FINAL EXAMINATION - TIMED ONLINE OPEN BOOK EXAMINATION
INSTRUCTIONS TO CANDIDATES AND RELEASE OF COMPULSORY PRE-SEEN
QUESTION

1. The duration for the Timed Online Open Book Examination (TOOBE) for this
module is 6 hours.
2. The question paper is divided into 3 Sections consisting of a total of 5
Questions.
3. Students are required to answer 3 questions, 1 from Section A, 1 from
Section B and 1 from Section C.
4. Section A consists of 1 essay question only. THIS QUESTION IS
COMPULSORY. This compulsory question:

a) Is set out herewith in Page 2 of this document for students to prepare 2


weeks in advance of the TOOBE for this module.
b) This question will be repeated in the TOOBE Question Paper on the
day of the TOOBE for this module.
c) Please note that your answer for this compulsory question:
i. must NOT simply be a descriptive account of the relevant law;
ii. must be in the nature of a critique of the relevant law. “Critique”
means a detailed analysis, evaluation and critique of the relevant
law;
iii. should be not more than 1,500 words.

5. Please note, the following:

a) Section B consists of 2 problem questions based on English Law. You


must answer 1 question from this section.
b) Section C consists of 2 problem questions based on Malaysian Law.
You must answer 1 question from this section.
c) For problem questions, you are expected to provide a detailed
identification of issues, understanding, application and analysis of the
relevant law to provide a solution to the problem posed.
d) Questions for Section B and C will only be released on the day of the
TOOBE for this module.
e) The word count for EACH answer in Section B and Section C should
not be more than 1,500 words.

6. Students are required to submit their answers for Section A, Section B a n d


S e c t i o n C on the day of the TOOBE for this module based on the General
Instructions on the TOOBEs given by the school.

SECTION A (COMPULSORY PRE-SEEN QUESTION)

Question 1

Promissory estoppel is considered to avail only as a defence without furnishing an


independent cause of action, or metaphorically: it can be used as a shield but not as
a sword.

Discuss, with reference to decided cases, the extent to which this view holds true.
