Case No. 2:- Event wise detail of Civil suit no.

CS/893/2018 regarding deliberately delay

in releasing of Arrears etc as under:-

1. That I submitted my application in the office of XEN City (OP) Division, Rohtak for
granting one annual general increment (AGI) and 3 rd ACP in the month of July 2014 and
I again written a letter to the XEN City (OP) Division, UHBNVL, Rohtak for granting of
3rd ACP along with required undertaking vide memo no. 822/HC RTK dated 28/11/14
(Photocopy of the same attached for ready reference as Annexure P8 and P9).
2. When I visited the office of XEN City (OP) Division, Rohtak account branch for
submission of undertaking for drawl of arrears of pay due to implementation of 7 th pay
commission on 15/6/2017. (Photocopy of undertaking attached for ready reference as
Annexure P10). I was shocked to see the salary statement for the year 2014-2015, 2015-
2016, 2016-2017, 2017-2018, I was astonished to see that I was being paid my basic pay
at the same basic pay of Rs 20340/- (9/2014) and I have not given my annual increment
since 9/2014 to 3/2018.(Photocopy of tentative salary statements of the year 2014-2015,
2015-2016, 2016-2017, 2017-2018 are attached for perusal as Annexure P11). I requested
personally Sh. Rajesh Rohilla D/Accountant to grant me my annual increment along with
arrears and payment of arrears of Pay fixation of 7th Pay commission. It is not out of place
to mention here that a certificate of basic pay issued by the XEN City (OP) Division,
Rohtak on dated 6/3/2018 showing Basic Pay Rs 72100/- per month but even then my
salary was being disbursed at basic of 9/2014( Rs 20340) i.e Rs 44270/- as total salary of
March 2018 paid on 3/4/2018 in my salary account of OBC Bank (Photocopy of salary
certificate date 6/3/18 and photocopy of OBC bank passbook showing salary are attached
for ready reference as Annexure P12 and P13). Sh. Rajesh Rohilla D/Accountant was
approached a number of times through official of union representatives and other account
officer of the Nigam for releasing the arrears but no heed was paid to my genuine
requests.
3. After all my efforts failed, I was compelled by Sh. Rajesh Rohilla D/Accountant to serve
a legal notice by his name at S. No. 5 of legal notice along with S.No.1 to S.No.4 as
procedural compulsion of the court cases through my council Sh. Harish C.Sikkri
Advocate on 9/4/2018 (Photocopy of legal notice attached as Annexure P14).
4. In spite of this, a letter was sent to me through Medical officer UHBVNL Health Centre,
Rohtak vide letter no. memo Ch 228/PF136 dated 24/4/2018 directing me to submit an
affidavit duly attested by the Executive Magistrate for releasing the arrears of 7 th pay
commission. It is not out of place to mention here that this affidavit was demanded by the
office of XEN City (OP) Division, Rohtak only form me but no other official of the
whole City Division, Rohtak was demanded such an affidavit/undertaking, as per Nigam
instructions only undertaking demanded from all strength of staff of City (OP) Division,
Rohtak (Photocopy of Ch 228/PF136 attached for ready reference as Annexure P15). The
same letter was replied by me on 13/5/2018 through Medical Officer, UHBVNL Health
 Centre, Rohtak vide Endst No. 1937 dated 13/5/2018 (Photocopy of the same attached for
ready reference as Annexure P16).
5. After this, a amount of Rs 350069/- was deposited in my old salary account of SBI Model
Town Rohtak without letting me even the deposit of cheque of arrears was not informed
me and just to harass me deliberately by delaying the payment of dues of Annual
increment arrears for 1391 days (Almost 4 years) and payment of dues of the 7 th pay
commission delayed for 330 days (11 months) i.e 21/7/14 to 14/5/18 ( for Annual
increment), June 2017 to 14/5/2018 (for 7th pay commission arrears). (Photocopy of Old
salary account of SBI passbook attached for ready reference as Annexure P17).
6. A letter was written to the XEN City (OP) Division, Rohtak by my council Sh. Harish
C.Sikkri Advocate on 20/7/2018 for seeking the information regarding deposit of arrears
and details thereof. (Photocopy of the same attached for ready reference as Annexure
P18).
7. A letter no 237/PF 136 dated 1/8/18 along with details of arrears and deduction of
Income Tax given to my council in 2nd week of Aug. 2018 by representative of the XEN
City (OP) Division. Total arrears Rs 439785/- and accumulated Income Tax of Rs
89716/- was deducted only to harass me which was got refunded from the Income Tax
Deptt. by hiring the CA later on (Photocopy of Ch no.237/PF136 dated 1/8/2018 attached
for ready reference as Annexure P19).
8. It is not of place to bring to the notice of your kind office that all the
employees/pensioners got their arrears of 7th pay commission in the month of June 2017
but I was deliberately harassed & not paid my arrears, the reason best known to the
D/Accountant. Thereby a amount of Rs 439785/- was not paid to me for Eleven months.
That is why I was again compelled to file a civil suit against Sh. Rajesh Rohilla for
harassment and claiming of interest of delayed payment for Eleven months.
