Sir/Madam:

Respectfully referred to your Office for inquest proceedings the records of the
investigation of the case of Rape defined and penalized under Article 266-A of the
Revised Penal Code, as amended by RA 8353- Anti Rape Law of 1976, committed on
or about 12:00 midnight of June 16, 2021, wherein persons being accused are:

1. John Paul Baluyot, 21 years old, college student, and presently residing
at 233 Gastambide St., Sampaloc, Manila; and

2. John Paul Arayat, 34 years old, married, unemployed and a resident of

Lot 1, Blk. 2, Barangay 141, Sampaloc, Manila.

(Both accused are under the custody of Sampaloc Police Station – PS-4,
were apprised of their rights under the Constitution, opted to remain silent,
and did not execute any affidavit)

Complainant/Victim:

Wynona Mendoza, 19 years of age, college student, and presently

residing at Kagandahan Dormitory, Legarda St., Barangay 410,
Sampaloc, Manila.

Facts of the Case:

A Rape incident transpired on or about 12:00 midnight of June 16, 2021 at

Kagandahan Dormitory, Legarda St., Barangay 410, Sampaloc, Manila City. The victim
was identified as Wynona Mendoza, female, single,19 years old, nursing student of
Arellano University-Legarda, and a resident of the above address who was found by her
roommate, Marie E. Tess, half-naked unconsciously lying on her bed wearing white t-
shirt without panty. With the assistance of responding officers of this Station, victim was
rushed at Mary Chiles General Hospital, Dalupan St., Sampaloc, Manila for immediate
medical attention. At around 1:00 a.m. of same date, Marie E. Tess was invited to this
office to provide statement regarding the incident.

At 1:30 a.m., PSMS Maria P Alad, duty investigator, proceeded at Mary Chiles
General Hospital to check the condition of the victim and to provide her statement.
Upon arrival thereof, victim was already conscious thus was able to provide her
statement.

Based on the victim’s account, at around 10:30 p.m. of June 15, 2021, she
invited four (4) persons, three (3) male and one (1) female, in her dormitory. These
persons she identified as: (1) Yuda Wan, female, 19 years old, college student and
presently a resident of 5 th St., Concepcion Aguila, Mendiola, Manila, (2) Vincent Zo, 20
years old, college student and presently a resident of General Tinio, Caloocan City, (3)
John Paul Baluyut, 21 years old, college student and presently a resident of 233
Gastambide St., Sampaloc, Manila, and (4) one John Paul Arayat, whose
circumstances are unknown to her.

She narrated that when these four persons arrived at her dormitory on or about
11 p.m., her roommate, Marie E. Tess was still there. She invited her to join them in
their drinking spree but the latter refused as she claimed to be meeting another friend
nearby. After Marie E. Tess left, she and four (4) others started to drink Alfonso Brandy.
At around 11:30 p.m., Yuda Wan and Vincent Zo left, so that only she and two others,
she identified as John Baluyut and a certain John Paul Arayat stayed inside their room
and continued drinking. Further inquiry disclosed that she felt drunk and before losing
her consciousness, she remembered John Paul Baluyut forcing his penis into her
mouth. She tried to resist and shout for help but the two strongly hold her hands and
shut her up by putting their hands into her mouth. After a while, she became exhausted
and hence allowed them to consummate their sexual desires. When she woke up, she
was already in a hospital feeling pain in her vaginal part.

Victim was subjected for Genital Examination at PNP Crime Laboratory Office,
Camp Crame, Quezon City which yielded positive results for Rape. Further, it also
yielded presence of semen conclusive of sexual intercourse.

Follow-up operation was conducted by elements of this station resulted to the

arrest of both accused on June 16, 2021. The complainant, her witnesses and arresting
officers executed their respective affidavits on the same date.

This case will be presented by PSMS Maria P Alad of this Office during the
course of inquest proceedings.

Further, request furnish this Office copy of your resolution thereof and other
proceedings for reference.
