Yes, I don't understand that at all. CJIS reviewed those Participation Options SEVERAL times before we finalized.

This is also why I want an update on NGI. Making it optional at the LEA level makes no sense if the States

already agreed to it at the APB level.

Marc (tho I know on leave) will need to be looped in as well. This might be a higher-level discussion to be held

during our face to face, which after this is a must-do, and when Marc is back in town. I'd request for Scott to be

there too - perhaps we need to meet half way.

Very disappointing. If CJIS comments on the language they won't be incorporated as it has already been

submitted as-is as a QFR. Please ensure Susan passes that along.

Rachel had me send CJIS what our response was to the Lofgren letter just as a FYI so they would be aware of

what ICE sent. Susan Penney was talking to (b)(6) (b)(7)(C) today and he told her to tell me that he would be

responding to my e-mail and providing edits even though I said no response required. He also went into a long

discussion with her where he apparently told her our participation language was wrong and that interoperability is

not mandatory that states are not required to send fingerprints to CJIS which is not what we said. I reminded both

of them that (b)(6) (... reviewed and edited our document before it was made final and he didn’t disagree with it then

so why is he disagreeing now.

He then went on to say that he was pushing for the LEAs to select if they wanted their fingerprints submitted to

ICE as an option in NGI where the states would allow them to have that type of option. Susan had a long discuss

with Rachel about the conversation with (b)(6)... and I was only there for a part of it but Rachel was very upset and

very concerned. We will need to talk when you get back.
