Narrative On Saturday, October 18, 2003, a 2341 Hours, Officers N. Alexander, G.C. Gothner, 8. Esler, A. Poskozim, and | were assigned to Investigate a report of a man battering a women In the Super One Foods parking lot, 1515 Oakes Avenue. Officers were unable to locate any persons involved in a disturbance in the Super One parking lot upon arcval. Officers began checking the surrounding area. [A short time later, | was assigned to investigate a male and female isturbance on the 1200 block of Tower Avenue. Upon arival, two pedestrians waved me dawn and began pointing at an adult male, adult female, and a young female child approximately five years old. The pedestrians told me the male was hitting the female. 1 approached the three subjects on the 1700 block of N. 12th Street | pulled my marked patrol squad up next to the three subjects who were walking East on N. 12th Street. The male subject was yeling, and screaming atthe female subject. The female subject was holding, the hand ofthe young cil. As! exited my squad, the male subject, later identified as John Derrick Thompson 11/02/71 (31), quickly began to walk away from me. | Instructed Mr. Thompson to stop. Poskozim and B. Esler turned Northbound ‘onto Ogden Avenue from N. 12th Stret in a Marked squad. Officers Pskouim and Esler hada visual on Mr. Thompson so I turned around ‘and went to make contact with the female and child made contact with the female, later identified as ane her young child on the 1200 block of Ogden ‘avenue, id not wish to speak with me and attempted to push her way past me. Olson / 3336 ‘Superior Police Department Supplement Number: 2 SUPPLEMENTAL: ON SUNDAY, 10-19-03, t about 2345 hours, Officer James Olson, Officer Gary Gothner, Officer Brad Esler, Officer Adam Poskozim and Sgt. Nicholas Alexander, responded to Super One Foods ‘on the report of a man beating @ woman in the parking lot. ‘No one fighting was observed. Officer Esler and Officer Poskorim did observe a black male, black female, and a small chillin the ares. The intial call did not mention a child being Present so no contact was made with these people. ‘A short time later Officer Olson was dispatched 10 the 1200 block of Tower Avenue on the report of @ male and female disturbance. As Officer Olson arrived pedestrians pointed to to the black male, black female, and child and sai that the male hag been beating on the female Officer Olson made contact withthe three. They were later identified a Jang John Derrick ‘Thompson. The child was not identified becaus Would not give lus her name. The B/F child appeared to be about 4 orS years old ‘Thompson fled on foot as soon as Officer Olson ‘made contact. Officer Olson called out the foot pursuit. Officer ‘Adam Poskozim and Officer Brad Esler assisted inthe chase. officer ‘Adam Poskozim caught up with Thomason and took him into custody. ‘Thompson resisted arrest and made mention to a gun. Nicholas Alexander/3243 Supplement Number: 3 SUPPLEMENTAL REPORT TO IR # 03-20374 (0n 10/18/03 at about 23:45 Officer Esler and 1 responded to a report ofa man beating a woman at Super One foods. ‘We arrived and saw only one couple in the parking lot of NorthWest ‘Outlet. It wasa black male and black female, but they had a small child with them. The RP did not describe a child, and we continued ‘9 lookin the area. The couple left and we did not make contact with them short time later, Officer Olson was dispatched ‘to the 1200 block of Tower for the same couple. Officer Esler and were not far away and responded to assist. Officer Olson continued to give directions ‘om the radio, saying the suspect was inthe car lot. ‘exited the vehicle and pursued the suspect on foot while Officer Esler attempted to cut him off inthe squad ca, |was shouting "Stop Running! Police Officer! Get on the ground ‘The black male, later ID'ed as John Thompson, kept cunning. Thompson was also the same man Officer Esler and | observed atthe NorthWest, Outlet ot. l observed this male the entre time, from when we saw Officer Olson chasing him until he was placed into a squad car. | chased Thompson through the alley, then East ‘through 2 yard to John Ave where Officer Esler was withthe squad car. Thompson then ran on the South side of 1020 John. I wat stil shouting commands. Thompson would lok behind him at me, but did not comply ‘Thompson was wearing loose fitting jeans and no belt. His pants slid down to one knee, causing him to pitch head first onto the cement sidewalk. He did not appear to be able to break his fll because both hand were down by his pants trying to hold them up. t shouted "Police! Stay on the ground". Thompson did not comply and tried to get up and keep running ran tothe right side of Thompson and tried to Push him back tothe ground. He shouted something like "The ‘motherfucker had a gun" or "ve got a motherfucking gu trying to controt his hands to prevent him from accessing a weapon, but Iwas not able to control hs eft hand. ordered Thompson to put his hands behind his back and stop resisting. He did not comply and | administered a short burst of OC spray to his face. Ido not know ifthe burst was effective, he did not show any effects, thad to let go af his hand 10 do this, As Thompson was trying to get up, he dragged me ‘on the cement on my right knee. This caused my pants to tear and my knee suffered abrasions ‘Thompson was not complying with commands and was stil resisting. | did not have my back up officer on scene yet. My hand made contact with his head, butit was nota strike. | pulled his arm, but he ‘would not bring it behind him. | administered several strikes to his ‘ight shoulder and bicep, in an attempt to force his elbow down so ould use leverage to pull the arm back. None of the strikes connected with his head or neck. Officer Esler arrived and tried to control the leftatm. | told Officer Esler that Thompson had mentioned a gun, ‘When Thompson would sil not bring his am back, | prepared to. administer knee strikes. Thompson suddenly brought both arms back behind his back. Officer Esler handcuffed the suspect, checked for fit and double locked them. | radioed we had the suspect in custody ‘The neighbor woman tothe South came out her back door to see what the disturbance was. She had heard us shouting for Thompson to stop resisting and to put his hands behind his back. she ‘went backinto the house and we did nat get her name, and due to the late time, we did not return after the incident, Officer Gary Gothner arrived and assisted us in helping Thompson to his feet. | asked ifhe was injured, if he wanted medical attention. He said he was not hurt, he was going to fucking kil us, and he was home so we could not arrest him. He also accused Officer Gothner of beating him 10 oF 15 times. Thompson now sald he did not know anything about a gun, Officer Gothner transported Thompson, During the ares, | did not realize Thompson had pulled one of my handgun magazines of my belt. | recovered thet and ‘my OC spray in the leaves. We back tracked the route Thompson ran vo see if he threw a handgun. We did not locate any weagons We retumed tothe scene and spoke with Officer Olson and Sgt Alexander. | notified Sgt Alexander of my damaged Uniform and injured knee. | also had twisted my right wrist. | did not give Thompson permission to injure me or damage my property Officer Poskozim #3363, Supplement Number: 4 SUPPLEMENTAL REPORT: "assisted Officer Olson withthe arrest of THOMPSON. Officer Olson radioed that a suspect in a domestic abuse complaint was fleeing from him Northbound on Ogden AVE from approx. N 12th ST. Officer Poskorim and | responded from Hammond AVE and N 12th ST in cruiser #07, ‘At Ogden AVE we saw Officer Olson. He radioed that the suspect was ‘unning Northbound on Ogden AVE, then radioed that he was running East through the car lot at N 12th ST. |saw the man as he ran East. My emergency lights were activated, and! saw the man look back at my cruiser ashe fled. He ran East towards ohn AVE. in the 1000 block ofthe Ogden / John alleyway 1 {dropped off Officer Poskozim. He ran directly behind the suspect, 1 ‘ent North inthe alleyway, then South on John AVE. | saw the man ‘ross John Eastbound mid-block. | parked on John AVE, radioed our location and ran behind Officer Poskozim. | could hear Officer Poskozim clearly shouting at the suspe “Police! Stay on the ground!". He shouted this before he even ‘eached the suspect. | ran up and found Officer Poskozim struggling “withthe large man. The suspect, later identified as THOMPSON, had his hands up near his head. He was trying to getinto a pull up position so he could get upto flee or fight. kneeled to THOMPSON'S left while Officer Poskozim was on his ight. Officer Poskozim clearly shouted at THOMPSON to stop resisting and to put his hands behind his back. THOMPSON refused and profanely threatened to Killus. | managed to get his let arm behind his back. Officer Poskozim then got the right hand back, and | handeuffed the man. ‘oublelocked the cuffs and checked them for tightness. Officer Poskozim radioed that we had the suspect In custody. | called fora transport cruiser and gave our location. Officer Gary Gothner arived and escorted the man to his cruser. He searched him and had him stn the car. The man loudly claimed thet Officer Gothner hit him in the head many times. THOMPSON was well aware that we were police officers from the start Of this incident.
