CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This Deed made and entered into by and between:

NIMFAH C. EVANGELISTA, of legal age, married, Filipino and a


resident of #261 Contreras St., Calvario, Meycauayan City, Bulacan hereinafter
referred to as the LESSOR;

and

APIPHA BISTON GAMOR, of legal age, married, Filipino and a


resident of #211 Llanillo St., Daungan, Meycauayan City, Bulacan, hereinafter
referred to as the LESSEE;

- WITNESSETH –

That the LESSOR is the absolute owner of a building premises located at #261 Contreras
St., Calvario, Meycauayan City, Bulacan

That the LESSOR hereby leases unto the LESSEE and the latter hereby accepts in lease
from the former of the said apartment under the following terms and conditions.

1. TERM – That the term of this Contract of Lease shall be five (5) years commencing on
January 2020 to December 2024.

The said lease may be renewed / extended as may be agreed upon by the parties on such
terms and conditions as may be mutually acceptable to both parties.

2. RENT – That the monthly rental shall be FIVE THOUSAND PESOS (P5,000.00)
payable every 30th day of each month. It is expressly agreed and understood that the
payment of the rental herein stipulated shall be made without the necessity of express
demand and without delay on any ground whatsoever.

3. ADVANCE RENTALS – That upon the signing of this contract the LESSEE shall pay to
the LESSOR one (1) month advance rental in the sum of FIVE THOUSAND PESOS
(P5,000.00) which amount shall be applied on the last term of the lease contract.

4. SECURITY DEPOSIT – That the LESSEE moreover upon signing of this contract shall
pay to the LESSOR a one (1) month security deposit in the sum of FIVE THOUSAND
PESOS (P5,000.00) which shall be non-intent bearing as guarantee for the faithful
compliance by LESSEE of all covenants and conditions of the contract.

Said security deposit cannot be applied by LESSEE to any current rental and shall be
kept intact throughout the life of this contract. It shall be returned to lessee only upon the
expiration of this Lease Contract after LESSEE shall have completely and satisfactorily
vacated and redelivered the Lease Premises to lessor, less whatever amounts LESSEE
owe LESSOR at the time of said termination or expiration of the term of this contract.

5. PERMITS AND LICENSES – LESSEE shall obtain at its own expense, permits and
license required by the Municipal and/or National Government for the construction of
Lessee’s desired improvements and the operation of its business.

LESSEE shall comply with any and all supplemental rules and regulations set own by
LESSOR and those which may hereafter be promulgated from time to time by LESSOR,
and all the laws ordinances, rules and regulations promulgated by the duly constituted
authorities of the National and/or Municipal Government regarding the use, occupancy,
security and sanitation of the Leased Premises: PROVIDED, that all works of temporary
character which may be ordained by the National and/or Municipal authorities to be
placed or done on the Leased Premises shall be for the account and expense of LESSEE.
6. UTILITIES – The LESSEE shall be responsible for the payment of the utility such as
electricity, water, telephone and other services used in or connected with the subject
premise that was lease to his/her.

7. SUBLEASE, TRANSFER OF RIGHTS – The LESSEE shall not directly or indirectly


sublease, assign, transfer, convey, mortgage or in any manner encumber his (its) right of
lease over the leased premises or any portion thereof under any circumstances whatsoever
without the written consent of the LESSOR and that any contract that may be made in
violation of this clause shall be null and void.

8. USE OF PREMISES – THE LESSEE hereby expressly agrees and warrants that the
leased premises shall be used by it exclusively for the following purpose to wit:
JEWELRY TRADING BUSINESS only and that said LESSEE is hereby strict prohibited
from using said premises for any other purpose or business without the prior written
consent of the LESSOR.

9. The LESSOR or its duly authorized representative shall the right to inspect the leased
premises at any reasonable hour of the day.

10. LESSEE hereby receives and accepts physical possession of the Leased Premises in
good, clean, sanitary and tenantable condition, ordinary wear and tear accepted and binds
his/her to keep and to take care of the Leased Premises with the diligence of a good
gather of the family keeping and maintaining the same in good, clean and sanitary and
tenantable condition.

11. REPAIR – Ordinary repairs as wells as extraordinary repairs caused by the fault or
negligence of the LESSEE or its officers, employees, customers or agents made in or
upon the Leased Premises and/or the equipments areas shall be for the account of
LESSEE.

12. TERMINATION OF THE LEASE – LESSEE agrees to return and surrender the Leased
Premises at the Termination of expiration of the term of this Lease in as good condition
as reasonable wear and tear with permit and without delay whatsoever, devoid of all
occupants, furniture, machinery equipments and signage, articles and effects of any kind.

13. PENAL PROVISIONS – that if the rental herein stipulated or any part thereof at any time
shall be in arrears or unpaid or if the lessee shall at any time fail or neglect to perform or
comply with any of the terms and conditions stipulated them in any of such above cases
this Lease Contract shall become automatically terminated and cancelled and said
premises shall be vacated peacefully by the lessee for the lessor to hold and enjoy and
henceforth as if these presents have not been made and it shall be lawful for the lessor or
any person or persons duly authorized in his behalf without any formal notice or demand
to enter into and upon said premises or any part thereof without prejudiced on the part of
the lessor to exercise any or all rights from the contract if lease and those given by law
and upon such cancellation of the contract the lessee hereby grants to the lessor the legal
right to enter and take possession of the lease premises as though the term of the lease
contract has expired.
