Sub : Notice prior to the filing of Execution Petition for the enforcement of Arbitration Award in the matter of
SBI CREDIT CARD No. 0004317575035930677

Sir/Madam,

Under instructions from our Client, SBI Card & Payment Services Ltd. (SBICPSL) incorporated under the Companies Act,
1956 having its Registered Office at Unit 401 & 402,4th Floor, Aggarwal Millennium Tower, E 1,2,3, Netaji Subhash Place,
Wazirpur, New Delhi – 110034, we hereby serve you with the following notice, the contents whereof you may please note:

1. A Credit Card bearing No. 0004317575035930677 vide A/c No. 0004317575031134233 was issued to you,
by our client afore-named, on the basis of your express representations and assurances that you would make
regular and timely repayments towards the expenditure incurred by you by utilizing the said credit card.
2. However, you have failed/avoided to make the payments of the amount due on the above-mentioned
credit card, despite regular monthly statement and numerous demands /reminders sent by our client in
this regard.
3. That you had been availing credit card facilities granted by our client subject to the terms and conditions of the
Cardholder Agreement, including an arbitration clause conferring exclusive rights upon our client to
appoint/nominate sole arbitrator to enter into & decide all disputes and difference between you and our client.
4. Since your credit card account continued to remain delinquent despite numerous requests and demands from our
client to make the outstanding payments and due to non-adherence to the terms & conditions of the afore
mentioned cardholder agreement, our client was constrained to initiate Arbitration Proceedings against you in
accordance with the provisions of the Arbitration & Conciliation Act, 1996 and consequently, an award has been
passed against you and in favor of our client by the Hon’ble Arbitral Tribunal of .Ms.Asha Dey on 43068, directing
you to pay an amount of Rs 121,487.44/- along with interest at the rate of 18 % per annum from the date of
initiation of arbitral proceedings till realization of the said amount.
5. That the award so passed by Hon’ble Arbitral Tribunal shall be executed against you to recover the amount as
awarded by the tribunal.
6. Now, since you had not challenged the award and that the statutory period for objection/appeal is already over,
our client has instructed us to take necessary steps for execution of the said arbitral award.
7. We hereby call upon you on behalf of our client, to make the payment as per the arbitral award within 7 days
from the receipt of this notice, failing which our client shall proceed with necessary legal action to execute the said
arbitral award and in such an eventuality, you shall be held liable for all costs and consequences arising thereof.
