WHEREAS,as part of the national government's thrust to provide quality,

essential, affordable and accessible healthcare services, the Department of Health
{DOH) reyjyed the Df)tika no Dayan (DnD) Program in order to further enhance the.
delivery of medical servicesto all Filipinos;

WHEREAS,the Botika ng Bayan Program will provide free access to essential

medicines for common diseases in the community targeting indigents and the
margjnal1zedsectors of the popuJam;

WHEREAS,the Botika ng Bayan Program would make available effective and

affordable medicines to the senior citizens and Philhealth cardholders and their
beneficiaries under the Partner Pharmacy Scheme;

WHEREAS,it behooves upon this Sanggunian to promulgate a measure that

would guarantee the smooth/efficient implementation of the Botika ng Bayan Program
in the city of General Santos;

AN ORDINANCE INSTITUTIONALIZING THE BOTIKA NG BAYAN (BNB) PROGRAM

WITHIN THE RURALHEALTH UNITS OF GENERALSANTOSCITY, PROVIDING FUNDS
THEREFORAND FOROTHERPURPOSES

Be it enacted by the SangguniangPanlungsod of GeneralSantos City that·

Section 1. Short Tit/e. - This ordinance shall be known as "The Botika ng Bayan
Ordinance of General Santos City.JJ

Section 2. Declaration of PO/icy.- The State shall protect and promote the right
to health of the people and instill health consciousness among them. Towards this end,
the State shall provide adequate social services and endeavor to make essential goods,
health and other sociat services avallable to every Rural Health Unit at affordabfe cost.

Section 3. Objectives. - This ordinance has the following objectives:

a) To promote equity in health by ensuring the availability and accessibility of

atfordable, safe and-effective, quality essential d-rugsto all",with priority fur
marginalized, underserved, critical and hard to reach areas;

b) To integrate all related issuances of the DOH that provide rules and
regulations in the establishment and operations of the BnB; and

c) To define the roles and responsibilities of the different units of the DOH and
other partners from the different sectors in facilitating and regulating the
establishment of the BnB.

terms are defined:

a) Botika ng Bayan (BnB) - refers to a drug outlet managed by the Department

of Health (DOH) and the Local Government Unit (LGU)

b) Botika ng Bayan Aide - refers to a trained person in charge in dispensing the

medicine at the Botika ng Bayan under the direction of the Department of
Health.

of the Philippine National Drug Policy, aimed at making available and
accessible, essential medicines of proven efficacy, safety and quality at
affordable cost.

those drugs included in the "core list" of the Philippine National Drug Formulary, and
the names thereof listed in their respective generic and trade names made available to
the public.

 Section 6. The Botika ng 8ayan Pharmacist shall be responsible in the overall
operation of the 80tika ng 8ayan.

Section 7. Implementing Rules and Regulations. - The City Health Office shall
issue the necessary rules and guidelines as may be needed to fully implement the
provisions of this Ordinance. In addition, the Department of Health, thru the City
Health Office, shall also embark on a sustained promotional campaign to increase the

Section 8. Funding. - The City Government shall allocate funds for the
establishment and operation of the Botika ng 8ayan Program in the Rural Health Units

Section 9. Repealing Clause. - All previous ordinances and provisions
inconsistent with this ordinance are hereby repealed or modified accordingly.

ordinance shall be held unconstitutional or invalid, other parts or provisions hereof
which are not affected thereby shall continue to be in full force and effect.

Section 11. Effectivity. - This ordinance shall take effect fifteen (15) days after
its publication in a newspaper of general circulation within General Santos City.

Enacted by the 19th Sangguniang Panlungsod, City of General Santos, on its 2ih
Regular Sessionheld on March 10, 2020.
