Rule of Beneficial Interpretation :-

1). Also called as Mischief rule/Hayden rule/ Purposive Interpretation.

Applicability :-

1). On failure of Literal Interpretation.

2). Words used in statue are ambiguous.

3). Words are capable of more than 1 meaning.

Following 4 matters shall be considered while making interpretation under this rule :-

1). What was old law before making of new act.

2). What was mischief in the earlier law.

3). What is the remedy that the new law has provided.

4). What is the reason for providing the new remedy.

Intention of Beneficial construction :-

1). Suppression of mischief.

2). Advance the remedy.

Non applicability :-

1). If literal interpretation is possible.

2). Meaning is absurd.

3). Fiscal or tax laws. Example: Income tax act.
