was sleeping. Josie became conscious and her screams
awoken the whole dormitory. She saw them run wearing women’s clothing but could
not identify who the men were. In the school, there were also male teachers, staff
and students.

Josie, Anne and some other students are now traumatised to sleep in the dormitory.
The SPM exams are approaching in less than 2 weeks. Complaints were lodged
with Headteacher Ms Stacy but she simply lodged a police report and told off
students who complained to their parents.

Advise the parties as to whether any Tort liability arises.
