15 Pursuant to Paragraph 3 of Letter of instructions (LOI) 588 (Designation of a
16 Pollution Control Officer by All Entities Discharging or Emitting Substances) dated
17 19 August 1977 and Executive Order 192 (Providing the Reorganization of the
18 Department of Environment, Energy and Natural Resources; Renaming it as
19 Department of Environment and Natural Resources) dated 10 June 1987, Presidential
20 Decree (PD) 1586 (Establishing an Environmental Impact Statement System Including
21 Other Environmental Management Related Measures and for Other Purposes),
22 Republic Act (RA) 6969 (Toxic Substances and Hazardous and Nuclear Wastes
23 Control Act of 1990), RA 8749 (Philippine Clean Air Act of 1999), RA 9003
24 (Ecological Solid Waste Management Act of 2000) and RA 9275 (Philippine C lean
25 Water Act of 2004), and their respective Implementing Rules and Regulations (IRR),
26 this Guidelines for Pollution Control Officer (PCO) Accreditation is hereby issued.

28 Section 1. Basic Policy.

30 It is the policy of the State to pursue a policy of economic growth in a manner
31 consistent with the protection, preservation, and revival of the environmental quality
32 of water bodies, air, and land.

34 Section 2. Objectives.
35
36 This Administrative Order shall have the following objectives:
37
38 a. To effectively enforce all environmental laws by establishing linkages
39 among the (1) Department of Environment and Natural Resources, (2)
40 industrial establishments which are potential and actual sources of
41 pollution, and (3) local government agencies;
42 b. To carry out the national policy of maintaining a standard quality of the
43 environment; and
44 c. To streamline the requirements for the accreditation of Pollution Control
45 Officers.

48 Section 3. Scope and Coverage.

50 This Order shall cover the accreditation of PCOs or establishments that
51 discharge solid, hazardous – liquid or gaseous – wastes to the environment or whose
52 activities, products, or services are actual and/or potential sources of land, water, or
53 air pollutions. Likewise, it shall apply to local government units (LGUs), development
54 authorities, government-owned and controlled corporations, and other public
55 establishments.

57 Ambulant vendors and stall owners as defined under RA 6977 ("An Act to
58 Promote, Develop, and Assist Small and Medium Enterprises Through the Creation of
59 a Small and Medium Enterprise Development (SMED) Council, and the
60 Rationalization of Government Assistance Programs and Agencies Concerned with the
61 Development") as amended by RA 8289 (An Act to Strengthen the Promotion and
62 Development of. and Assistance to Small and Medium Scale Enterprises, amending
63 RA 6977. otherwise known as the "Magna Carta for Small Enterprises"), and materials
64 recovery facilities (MRFs) operated by barangays that do not handle hazardous wastes
65 are exempt from the coverage of this Order.

67 Section 4. Definition of Terms.

69 For the purposes of this Order, the following terms shall have the following
70 meanings:

72 a. Ambulant Vendors – either itinerant or semi-static. Itinerant vendors are
73 those who go around shouting their ware while semi-static vendors are
74 those who are in semi-fixed positions but may move about as the situation
75 necessitates.

77 b. CMR – Compliance Monitoring Report

79 c. EMB – Environmental Management Bureau (EMB).

81 d. Department – Department of Environment and Natural Resources (DENR).

83 e. Director – the Director of the EMB Central Office.

85 f. Economic Activity – the activity of the establishment as classified under
86 the Philippine Standard Industrial Classification.

88 g. Environmental Aspect – the element of an organization's activities or
89 products or services that can interact with the environment (ISO 14001
90 definition).

92 h. Environmental Impact – any change to the environment, whether adverse
93 or beneficial, wholly or partially resulting from an organization 's
94 environmental aspects (ISO 14001 definition).

96 i. Environmental Incident – an incident that has caused, or has the potential
97 for causing pollution to the environment.

99 j. Environmental Management – the entire system which includes, but is
100 not limited to, conservation, regulation, and minimization of pollution;
101 waste management; environmental law and policy environmental education
102 and information study and mitigation of the environmental impacts of
103 human activity; and environmental research.

105 k. Establishment – a recognizable economic unit under a single ownership or
106 control, i.e., under a single legal entity, which engages in one or
107 predominantly one kind of economic activity at a single physical location.
108 This includes industrial, commercial, and institutional establishments.

110 l. Highly Urbanized Cities – cities with a minimum population of two
111 hundred thousand (200,000) inhabitants as certified by the Philippine
112 Statistics Authority, and with the latest annual income of at least Fifty
113 Million Pesos (PHP 50,000,000.00) based on 1991 constant prices, as
114 certified by the city treasurer.

116 m. Installation – a system of machinery or other apparatus set up for use.

118 n. Letter of Instruction 588 – the Designation of a PCO by All Entities
119 Discharging or Emitting Pollutants.

121 o. Managing Head – the highest executive officer of the establishment (i.e.
122 President, General Manager, Factory/Plant Manager, Managing Director,
123 Managing Partner, Chief Executive Officer, or Local Chief Executive).

125 p. Memorandum Circular (MC) 2007-003 – the Policy on Compliance and
126 Permitting for Industrial Facilities Relating to Air Quality.

128 q. Organization – a group or association of individuals who are joined
129 together either formally or legally. This includes a corporation,

130 government, partnership, and any type of civil or political association of
131 people.

133 r. PCO Accreditation – is the process of determining the qualifications of
134 interested applicants as Pollution Control Officer where a Certificate of
135 Accreditation is issued by the EMB Regional Office in compliance with the
136 Duties and Responsibilities as stated in Section 8 of this DAO.

138 s. Pollution Control Facility – any structure, including, but not limited to,
139 contrivance, facility, system, device, or mechanism which can adequately
140 control and/or abate liquid or gaseous wastes or sound pollution within the
141 allowed quality of standards of the Department.

143 t. Pollution Control Officer

145 ▪ Designated Pollution Control Officer – a technical person competent
146 in pollution control and environmental management, duly recognized by
147 the Managing Head or LGU to perform the duties and responsibilities of
148 a PCO in a particular establishment.

150 ▪ Accredited Pollution Control Officer – a technical person duly
151 recognized by the EMB Regional Office for fully complying with all the
152 environmental laws, including its respective permits and clearances.

154 u. Pollution Source – a process, equipment, or facility installation that
155 discharges solid, liquid, or gaseous wastes to the environment.

157 v. Regional Director – the Director of the EMB Regional Office.

159 w. Secretary – the Secretary of the Department of Environment and Natural
160 Resources.

162 x. Small stand-alone establishment – a free standing establishment under
163 Category A of this Order which has its own area and is solely operated by
164 one management.

166 y. SMR – Self-Monitoring Report

168 z. Technical Conference – a meeting between the EMB Regional Office and
169 the respondent with or without the presence of a complaint for the purpose
170 of discussing/clarifying particularly environmental concerns, pollution
171 prevention commitment and appropriate technical solutions, a nd/or
172 remedial measures for the prevention, abatement, or mitigation of
173 pollution.

174 Section 5. Criteria for the Designation of PCOs.

176 The following are the criteria and conditions in Designating a PCO.

178 5.1 Minimum Competency Requirement.

180 The designated PCO must be a Filipino citizen of legal age, mentally
181 and physically healthy, and with good moral character. He/She must have the
182 following qualifications as a minimum competency requirement:

184 a. Category A Establishments

186 1. At least a graduate of senior high school with academic track on
187 Science, Technology, Engineering and Math (STEM), or any TESDA
188 course related to pollution control or environmental management.

190 2. Owner of the establishment or an employee for at least six (6) months
191 performing environmental management-related functions.

222 5.3 Type and Size of Industry/Institution Allowed for Clustering

224 a. Companies with Multiple Installations.

226 For companies with multiple installations (e.g., telecommunication
227 companies, power transmission substation, distribution station, water pumping
228 station, sewage/septage treatment facilities, banks etc.) at different locations or
229 regions, the Regional Director shall require a minimum of one PCO per region.
230 For regions with Highly Urbanized Cities (HUC), an additional one PCO per
231 HUC shall be required by the Regional Director.

234 b. LGUs and Other Government Institutions.

236 Government institutions and LGUs that operate establishments but not
237 limited to slaughterhouses, public markets, and hospitals, and whose activities
238 necessitate the appointment/designation of a PCO designate a PCO as defined
239 in Table 1 of this Order.

241 c. Category A and other Small Stand-alone Establishments.

243 Category A and other Small Stand-alone Establishments may apply for
244 clustering for the designation of one PCO and one Managing Head, subject to
245 the approval of the EMB Central Office upon the recommendati on of the EMB
246 Regional Office considering the following criteria:
247
248 1. Clustering is applicable to industries/institutions and other small stand-
249 alone establishments which fall under Category A of this Order;
250 2. Establishments applying for clustering shall have the same owner or
251 belong to one corporation, chapter, or similar groups;
252 3. Clustering shall be within the same city in the National Capital Region,
253 other HUCs and same province in other Regions;
254 4. A cluster shall have a maximum of 20 establishments.

256 The PCO of clustered establishments must comply with the minimum
257 competency requirements for Category B establishments.

260 d. Clustering Requirements

262 The clustering of establishments may be granted, provided the
263 establishments are within the operational service area where permits and
264 clearances are secured. Such will ensure that the EMB Regional Office can
265 regularly monitor the operation and assess/evaluate compliance with
266 environmental requirements. Clustering may be approved on a case -by-case
267 basis depending on the area-based assessment contingent on the LGU
268 classification in relation to its province, either HUCs, component cities, or a
269 combination of the two.

271 Application for clustering must be submitted to the concerned EMB
272 Regional Office enclosed with the following documents:

274 1. A request letter addressed to the EMB Regional Director;
275 2. List of individual establishments or branches to be clustered, including
276 complete addresses; and
277 3. Waste description and volume of waste generated per establishment.

280 Section 6. Accreditation of PCOs.

282 The Managing Heads of establishments, Head of Office for LGUs, and other
283 government institutions shall apply for the accreditation of their designated PCO at
284 the concerned EMB Regional Office provided the following requirements have been
285 complied:

287 Section 6.1 Requirements

289 The Managing Head, or his/her duly authorized representative, shall
290 submit to the concerned EMB Regional Office the following requirements for
291 the accreditation of his/her PCO and pay the processing fee to the concerned
292 EMB Regional Office:

294 1. Compliance of Discharge Permits (DP), Permit to Operate (PTO), and
295 other related permits;
296 2. Letter of designation as PCO of the establishment;
297 3. Notarized Affidavit of Joint Undertaking of the PCO and the Managing
298 Head
299 4. Certificate of Completion for the forty (40)-hour Basic PCO Training
300 Course issued by an EMB-recognized training organization/institution
301 together with its valid Certificate of Recognition.
302 5. A certificate that the Managing Head attended an eight (8) -hour
303 training on environmental management covering the basic
304 environmental laws, rules, and regulations, and the duties and
305 responsibilities of the PCO issued by an EMB-recognized training
306 organization/institution together with its valid Certificate of
307 Recognition.

309 The Owner or the Managing Head of Category A establishments may act
310 as PCO of the establishment provided that he/she shall attend the forty (40) -
311 hour training as required for PCO accreditation.

314 Section 6.2 Processing
315
316 The EMB Regional Office, upon review and evaluation of the submitted
317 requirements, will proceed with the processing of the submitted application for
318 accreditation as follows:
319
320 1. The Regional Director (RD) shall act on the application based on the
321 template provided in Annex D of this Order for accreditation of the

322 appointed/ designated PCO within fifteen (15) calendar days from
323 receipt of the application. For approved applications, the RD shall issue
324 the "Certificate of Accreditation" (using the attached template as Annex
325 E) containing, among others, the responsibilities and accountabilities
326 of the PCO and the Managing Head of establishments. However, for
327 denied applications, the RD will officially inform the establishment of
328 the grounds for denial.
329 2. The EMB Regional Offices shall prepare a database of its accredited
330 PCOs and shall furnish the EMB Central Office for consolidation and
331 documentation every end of the month.
332 3. The concerned EMB Regional Office shall charge a processing based
333 on the DENR-EMB approved rate.
334 4. For areas under the jurisdiction of LLDA, a separate guideline shall
335 apply.

337 Section 7. New PCO in Case of Resignation or Termination.
338
339 In case of resignation or termination of the services of the PCO, the The Owner
340 or the Managing Head shall designate a new PCO. He/she shall inform, in writing, the
341 concerned EMB Regional Office within fifteen (15) calendar days and direct the
342 proponent to issue designation for the new PCO within thirty (30) calendar days from
343 the date of resignation or termination.

345 The Owner and/or Managing Head shall immediately assume the
346 responsibilities as interim PCO until such time that a new PCO shall have been
347 designated. In case the Owner and/or the Managing Head of the establishment is of
348 foreign nationality, the next highest-ranking Filipino Officer shall assume the
349 responsibilities of the PCO.

351 The accreditation of a PCO who has resigned or been terminated shall be
352 considered automatically revoked upon his/her resignation or termination. A new
353 accreditation shall be secured from the concerned EMB Regional Office if the PCO
354 transfers and assumes the PCO position in another establishment.

357 Section 8. Duties and Responsibilities of Designated and/or Accredited PCOs.
358
359 The designated and/or accredited PCO shall perform among others the
360 following duties and responsibilities:
361
362 a. Ensure compliance with PD 1586, RA 6969, RA 8749, RA 9003, RA 9275,
363 and their existing rules and regulations:
364

367 • Compliance with ECC conditions and its Environmental
368 Management and Monitoring Plan;
369 • Submission of CMR on semi-annual basis using online system;
370 • Apply ECC amendment for any project modifications; and,
371 • Secure ECC for LGU Waste Management Facilities such as SLF,
372 MRF, Large Scale Composting Facility, WTE, and the likes.

376 • Ensure the proper operation and maintenance of the wastewater
377 treatment facilities;
378 • Ensure compliance with the effluent standards with the attachment
379 of the latest laboratory results from DENR-recognized
380 environmental laboratory
381 • Secure Discharge Permit (DP) using the OPMS and/or the existing
382 online application system used by the EMB RO.
383 • Monitor and secure necessary permits from DA and its attached
384 agencies for wastewater that will be reused for irrigation and other
385 agricultural purposes, if applicable
386 • Re-apply a discharge permit through OPMS if there will be
387 changes/modification in the previously submitted Engineers' Report
388 and other requirements such as but not limited to increase in
389 discharge wastewater volume, method of treatment, and disposal of
390 effluent
391 • Submit SMR on a quarterly basis using an online system
392 • Secure Certificate of interconnection (for PEZA locators and
393 establishments/industries connected to centralized wastewater
394 facilities of the water service provider), if applicable;
395

398 • Ensure compliance with the emission and ambient air quality
399 standards with the attachment of laboratory result and/or Source
400 Sampling Test Result/CEMS/COMS;
401 • Secure PTO on all point and non-point emission sources using the
402 OPMS and/or the existing online application system used by the
403 EMB RO;
404 • Submission of SMR on a quarterly basis using online system ;
405 • Report plant operational problems such as but not limited to
406 breakdown of APSI, APCD and CEMS/COMS per EMB MC 004,

407 Series of 2011 within 24 hours including the steps undertaken to
408 solve the problem and prevent its recurrence;
409 • Apply Permit to Operate for amendment through OPMS if there are
410 changes/modification in the previously submitted Engineers' Report
411 and other requirements such as but not limited to type of fuel used,
412 increased capacity in APSI/APCD, and additional APSI/APCD
413 subject for re-evaluation;
414 • Ensure transmission of real time CEMS/COMS data to EMB RO and
415 CO. (for plants with CEMS/COMS);
416 • Maintain and calibration of ambient air quality monitoring
417 stations/CEMS/COMS. (for plant with ambient monitoring stations
418 and CEMS/COMS);
419 • Submit RATA yearly and CGA quarterly (for plant with
420 CEMS/COMS);

424 • Ensure environmental compliance of SWM Facilities provided
425 under the approved 10-year solid waste management plan by the
426 Head of Office and PCOs. The LGU SWM Board shall
427 develop/update the Ten Year SWM Plan and secure NSWMC
428 approval;
429 • Secure ECC, DP and PTO for LGU owned Sanitary Landfills/WTE
430 and the likes including SLFs/WTE owned under Public Private
431 Partnership (PPP);
432 • Secure Hazardous Waste Generator ID and TSD Registration for
433 MRFs consolidating household hazardous wastes/special
434 waste/household healthcare wastes;
435 • Ensure the proper operation and maintenance of the solid waste
436 segregation/management facilities such as MRFs, sanitary landfills,
437 composting facilities.

441 Title II: Chemicals
442 • Secure Pre-Manufacture Pre-Importation Notification (PMPIN) (for
443 importer and manufacturer of new chemicals), if applicable;
444 • Submit Notice of Commencement after 3 weeks of first arrival (for
445 listing of new chemical in PICCS);
446 • Secure small quantity importation (SQI) clearance (for importer and
447 manufacturer of new chemicals with less than 1,000 kg/year) ;
448 • Secure Polymer exemption certificate (for importer and
449 manufacturer of new polymers);

450 • Secure Priority Chemical List (PCL) Certificate (for importer,
451 manufacturer, distributor, and user);
452 • Secure Chemical Control Order (CCO) Registration Certificate (for
453 importer, manufacturer, distributor, user, and waste service
454 provider);
455 • Secure CCO Importation Certificate (for importers);
456 • Submit SMR on a quarterly basis using online system.
457 .
458 Title III: Hazardous Waste
459 • Secure Hazardous Waste Generator Registration Certificate at
460 hwms.emb.gov.ph;
461 • Secure permit to transport before actual hauling and submit
462 completed manifest within 7 days upon receipt of the TSD (for
463 generator only);
464 • Secure TSD registration certificate, and issue certificate of
465 treatment within 45 days upon receipt of the hazardous waste (for
466 treater only);
467 • Secure transporter and TSD registration certificate (for both
468 transporter and treater);
469 • Secure importer registry and importation clearance for recyclable
470 materials containing hazardous substances, (for importer of
471 recyclable materials);
472 • Secure export clearance for hazardous waste following the prior
473 informed consent of the Basel Convention, (for export er of
474 hazardous waste);
475 • Comply with the handling, storage, and labeling requirements of
476 DAO 2013-22 (for generator, treater, transporter, importer, and
477 exporter);
478 • Submit SMR on a quarterly basis using online system.

480 b. In case of emergency situations, the following shall be complied:
481 i. Immediately notify and submit a report within 24 hours EMB Regional
482 Office and/or the respective Provincial Environmental Management
483 Units (PEMU) of any emergencies or incident due to accidental
484 release of wastewater to as but not limited to spillage, breakdown or
485 damage on the WTF, Pollution Control Device, force majeure, and the
486 like;
487 ii. Respond to emergencies that can prevent or minimize damage to
488 equipment, land, groundwater, and/or public health, including
489 incident of fish kills, chemical and oil spills, among others; and
490 iii. Submit Action Plan within seven (7) working days from su ch incident
491 a report detailing the cause(s) and the steps undertaken to solve the
492 problem and/or to prevent its recurrence.

493 c. Attend, as duly authorized representative of the establishment, technical
494 conferences, hearings, and meetings, especially on matters pertaining to
495 pollution cases of the establishment where he/she is employed;
496 d. Act as liaison officer to EMB and keep himself/herself abreast with the
497 requirements of the Department;
498 e. Coordinate regulatory programs and activities with the
499 city/provincial/municipal governments;
500 f. Implement environmental management activities, including awareness
501 campaign within their organization and actively participate in EMB
502 programs and DENR environmental celebrations and activities; and
503 g. Participate in multi-partite monitoring team activities and meetings.

505 The PCO and the Managing Head shall be held jointly and severally liable for
506 any violation of PD 1586, RA 6969. RA 8749, RA 9003, RA 9275, their respective
507 IRRs, and other pertinent rules and regulations committed by the e stablishment.

510 Section 9. Validity of PCO Accreditation.

512 The PCO Accreditation shall remain valid from the date of issuance until unless
513 suspended or revoked by the EMB Office upon violation of any provisions as provided
514 by Section 12 and 13 of this Order.

517 Section 10. Reporting.
518
519 All accredited PCOs shall submit all the required reports to EMB Regional
520 Offices such as SMR (quarterly), CMR (semi-annually), and Emission Test Results as
521 required.

523 ISO 14001 Certified companies may opt to apply for a semi -annual report
524 submission of SMRs, subject to the approval of the EMB Central Office.

526 For establishments with interim PCO pursuant to Section 7 of this Order, the
527 Managing Head shall submit the required reports under this Section.

530 Section 11. Suspension of PCO Accreditation.
531
532 Any of the following shall be the grounds for suspension of PCO accreditation:
533
534 1. Receipt of three (3) notices of violation (NOV) for failure to secure and
535 comply with any applicable permits such as DP, PTO, Hazardous Waste ID,

536 or any combination thereof, including non-compliance with ECC
537 conditions, EMP, EMoP, and incomplete/non-submission of SMRs and
538 CMRs;
539 2. Submitted false documents and/or misrepresented facts in the reports;
540 and/or
541 3. Failure to notify the Bureau within 24 hours from the occurrence of
542 Plant/Industrial Operational Problems resulting to effluent discharges and /
543 or emitting pollutants that exceeds from the standards. This shall warrant
544 not only suspension but shall be subjected to fines and penalties under the
545 provisions of the following Order:
546 i. Part XIII of DAO 2000-81 – RA 8749
547 ii. Chapter XII of DAO 1992-29 – RA 6969
548 iii. PART V, Sec. 3 of DAO 2001-34 – RA 9003
549 iv. Chapter V, Sec.28 of DAO 2005-10 – RA 9275

551 In order to lift the suspension, the PCO shall ensure compliance with the issued

557 Section 12. Revocation of PCO Accreditation.

559 The following shall be considered as gross violations and grounds for
560 revocation of PCO accreditation by the Regional Director, and/or including permanent
561 disqualification from being accredited as PCO of any establishment:

563 1. Receipt of three (3) times suspension orders; and/or
564 2. Willful and deliberate discharge of untreated emissions/effluents and
565 hazardous and toxic substances/wastes.

567 The commission of any of these violations shall, upon due process, result in the
568 revocation of the accreditation of the PCO and/or the permanent disqualification of
569 the concerned person from being appointed as PCO of any establishment. Upon
570 discovery of the existence of any of the grounds for revocation, the Regional Director
571 shall notify the Managing Head of the reason(s) for r evocation.

573 In the event that the accreditation of the PCO is revoked, the Owner and/or the
574 Managing Head shall act as the interim PCO and shall immediately submit the newly
575 designated PCO to the EMB Regional Office and seek accreditation within fifteen (15)
576 calendar days from receipt of the Revocation Order.

581 Section 13. Training for PCOs and Requirements for Training
582 Organizations/Institutions.

585 Only EMB-recognized training organizations/institutions shall provide
586 trainings for PCOs. As part of the recognition process, these training
587 organizations/institutions must meet the minimum requirements provided i n Annex F
588 of this Order. A fee of Php 2,000.00 per application shall be charged by EMB Central
589 Office for the processing of the application for recognition. In addition, all EMB-
590 recognized training organizations/institutions with valid Certificate of Recognition
591 may conduct trainings for PCO Accreditation through an online platform provided the
592 requirements listed in Annex G are fulfilled.

594 Recognized training organizations/institutions shall be required to submit a
595 Semi-Annual Accomplishment Report to EMB every January 15 and July 15 . Their
596 recognition shall be valid for two (2) years and shall be renewed upon submission of
597 the requirements provided in Annex F of this Order.

600 Section 14. Suspension and Cancelation of Recognition of PCO Training
601 Organization/ Institution

603 The recognition of the training institution shall be suspended for failure to
604 accomplish at least 80% of the trained PCO for two consecutive submissions of
605 accomplishment report. In order to lift the suspension, the training institution shall
606 submit a work program within 30 days upon receipt of the suspension order or upon
607 the discretion of the Bureau Director indicating the strategy to augment the number of
608 accredited PCO.

610 Three (3) times suspension shall be a ground for the cancelation of the
611 recognition.

614 Section 15. Separability Clause.

616 If any section of these guidelines is held or declared unconstitutional or invalid
617 by a competent court, the other sections or provisions hereof shall continue to be
618 enforced as if the section or provision so annull ed or voided have never been
619 incorporated herein.

623 Section 16. Amendments.

625 The Environmental Management Bureau is hereby authorized to issue
626 amendments, clarifications, and/or modifications of this Administrative Order as the
627 need arises.

629 Section 17. Repealing Clause.

631 All other previously issued pertinent guidelines, rules, and regulations or
632 portions thereof inconsistent with these guidelines are hereby revised, amended,
633 and/or modified accordingly.

638 of general circulation and upon acknowledgment of receipt of a copy hereof by the
