MAHARASTRA

CTE (CONSENT TO ESTABLISH)


CTE-Consent to establish is NOC given by MPCB which is required before you start your
business or enterprise as per The Water (Prevention & Control of Pollution) Act – 1974 and the
air (prevention and control of pollution) act, 1981. It is mandatory to obtain CTE from the
respective State Pollution Control Board (MPCB) before the commencement of business. The
Process requires the application in prescribed format along with required documents and fees
followed by Inspection.

CTO (CONSENT TO OPERATE)


CTO- Consent to operate as it is known is NOC given by State pollution control board (MPCB)
to operate your business after you have received your CTE NOC from SPCB(MPCB) as per The
Water (Prevention & Control of Pollution) Act – 1974 and the air (prevention and control of
pollution) act, 1981. The procedure involves filing of respective application in prescribed format,
documents and fees for the application followed by inspection and after this process CTO is
issued

CATEGORY OF INDUSTRY
Industries are classified into four categories by Maharastra Pollution Control Committee Based
on what your work and how much pollutants are released with that job
work/business/manufacturing.

1. White

2. Green

3. Orange

4. Red

POLLUTION CONTROL NOC


The Maharastra Pollution Control Committee shall grant the Pollution Control No Objection
Certificate (NOC) the industries which are permissible in the mixed land use areas or zones as
per by-laws of the Master Plan notified by Maharastra governing authority or the draft master
plan. Any industry or enterprise established in the designated or approved area(s).

Procedure for Obtaining MPCB NOC

 Identifying the applicability and eligibility of the establishment or industry.


 Identifying the category and location of the respective industry or establishment.
 Preparation of drafts for filing of the application for MPCB NOC.
 Preparation & Filing of application for MPCB NOC.
 Post filing of the application the same is scrutinized by the authorized officers of the
MPCB.
 On scrutiny, every industry filing the application is subject to Inspection by the
designated officer.
 On conduction of successful and satisfactory scrutiny, the NOC is issued by the MPCB.

FEE CHARGED BY MPCB FOR NOC


The Fees for MPCB NOC (CTE and CTO) depends on various factors such as the Fixed Cost of
the Project, Category of Business and penalty imposed (if any) by the MPCB.

Documents required to get the MPCB consent to establish

 Site proposal/index
 Geographical Map
 Detailed layout plant of different processes and point sources of sewage
emissions/discharges and position of stack and documents including D.G. set capability in
KVA.
 Details of Water Pollution Control/Air Pollution Control instruments proposed to be
provided.
 Ambient Air Quality Report
 NOC from Directorate of Industries Government of Maharashtra /SSI Certificate
Maharashtra
 DGTD Registration ( if applicable )
 Details of chemical reactions with mass equilibrium.
 Consent fees in the form of DD drawn in the favor of Pollution control board.
 NOC from Local body.
 Undertaking on Rs. 20 stamp paper or Chartered Accountant certificate about projected
Capital Investment ( Land, building, and other types of machinery).
 Water Budget calculations
Documents required for consent to operate or renewal

 Detailed layout plant of different processes and point sources of effluent or sewage
discharge or emissions and position of stack and documents including DG set capability in
KVA.
 Process flow sheet.
 The latest analysis report of solid waste, effluent, hazardous wastes and fuel gases
 Details of Water Pollution Control or Air Pollution Control instruments provided.
 Ambient Air Quality Report
 NOC from Directorate of Industries Government of Maharashtra or SSI Certificate
Maharashtra.
 DGTD Registration. (if applicable )
 Details of chemical reactions with mass equilibrium.
 Consent fees in the form of DD drawn in the favor of the Pollution Control Board.
 Xerox copy of previous consent (for renewal only).
 Xerox copy of Environmental Clearance of Government of Maharashtra or Government of
India in case of 1st consent to operate in case of industries or process requiring
environmental clearance.

PROCEDURE

CONSENT TO ESTABLISH PROCEDURE:

1. Applicant registers on the online website to http://www.ecmpcb.in/


Applicants are not required to visit any of the MPCB offices at any stage of the
application process. The online system offers the functionality of one-time mobile
verification for the applicant & one-time online document verification by the Department
as a part of the registration procedure
2. Once registered, applicant files application online.

Then the application is shown as "Document Pending", 4 compulsory documents need to


upload online then the status changes to "Payment Pending". Industry will have to pay
the fees online as per fees structure http://www.mpcb.gov.in/consent-under-water-and-
air-act#fees. Industry will have to update the payment details and on approval of
application changes to "Payment Approved".

3. SRO assign the application to Field officer. Once the field officer reviews the application,
he/she Push the application through the Integrated Management information system
(IMIS), the application status changes to "In Process". Field officer scrutinize the
application, visit the industry (for establishment and first operate) & put their
recommendation / visit report and submit it to Sub Regional Officer.
4. Now depending upon the category and the Capital Investment of the industry the
application is forwarded through IMIS as per delegation of power. Refer below

will scrutinize the application, if it is fine then the application is granted in IMIS and then
status will be changed to "Approved" on the online portal followed by uploading the
signed consent copy. Otherwise if the application is not fine, then the application is
rejected in IMIS and notify the Entrepreneur by marking the application status as
"Rejected". Industry can download the consent copy from online portal.

CONSENT TO OPERATE PROCEDURE:

1. Once registered, applicant files application online.

Then the application is shown as "Document Pending", 4 compulsory documents need to

air-act#fees. Industry will have to update the payment details and on approval of

4. The concerned authority will scrutinize the application, if it is fine then the application is

application status as " Rejected ". Industry can download the consent copy from online

GUJARAT

DOCUMENTS NEEDED FOR GPCB NOC


 Application processing fees for the period of five years with break-up.
 Site plan showing the distance of (not applicable if the industry is to be located in GIDC
estate
 Nearest residential area with certificate of Talati /Mantri from the proposed site.
 Nearest of state/ national highway from the site of the unit/industries.
 Nearest Lake/ Pond/ River/ Sea/ Canal/ Forest area and any water body
 Nearest spaces of tourist and historical importance.
 School, collage, Temple, Mosque etc.
 Lay Out plan showing the location of the:
 Vents/ Stacks/ Chimney and emission points.
 Drainage and final disposal for liquid effluent
 Solid waste collection/ storage/ disposal facility
 Total available open land in the industrial premises
 List of partner/ Directors (names along with residential address) and telephone number.
 Details of effluent Treatment Plant along with flow diagram.
 Letter of membership of common effluent Treatment plant if applicable.
 Analysis report of Treated and untreated effluent (Air, water and Hazardous solid waste
for Schedule II category from Laboratory specified under HW Rules)
 Break-up of water uses and water balance.
 Details of manufacturing process, with process flow diagram and all chemical equations.
 Environmental statement (form-V)
 Certificate of SSI. (Compulsory for HW fees)
 Details of air pollution control measures: stack/ chimney wise for flue gas and process
emission.
 Boiler, Steam generating certificate indicating steam generation and consumption of coal
tons per day duly certified by office of boiler inspector (in case of IBR Boiler)
 Compliance regarding public hearing /environmental clearance certificate, if applicable.
 List of raw material with quantity per month (MT/M) (Verify Applicability of CPCB
Registration)
 List of product/by-product with quantity per month (MT/M) (Verify Applicability of
CPCB Registration for disposal).
 Copies of consent order /authorization order along with CC&A for which they have last
consent.
 C.A. Certificate for project (if SSI unit)
 Properly filled up Form: I as per Hazardous waste (M&H) amended Rules, 2003.
 Annual Report in Form-IV (in case of renewal application), with documents of disposal
complying Generation, Stock and Disposal justifying stock (Every Year by 31st January).
 Annual Report in Form 12 in case of recycler/ re-refiner of HW as covered in Schedule 4,
5 and 6 of HW Rules.
 Annual Report in Form 13 in case of Generator or Auctioneer of HW as covered in
Schedule 4, 5 and 6 of HW Rules.
 Form-V under Hazardous waste Rules-1989 in case of accident.
 Form-VI & Form-VII in case of important of Hazardous waste under Hazardous waste
Rules-1989.
 Photographs of Hazardous Waste Storage facilities.
 Undertaking should be checked as per amended Rules, 2003 – In case of non-applicability
of HW Rules.
 Details of step taken by the applicant for reduction and prevention in the waste generated
or for recycling or reuse (Copy of under taking for the same).
 Membership certificate of common TSDF /Common incinerator (if applicable)
 Details of HW as per 2003 amended rules or for all categories with Quantity, for
Reception (Reprocessor/ Re-cycler), Generation, Collection, Storage, Treatment (Details
of Method) and Disposal (Details of Method).
 Compliance of earlier authorization in case of renewal.
 Copy of CPCB registration or proof of application made to CPCB in case of recycler/ re-
refiner of HW as covered in Schedule 4, 5 and 6 of HW Rules.
 Copy of Inter State Transport NOC under Rule 7(6) in case of Selling/ receiving HW To/
From State other than Gujarat.
 Inspection Report in CPCB Performa in case of authorization for registration as recycler/
reprocessor.
 In Case of rejected application compliance of reasons of rejection.
 Form I of Environmental Clearance, if Environmental Clearance is applicable
 For ground water, central ground water authority permission, if in dark zone.
