SUBJECT : Investigation Report RE: Death of PDL JUBAY, DARWIN y SALDE

MATTERS INVESTIGATED

1) The surrounding facts and circumstances regarding the death of PDL Jubay, Darwin
y Salde.
2) To determine if there was foul play involved and evidences for filing of appropriate
charges of liable person if any.

FACTS OF THE CASE

Facts of the case are as follows:


That on or about 2056H 25 October 2019, PDL Jubay, Darwin y Salde, 33 years
old, single and a resident of Asturias CEBU, PHILIPPINES, who was committed herein
last 29 May 2017 for Violation of section 11 of RA 9165 and PD 1602 docketed under
criminal case no. DU-31132; DU-31126 pending before RTC Branch 83 and RTC
Branch 84, Mandaue City, was rushed to Mandaue City District Hospital with complaint
of difficulty in breathing. He was seen by Dr. Marie Antoinette Alcantara attending
physician but unfortunately at around 2140H in the evening of 25 October 2019, said
PDL was pronounced dead on arrival (DOA) at the said hospital. (Copy of the Spot
Report dated 25 October 2019 hereto attached as Annex “A”)

Certificate of death dated 25 October 2019 duly signed by DR. Antoinette S. T.


Alcantara M D revealed that the death of PDL Jubay, Darwin y Salde occurred at around
2140H, further certified that the immediate cause 0f death was due to “ISHEMIC
CARDIOMYOPATHY “. (Copy of the certificate of death dated 25 October 2019
hereto attached as annex “B”}.

Health Service Referral Slip dated 25 October 2019 issued and signed by SJO3
Joel Canaveral RN, Jail Nurse, revealed that PDL Jubay, Darwin y Salde was referred to
the Mandaue City District Hospital with complaint of difficulty in breathing. Initial
treatment was given to said PDL but unfortunately, he was declared (DOA), dead on
arrival. (Copy of Health Service Referral Slip dated 25 October 2019 hereto attached as
annex “C”)
Sworn statement of PDL Brayan Jugan dated 31 October 2019 stated among
others that he was the cell mayor wherein the late Jubay, Darwin y Salde was confined,
that he knew personally said PDL who faced charges for violation of section 11, Art II of
RA 9165 and PD 1602, that said PDL was transferred from the other cell to their cell at
TC 1, that according to him at around 03:00 o’clock in the afternoon, said PDL was
already pale and very weak and could not even move his body, that prompted him to call
for the assistance of the duty nurse to attend to the situation of Jubay, Darwin y Salde,
that according to PDL Brayan, PDL Jubay, Darwin y Salde was always complaining of
pain on his chest. Further stated, that said PDL was suffering from chest pain and
difficulty in breathing while inside their cell. That according to PDL Brayan, said PDL
was not involved in any fight or altercation between any other PDL in their cell before.

annex “D”)

Sworn Statement of JO1 Ruel Cimacon dated 31 October 2019 stated among
others that on 25 October 2019, he reported to Mandaue City Jail- Male Dorm to render
duty, that at around 09:00 o’clock in the evening of 11 August 2019, he was instructed to
escort PDL Jubay, Darwin y Salde to Mandaue City District Hospital, that at around
12:37 in the afternoon, on board the ACERT ambulance the said PDL was brought to
Mandaue City District Hospital, that while on transit, ACERT personnel conducted CPR
to the said PDL and continually monitored his breathing and BP, that they arrived at the
hospital and immediately, said PDL was assessed by the ER staff, that medical
intervention were made to revive the PDL but unfortunately at around 2140H, said PDL
was declared dead on arrival by his attending physician. Further stated that immediately
thereafter he informed the jail about the death of said PDL; (Sworn Statement of JO1
Ruel J. Cimacon dated 31 October 2019 hereto attached as annex “E”)

Sworn Statement of J01 Milky Manasis dated 31 October 2019 stated among
others that on 25 October 2019 he assumed post at Mandaue City Jail- Male Dormitory as
duty jail nurse, that at about 03:00 o’clock in the afternoon of same day, he attended to
one PDL in the person of Jubay, Darwin y Salde who experienced difficulty of breathing,
that according to him, upon assessment PDLs’ blood pressure, respiratory rate, pulse rate
as well as his temperature were not normal and needed further medical intervention, that
he informed the Deputy Warden SJO4 NEAL ROSAROSO regarding the situation of the
said PDL, that according to him, on or about 09:07 o’clock in the evening ACERT team
arrived and assessed the PDL and ACERT team recommended that the said PDL be
brought to the nearest hospital. (Sworn Statement of JO1 Milky Manasis dated 31
October 2019 hereto attached as annex “F”)

DISCUSSION

From the facts afore stated, it is crystal clear and the herein investigator is
convinced that the cause of death of Jubay, Darwin y Salde was due to his illness. Sworn
statements of PDL Jugan, Brayan which is hereto attached as annex “D” would attest that
the late PDL Jubay, Darwin y Salde suffered from chest pain and difficulty in breathing
unconscious after collapsing while watching TV inside their cell. According to him, prior
to the time when PDL Jubay, Darwin y Salde was brought to the hospital, PDL Jubay,
Darwin y Salde was already very weak and suffered pain in his chest. According to JO1
Cimacon in his sworn statement hereto attached as annex E, that while on transit, the
ACERT personnel conducted Cardio- Pulmonary Resuscitation (CPR) to the PDL.
Moreover, at the hospital, immediate medical intervention was made to revive the life of
the said PDL but unfortunately, the attending physician pronounced the PDL Dead on
Arrival. Kind of illness and the cause of death of the PDL was due to “ISHEMIC
CARDIOMYPATHY” as determined in the death certificate.

CONCLUSION

Wherefore, premises considered, the investigation of the case at hand is hereby


Dropped and Closed. The investigation determined that the cause of DEATH of the late
PDL Jubay, Darwin y Salde was due to his illness. No other person liable and
absolutely no foul play involved.

RECOMMENDATION

1) This case be hereby DROPPED AND CLOSED.


2) Let a copy of the Investigation Report be furnished to the C, RIPD.
