DEPARTMENTAL INQUIRY UNDER RULE 14 OF THE CCS(CCA) RULES 1965 AGAINST SHRI.

1. With reference to the aforesaid letter, at para '1' you have referred the inquiry held on 7 th Mar
2020. It is submitted that my Defence Assistant Shri. RG Pandey has submitted the issues and
apprehensions about the conduct of inquiry on 7 th Mar 2020, through his letter dated 6th Mar 2020
(Copy enclosed), which was received by your office. My DA has categorically requested to take utmost
care about the issues / objections brought before you through his letter and reschedule the said inquiry
as well as to shift the place of inquiry, in order to conduct the inquiry as per the provisions of law. It is
unfortunate mention that neither you have replied to the issues raised by my DA through his letter nor
have accepted my repeated requests to not to proceed in the inquiry in absence of my Defence
Assistant, also you have arbitrarily refused to adjourn the inquiry. Further you have threatened me to
conduct the inquiry ex-parte, which is illegal and against the principle of natural justice.
2. The Examination-in-chief of PW….. has never been conducted in presence of me and my DA,
which is totally unfair. Also the cross examination of PW…. by my DA is yet not completed and
pending. Despite of the same, your office has called me on 20th Mar 2020, at 1030Hrs, at Conference
Room, NCH Colony, Powai, Kanjurmarg, for General Examination to know my grievances, which is
very much shocking and unjustified. Thus your approach and act is seen to be inclined towards
prosecution side and seem to be Biased.
4. I want to put my grievances against the allegations in the instant case in my general
examination, after due completion of the Examination-in-chief and cross examination of PW….. in
presence of me and my DA. Your reply in this regard is highly solicited.
