PNP – AVSEU 10 Headquarters in Laguindingan Airport

Dear PCol Valones,

The Authority writes in relation to the referenced subject and the request for an expedited
approval of the Memorandum of Agreement (MOA) for the use of land within the
Laguindingan Airport for the construction of the Philippine National Police PNP-Aviation
Security Unit 10 Headquarters (PNP – AVSEU 10).

We respectfully apprise that prior to our receipt of your endorsed letter from the Office of the
President – Presidential Management Staff requesting this Authority to expedite the approval
of the MOA, we had received a similar request from C/SUPT Joel S Orduña, Director of PNP
– Aviation Security Group (PNP – AVSEGROUP), for an institutional MOA between PNP
and CAAP.

The institutional MOA provides for the establishment of PNP – AVSEGROUP


headquarters/facilities in various airports controlled by CAAP, which includes Laguindingan
Airport. Relative to this request, PNP – AVSEGROUP provided a draft MOA for the
institutional establishment of the headquarters/facilities.

However, upon review thereof, we recommended that a provision be removed from the
MOA. The provision states that in the event of relocation of the constructed
headquarters/facilities, CAAP shall reimburse the cost of transfer and replication of the
facilities affected thereby. We recommended the removal of this pursuant to the fact that
relocation of any edifice on airport premises shall always be subjected to an assumed risk
pursuant to the need to improve, expand, and/or develop the same.1

There were several meetings conducted with PNP – AVSEGROUP to discuss and agree for
the abovestated recommendation; however, the parties have yet to reach consensus on the
matter.

In relation to the referenced proposed MOA, we also provide for the same recommendation,
among others. In addition, the proposed site by PNP – AVSEU 10 was not recommended by
the Aerodrome Development & Management Service (ADMS) of this Authority, as the
orientation of the proposed site is not perpendicular or parallel to the orientation of the
runway and surrounding roads. Hence, ADMS studied and identified another location for the
PNP – AVSEU 10 headquarters.2

In view of the foregoing, we respectfully inform that pending the approval of the institutional
MOA between this Authority and PNP – AVSEGROUP, the referenced proposed MOA was
revised to reflect the following recommendations:

a. The location identified by ADMS be reflected in the proposed


MOA;

b. The cost of transfer and replication of the affected


headquarter/facilities of PNP – AVSEU 10 due to airport
improvement, expansion and/or development shall be borne by
PNP – AVSEU 10;

c. Additionally, to include a provision for the immediate reporting


and coordination of PNP AVSEU 10 with the Airport Manager or
Airport Duty Officer of cases of interview, apprehension, and/or
detention of airport personnel.

We formally transmit herewith a copy of the revised MOA which reflects the
abovementioned recommendations for your review and approval.

The execution and implementation of the revised MOA was subject for approval by the
Board of Directors (Board).3 Accordingly, it has been endorsed and presented to the Board
during the 66th Board of Directors’ Meeting held on 02 September 2019.

Pursuant to the Meeting, however, the Board required the following information for further
evaluation:

a. More detailed purpose/s and/or development plan/s of PNP-


AVSEGROUP must be stated, aside from the items which are
mentioned, considering the extent and size of the area identified
by ADMS is approximately three thousand six hundred square
meters (3,600 sqm.); and

b. The possibility of shortening the twenty five (25) – year
duration/period of effectivity of the proposed MOA.
This is to respectfully inform that the approval and execution of the proposed MOA is
deferred upon submission of the requested detailed purpose and/or development plan and the
acquiescence of the PNP to the shortening of the duration/period of effectivity.

The Authority, upon recommendation of the Board, also advised to acquire land use from the
local government units for the establishment of the PNP – AVSEU 10 Headquarters pending
approval and execution of the subject proposed MOA.

In consideration of the observations and recommendations of the members of the CAAP


Board of Directors, may we respectfully request for a coordination meeting between your
good office and CAAP concerned units such as:

1. CAAP Security and Intelligence Service (CSIS);


2. Aerodrome Development & Management Service (ADMS);
3. Laguindingan Airport Manager; and
4. Enforcement and Legal Service

at a mutually acceptable date and time.
