1. Ako ang respondent sa criminal case no. 3435, nga gi file nila ni PSSG
CRISTITO V. ARESCO, PAT GYPSY N. MIRO, and PAT JERAMIE C.
MALANG, kuno sa paglapas sa P.D. 1602, kag naga sumiter ako sa akong
affidavit. (I am the respondent in criminal case no. 3435, filed by PSSG
CRISTITO V. ARESCO, PAT GYPSY N. MIRO, and PAT JERAMIE C.
MALANG, for the alleged violation of P.D. 1602, and I am submitting this
Judicial Affidavit in support of my Motion to Quash the Information and
dismiss the case.
ANSWER AND DEFENSES TO THE
ALLEGATIONS OF THE COMPLAINT
2. Wala ako nakalapas sa illegal nga pagsugal sa ilaang gipasaka nga
sumbong batok nako niadtong petsa 9 sa May 2021, mga alas 2:30 ang
takna sa kahaponon, Sitio Kimod, Brgy. Bongdo Proper, Municipality of
Borbon, Province of Cebu, Philippines, adlaw nga Dominggo, nga gitumo-
tumo nga nay sabong (I did not violate the law on illegal gambling on the
9th day of May 2021, at around 2:30 in the afternoon, at Sitio Kimod, Brgy.
Bongdo Proper, Municipality of Borbon, Province of Cebu, Philippines, to
conduct cockfighting in Sitio Quimod, Bongdo Proepr, Borbon, Cebu.)
A. In the present case the prosecution asserts that the warrantless arrest of
the accused was the result of a validly conduct buy-bust operation. They
likewise claimed that the arrest was performed after the accused has bee
informed of his constitutional rights.
B. Contrary to the claim of the arresting officers that the warrantless arrest
was the result of a valid buy0bust operation, no actual buy-bust did in
fact ake place. As stated by the accused in his Judicial Affidavit, the police
broke into his house
