SETTLEMENT AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

1. This agreement is executed by and between ROLLY C. RIOLA, of legal age,

widower, Filipino, with address at Port Area, Isabela City, Basilan, hereinafter
referred to as First Party and JAUKAL IMPUN IBRAHIM, of legal age, married,
Filipino, with address at Ulame, Lamitan City, Basilan, hereinafter referred to as
Second Party.

2. On November 11, 2020, around 10:00 am, the wife of the First Party was
involved in a vehicular accident along Valderoza St., Barangay Isabela City
Proper. The Second Party, while driving his top-down motorcycle WITHOUT
INTENT OR NEGLIGENCE, accidentally hit the wife of the First Party.

3. The Second Party immediately rushed the wife of the First Party to Juan S.
Alano Memorial Hospital. Unfortunately, the wife of the First Party died on the
same day at 3:30 in the afternoon.

4. In this agreement, the First Party admits, knows and believes that the Second
Party did not intend and was not negligent in the vehicular accident that
occurred. He also sees the innocence and sincerity of the Second Party in
assisting the former’s wife immediately upon the occurrence of the accident. As
such, the First Party sees no reason for instituting any complaint or action
against the Second Party.

5. The First Party only demanded that the Second Party pay the amount of
TWENTY-FIVE THOUSAND PESOS ONLY (P25,000.00) representing the costs
of the hospitalization and burial of the First Party’s wife. The Second Party
readily complied with the First Party’s demand and PAID the stipulated amount
in the Barangay Hall of Barangay Port Area, in the presence of two Barangay
Kagawads of the said Barangay.

6. The First Party promises the Second Party that he has no interest in filing any
complaint nor instituting any action, civil or criminal, against the Second Party as
the First Party is convinced that the incident above-described was a mere
unfortunate accident.
7. This agreement is executed in Isabela City, Basilan on November 18, 2020.
