Auction Procedures

•IDENTIFICATION OF GOODS
•Station Manager identifies goods liable for auction process (abandoned goods, seized goods or Out of Time goods);
Step 1 •Station Manager Organises Local Auction Committee to approve list and send to Customs Director.

•CUSTOMS DIRECTOR/DIRECTOR GENERAL DECISION


•Requisition of goods for use within Customs Department; or
•Destruction of Goods; or
Step 2 •Auction of goods. Goods with a value in excess of 10 000USD will be approved by the Director General.

•AUCTION VALUATION COMMITTEE


•Goods for auction assessed by Valuation Committee, 'Reserved Price' agreed;
•Date and time for auction agreed;
Step 3 •Auction List completed showing date/time of auction, description and quantity of goods and reserved price.

•NOTICE OF AUCTION
•MoFD Public Relations Department to advertise Auction List on MoFD Website, in Government Newsletter and private
newspapers.
Step 4 •Auction List sent to Chamber of Commerce, local trade groups, and displayed at Customs HQ and local Customs Station.

•PUBLIC VIEWING OF GOODS


•Customs to arrange dates/times for public viewing of auction goods.
Step 5 •All bidders considered to have inspected goods.

•QUALIFICATION OF BIDDER
•Somaliland resident over 16 years of age;
Step 6 •Holder of Tax Identification Number and MoT Import Licence.

•ACCEPTANCE OF BID
•Customs to accept highest bid, bidder to pay deposit of 50% of bid;
Step 7 •Balance to be paid within seven working days.

•CONFIRMATION OF SALE
•Customs to issue document confirming sale of goods to bidder;
Step 8 •Document to be used by bidder as authorisation for release of goods from Customs.

•ALLOCATION OF PROCEEDS OF SALE


•Auction administration fees, Customs duties, taxes, fees and any penalties recovered by Customs;
•Demurrage/Port fees paid to warehouse operator/port authorities;
Step 9 •Balance held in deposit account for 2 months;
•Claims can be made to deposit by transporter/importer, after 2 months deposit is forfeit to the revenue.
