When this Case was called, Assistant City Prosecutor Attorney Joselito, for the state and
defense counsel, Attorney Meca appeared.
Private complainant authorized representative Edmare Taluco and accused Petra Petro
Cola, are also present.
The court note the presence of Leona Cola the mother of accused Petra Petro Cola who
manifested that her daughter is currently working that is why he is absent today’s hearing is
supposedly the arraignment and pre - trial conference of the instant case. But the parties have
already reach attend an amicable settlement through the assistant mediator, Mr. Rico Rosales of
the Philippines mediation Center, Region 7. On May 31, 2021, the court received a copy of the
parties’ compromise agreement. Considering the parties compromise is not contrary, moral,
good, custom, public order or public policies, the court APPROVED the same on June 01, 2021.
But since is only affect the civil aspect of the instant case. Defense counsel, Atty. Jesa Meca
moved for the dismissal of the criminal aspect of the case as well.
Assistant City prosecutor, Atty. Joselito manifested that the prosecution only agreed to the
provisionally dismissal of the instant case, with respect to Petra Petro Cola only, because the
accused is absent. Wherefore for lack of interest of the private complainant to prosecute the
instant case and with the manifestation of the public prosecutor the case against accused Petra
Petro cola docketed at M-Ceb-20-14906 CR for violation of Batas Pambansa Bilang 22, is
hereby ordered PROVISIONALLY DISMISSED, With the express consent of the accused
Petra Petro Cola, at evidence by signature on the lower right hand portion of the information.
For accused Petra Petro Cola, served this case for pre- trial arraignment on June 17, at
2:00 o’clock in the afternoon.
The parties and counsel court are notified in open court.

When this case was called for the arraignment of the accused and pre-trial
conference, Assistant City Prosecutor Atty. Joselito, for the state and defense counsel,
Atty. Meca, appeared.
Accused Petro Petra Cola and the arresting officer____ are also present. The two
accused_______ and_____ are, however, absent despite due notice.
Considering that the accused _______ is not represented by a counsel, the court
appointed, Attorney _________ of the public Attorney’s office, at counsel de ofecio.
Upon personal evaluation of the documentary evidence presented by the
prosecution, without necessarily declaring the guilt of the accused, the court find
probable caused to hold the accused for trial.
When arraign, the accused was read of the information stating the charges
against him Petra Petro Cola for violation of Section 01, OF PD 1602 if a language
_________ and understood by her, and by at apply to enter her plea, with the
assistance of attorney _________, said accused personally, he did not guilty to the
said crime.
Let the plea of NOT GUILTY of accused Petra Petro Cola be entered in the
certificate of arraignment.
Attorney__________ thereafter moved for the resetting of the pre-trial
conference. Assistant City Prosecutor_______ Enter post no objection there to. But he
moved for the issuance of the bench warrant of arrest against accuse _________ and
_____.
Accordingly, reset the pre-trial conference thru July 3 at 2 o’clock in the
afternoon.
Issue a bench warrant of a rest against accused________ and _________.
The bond for the provisional liberty of the accused is PICK at five hundred pesos
(500) accused Petra Petro Cola and counsel on records are notify in open court.

When this case was called, Assistant City Prosecutor Atty. Jose Lito, for the state, Atty.
Joy Maine Legaspi for the private complainant and defense counsel, Atty. Jessa Mesa, appeared
Atty. Joy Maine Legaspi manifested early today she filed a motion to withdraw at counsel with
the conformity of this trial.

Today’s hearing is supposedly the initial presentation of defense witness Atty. Jessa
Meca manifested that the parties have already settled. He then moved for the resetting of today’s
hearing, for the private complainant to submit her affidavit of desistance. The prosecution joined
with said motion for the resetting.

ACCORDINGLY reset today’s hearing to June 29, 2021 at 2 : 00 o’ clock in the


afternoon.

The parties and the counsel on record are notified in open court.

When these cases were called , Assistant City Prosecutor Atty. Jose Lito, for the
state and defense counsel, Atty. Jessa Meca, appeared.

Private complainant Risa Veloces and Petra Petro Cola are present.

Today’s hearing is supposedly the pre- trial conference. But the parties have already
reached an amicable settlement thru the assistance of Mediator Mr. Rico Rosales, of the
Philippine Mediation Center, Region 7.

On May 27, 2021, a copy of the parties compromise agreement was submitted to the
court. The same defined their respective rights and obligation, and prayed for the court’s
approval of the same.

Considering that the parties compromise agreement if not contrary to law, moral,
good custom, private public 0rder or public policy, the court approved the same under
order dated May 28, 2021,

But since if only affect the legal aspects of the instant cases, defense counsel, Atty.
Jessa Meca move for the DISSMISAL of the criminal aspect as well. Assistance City
Prosecutor Jose Lito, interposed no objection thereto. But manifested that the prosecution
and the private complainant only agreed to the PROVISIONAL DISSMISAL of the instant
cases.

Upon searching question accused confirm that they consent to the provisional
dismissal of the instant cases. They manifested that they were made aware of and
understood the consequences thereof and are still willing to have the instant cases
provisionally dismissed. Private complainant on the other hand, reiterated their lack of
interest to pursue the instant cases against the accused. CRIM. CASE NO. M – CEB – 19 –
04041, M- CEB – 19 – 04 043 M – CEB – 19 – 04043 are hereby PROVISIONALLY
DISSMISED with express consent of the accused as evidence by their signature at the
lower right hand portion of the of the three information.

The parties and counsel on record are notified in open court. Let copies of this order
be furnished to the parties and the counsels.

SO ORDERED.
